Setting aside the issue of her culpability, and setting (mostly) aside the issue of her mental health history… it’s being reported that TMZ was tailing her at the time. And I can’t shake the image of Princess Diana’s death being pursued by paparazzi. Maybe there’s a connection, maybe not… I don’t know. But I know there is another celebrity stalker site akin to the old Gawker Stalker. And again I won’t claim any connection, but if she was struggling with her mental health (which she’s been very open about for years) and if TMZ was lurking behind her hoping for a juicy story… then TMZ needs to be ended. And everyone affiliated with them needs to be locked up or financially destroyed.

That does but inspire confidence.

I haven’t done a ton of research, but TMZ isn’t crediting/naming anybody else for the pics and videos at the scene, and stories from every other news site I’ve clicked on only credit TMZ for those images.

TMZ has since “reported” Heche posted an episode of her podcast the day of the accident(s) where she and her co-host were apparently drinking, but most podcasts record days or weeks in advance so that isn’t evidence of anything.

Again, it might just be a coincidence that TMZ happened to be on-scene seconds after the crash…,and also before the crash. Or they might’ve just bought media from bystanders and slapped the TMZ logo on it. And Heche might be solely responsible regardless. But something about this story feels incomplete to me. And since TMZ seems to have been there, I find that suspicious.

I totally endorse the roasting of TMZ and their kind, but so far I don’t think we are seeing any evidence of a Princess Diana like chase by the paparazzi. TMZ is saying they have “obtained” video (I suspect cell phone video from near by residents, or maybe house security video). Also, TMZ is crediting reports from witnesses. I have not seen them refer to their own video or reporters being on the scene at the time.

As was explained to me elsewhere on the interwebs, due to California’s strict laws about stalking, TMZ subcontracts its stalking to freelancers who agree to not stalk celebrities, but can only get paid if they get video or pics by stalking celebrities. So they are TMZ but they aren’t TMZ for liability purposes.

Stalking laws don't apply to journalists. If they applied it to journalists there would be a risk of having the entire law overturned.
I don't know about TMZ staffing in 2022. But about six years ago it was almost all freelance. Not for legal liability but because they don't want to pay benefits. My understanding is if four photographers provide pretty much the same photos they have favored photographers.
Also, if TMZ had photographers to assign I am guessing Anne Heche is low on the list.
The CBS affiliate got home security video that showed Heche driving erratically and no one was chasing her.

From California Penal Code 646.9

f) For the purposes of this section, “course of conduct” means two or more acts occurring over a period of time, however short, evidencing a continuity of purpose. Constitutionally protected activity is not included within the meaning of “course of conduct.”

This is an unrelated celebrity tabloid journalism story but it does give an idea of how the tabloids get these stories.

A friend of mine owns a used bookstore, mostly English language books, in Tel Aviv. A couple of days ago he posted on FB that a young woman with a toddler came into his store to browse and bought some books. When he looked at her credit card it turned out to be Amber Heard. He took a picture of her with a bookstore tote bag.

The next day an Israeli gossip columnist translated his post into Hebrew and published it and the picture without attribution. Later that day my friend posted this link:

For those who understandably don’t want to read a Daily Mail article, it’s about Amber’s trip to Tel Aviv, including a word-for-word copy of the FB post and photo, again without any attribution or  credit. My friend asked about legal action in the comments of the post with the Daily Mail link and someone I don’t know (an attorney apparently) said getting even the best result wouldn’t be worth the money and hassle.

The relationship of this to the Anne Heche story is that TMZ doesn’t need an army of paparazzi or need to send people out to stalk celebrities anymore. They just need to know from a police scanner or social media that something happened to a celebrity and then they can scan Twitter, Instagram, TikTok, etc for footage they can use.

I do think that is exactly what happened here. People in the neighborhood posted cell phone and home security video on social media. TMZ picked it up (with or without permission, but no specific attribution). I don’t think there were TMZ SUVs chasing her down the streets and forcing a crash. But the vultures continually circle, and are sniffing the air, and pounce at first scent.

The FOX affiliate helicopter commentator didn't know who she was and referred to her as a he.
I am guessing this was a wealthier part of LA so a car into a home will get stronger media coverage than, say, a car into a Compton home

As of minutes ago, CNN is reporting Heche is classified as “brain dead” and is only being kept alive so her organs can be donated.

The sad week in Bay City continues; Robyn Griggs (Maggie Cory) died yesterday after a two-year battle with cervical cancer.
