Dear Sub Comm Tier 2 members

This is regarding issue of refund of fit out deposits of Tibrewals.

I have attached excel sheet summarising their 5 flats, violations, deposits against each flat. 

Giving a brief summary below -

1) they have 5 flats but they have paid fit out deposits only for 3 flats i.e 30 lacs.  As per them, the 2 flats were almost ready when society took over and hence there was no requirement to pay fit out deposits
2) on the 60th floor they have 2 apartments and for both apartments there are violations which are mentioned in the excel sheet.  - lobby modification, door extension occupying common space area, making additional storage in lobby.   
3) on the 69th floor they have 2 apartments, where they have modified the lobby and have installed additional storage in common space area.  But we have fitout dep against only one appt. 
4) for the 5th apartment on 68th floor there is no violation

The main violation is door extension on 60th floor for 2 flats but we have fit out dep against only one flat i.e. 10 lacs

On 69th floor violation is additional storage in common area lobby.

We are of the opinion that we can refund 10 lacs against 68th floor where there are no violations.

For the 60th and 69th floor we can hold on the deposits, till corrective measures are taken.  However, we would request your take on this matter as tier 2 sub comm is ideally supposed to monitor this issue of tier 2. 

Also, as most of you must be aware. there are other violations done by them like using a common area to make their house help sleep, have made like a room for them with storage and also are using common electricity of building to charge phones, use for fans and any other purpose.  we have photos of the same.

So kindly advise PMC on this issue as what should be the way forward.

The door extension is done by many villas and not by me alone. Just because i was unfortunate to give you BPD does not make sense to hold only my amount. Either take from everyone or release mine.

East villa door is just for my own security. Lot of people have been to my villa to check my lobby and they have even entered house without my permission.  The reason was explained to jai prakash for which he understood. And also there is no lock on the east villa door. So fire safety is not a problem. 

I was given bare shell villa and lobby.  You can confirm from lodha and JLL team. I hope that allows me to put the door and do lobby as per my choice and shouldn't be a violation. Its an FRD and JLL team has confirmed the same. Its my house and its a violation if i choose a door of my liking? I really want to know what violation it is.

The service lobby is not used by any residents and only for services for my floor only. So i really dont see a problem if staff uses it to sleep there. 

Also the electricity that they are using to charge phones and use fan is paid by me. Its connected to my house metre. Even the light and ventilation system of service lobby is connected to my metre.

So i am actually saving society some money. Please ask JLL team to confirm the same before accusing me of misusing it.

If JLL can prove it otherwise i am happy to rectify it immediately.

I believe tier 2 sub committee has still has not taken charge of the operations. There is no progress since last meeting called by PMC.

I am happy to discuss if called upon but i sincerely feel holding only my BPD is unfair for which i have been following up since 4 months now.

The door extension is already a subject of ongoing discussion  for all the apartments in tier 1 and tier 2. So whatever is decided in the AGM i will  abide by it. 

I would like to meet the PMC and try to solve it amicably. Let me know the time

Dear PMC,

We very much appreciate your reaching out to us for input on this and other issues. Few thoughts on this - 

1. We appreciate the finalisation of scope areas and the effort involved to getting to this point. But we do need closure on the operating model and a proper documented handover of Tier 2 status, including ongoing and past issues, and  plans to address issues highlighted in email sent in May. Till that happens, as has been indicated earlier, the Tier 2 sub-committee is unable to take over the operations. 

2. At this point, we do not have any access to resources, data or context on historical issues. We are also not monitoring what is happening on each floor and as such only get information when we see these emails. It is not feasible to form a point of view on the fly on a series of what seem like sporadic emails on disparate issues. We need access to society resources if this job has to be done properly and not tactically respond to sporadic emails 

3. As a subcommittee we are fully prepared to take over from a policy and stance perspective if and when the handover as requested for happens. We have invested time to discuss and form a clear point on view on policies and we will not allow a violation of these. For instance - this issue of staff sleeping in lobbies is untenable and not allowed as per the policies we have already drafted and shared. We wrote the policies down as we didn't see anything existing on such issues - pls share with us if we have missed it as we would love to incorporate. As a subcommittee, we are of the view that in a community like this where we want to live like a family, without clear written policies, the risk of being perceived as ad hoc by individual home owners on issues pertaining to them is high- and we do want to be inclusive and minimise judgment involved on a case to case basis. 

4. Finally we would request the PMC to decide whether it is planning to fully implement the guidelines signed off by PMC members with the builder where two tier sub committees were to fully manage areas under the respective tiers. Accountability can only come with authority, resources and proper handover - so finalising scope without agreeing on operating model and resourcing will not be be practically executable. Till then we are happy to be helpful and provide informal input and counsel. If there isn't a plan to fully implement what was committed at the time of society formation in writing, you would all agree that the sub committee structure is superfluous in that scenario be disbanded.

Dear Harsh

We are refunding 10 lacs BPD for one of the flats with no violation

changing door as per your like is not a violation 

Violations are - extension and any structural changes doen if any without approvals. 

PMC is responsible from the day they took charge and we are trying to be fair to every member.

We are awaiting revert from tier 2 sub comm for their view on balance 20 lacs.
