[Next Project] The Seagull by Anton Chekhov (trans. by Constance Garnett)

Hello all,

For my next project I'd like to do Chekhov's The Seagull, translated by Constance Garnett. Again, I'll be transcribing and producing.


[PS: I noticed that we have Three Sisters in the Julius West translation. Unfortunately, I haven't been able to find anything evaluating the quality of his translations. If you want the Garnett translation for Three Sisters, I'm willing to eventually transcribe and replace the West translation, but I don't want to step on anyone's toes or anything. Ultimately, it's up to you, Alex, so just wanted to throw this out there if you preferred to have the Garnett translation for SE.]

OK, please send a link to your repo once you start.

I think we want Garnett whenever possible. But since we already have
that book, I would classify that as a very low priority project.

For the cover, I'd like to use The Wounded Gull by Jules Breton, and this link says it's PD: https://www.slam.org/collection/objects/10780/

I assume the TOU is sufficient for PD proof? If not, then this scan should do.

(I’m not managing this so I’ll leave it to Lukas to explain, but I liked the image enough to go looking for actual PD proof. I found this image in a St. Louis Post-Dispatch from 1925, but the quality is so low that it’s arguable.

Hello Robin,

That's the same newspaper I linked to above, and the next page after the one you linked to is a clearer image, so hopefully that one should work.

I assume that the TOU from the museum is not sufficient, then? If not, I'd like to know why.

I think the scans are OK to use. I'll add it to the DB and assign it. It's a good thing you managed to find scans, because that statement from the museum doesn't mention anything about the images being CC0, which is our requirement. That's not exactly the same thing as being PD unfortunately.

OK. I decided to read the CC0 FAQ, and now I think it makes sense to me. I had previously looked at https://standardebooks.org/manual/1.8.4/single-page#10.3.3.7.5, and since there was clear TOU,  it seemed that the "no other licence information" objection didn't apply. And since there wasn't a CC licence, there wasn't a "CC licence other than CC0," so I didn't think that objection applied either. (However, I had a suspicion that something was up, so I made sure to find scans, and I'm glad I did.)

Based on the CC0 FAQ, it sounds like even if the museum that holds the artwork says that it's in the public domain, and gives us clear TOU that state we can use it without restriction, we still don't actually have the legal right to apply the CC0 licence to the image (which we do with all our ebooks), unless we find a scan of the painting in a PD book. (Or if the museum applies the CC0 licence themselves.) Correct?
