He explains why in fact the Levitating suit probably shouldn't be litigated. 

I've got to say that I'm really uncomfortable with the way that musicians are constantly being sued over standard constructions and chord progressions. There are already cases of musicians giving credits to others "just in case" and in the long term it'll lead to massively complex issues that prevent new works from being created.
