The following was copied from the April 2024 issue of American Motorcyclist, the AMA's publication.

Lane filtering and passing bill passed by Colorado Senate, moves on to House of Representatives

By Keaton Maisano

The Colorado Senate voted 22-8 (with five excused) in favor of passing Colorado SB24-079 – a motorcycle lane filtering and passing bill – marking the furthest such a bill has progressed in the state’s history.

The bill – which was passed by the Senate on third reading on Feb. 13 – allows for motorcycles to pass stopped cars while traveling a speed that does not exceed 15 mph. Under these terms, Colorado would become the first lane-filtering state to require vehicles to be at a complete stop before a motorcyclist can overtake them.

While SB24-079 saw initial pushback from the Colorado State Patrol Association, County Sheriffs of Colorado and the Association of Chiefs of Police, it passed a Feb. 7 hearing of the Colorado Senate Transportation and Energy Committee after three amendments were added. The amendments included a reduction in motorcyclist speed from 20 to 15 mph while passing; the requirement for vehicles in the lane to be completely stopped before overtaking; and the need for the Colorado Department of Transportation to gather traffic accident data and report to the legislature no later than January 2027 about the efficacy of the proposed law.

Upon the bill’s introduction in the House of Representatives, Representative Ron Weinberg (R – Loveland) joined Representative Javier Mabrey (D – Denver) as a Co-Prime sponsor. The bill needs to pass the House Transportation Committee before facing a full House floor vote. As of publication, the bill has not been assigned to committee.

The AMA, which closely followed and supported the progression of SB24-079, endorses the practice of lane splitting, given its long-term success in California and research showing it enhances motorcycle safety.

Gonna toot our horn a little here - one of the sponsoring state Senators, Nick Ninrichson, is a BSM member, and a couple of us board members testified a couple of times to help get that bill through.  It's actually further along than this article describes - it passed the senate, the house with amendments, and then the senate accepted the amendments. It's on Polis' desk and he is expected to sign it.

Cheers,

Jim

If we’re just finding out about this., then it’s probably not getting much attention elsewhere. Without the other road users informed, the usual mix of zoned-out dullards, distracted texters, and rage-addled psychopaths we encounter could be a problem. I hope CDOT and the CSP get the word out so we can enjoy it!

Cheers!

Steve

There is money for general education included in the bill.  If it gets signed, it will make the news.

Jim,

Thanks for the work that you guys put in to get this done. I know that it takes a lot of time and effort to get anything through the legislature and my hat is off to you all.

So I just got word, Polis has signed this bill; it becomes effective Saturday, August 17th at 12:01 AM.  There's a three-year renewal, so we'll have to do this again to keep it, but so far no state that has instituted it has ever failed to renew it permanently (Utah and Montana are the two).

Wonderful.  They just need to let the cars and pickups know we are not “cheating”

Agreed Vince. More importantly, let’s hope that the other road users don’t act like jealous children and try to stop motorcyclists from availing themselves of their right-of-way.

After living in "ScCal" for 8 years,l have a few reservations on this one.Just hoping this will not get abused on either side and that enforcement is done within reason, besides, cell phones and 8"-20" center stack screens did not exist back then.........
