Guys i will be brief, do not listen to anyone who says pay anything, Baron
Deschauer has been forced into insolvency on two of his companies by the
Secretary of state, pls search his name followed by "insolvency" you will
see that both Broomfield and Lakeview are finished. I am doing all i can to
make sure the rest of his companies go the same way and will update you
here. Baron knows his days are numbered and is trying to eek out any penny
he can before he is completely closed down. The sites will never get
planning, but at least you can stop paying charges. if anyone has a small
claim letter, i suggest responding saying 2 things 1. the contract included
finance and the company selling you the land was not licensed, 2. you are
being asked to pay to maintain roads that do not exist, in law a positive
covenant, involves a burden and benefit, as there are no roads you cannot
benefit, so you should not have the burden. just say you are happy to lose
the right to use roads( that will never exist) in return for the company,
not to enforce the covenant. we have land at Bluebell and this was my
response;
 
As stated in our original letter to the court we visited the site on
October 1st this year and complained about the condition of the access road
“Hill road”, Terracorp have made it clear on page 4 of their defence that
Hill Road is not owned by them nor forms part of the positive covenant.
There are therefore no roads , paths , drive tracks, access ways and
verges to maintain, or that have been maintained, the whole site is one
big field used to cultivate hay. It is highly unlikely there will ever be
any roads allowed on this site, it is within the green belt and designated
an area of outstanding beauty and as such will never have the ability to
use our benefit. It follows that Terracorp have not had any costs.
 
In *Rhone v Stephens* Lord Templeman said the following *“ In Halsall v
Brizell the defendant could, at least in theory, choose between enjoying
the right and paying his proportion of the cost or alternatively giving up
the right and saving his money.” *We have not had our right and it is
highly unlikely we ever will. In order to save costs and the Courts time,
we are happy to give up our benefit 10.(B) in return for Terracorp
accepting that 10.(A) e is no longer enforceable.
 
i am in touch with the insolvency service about all Barons companies, not
by mail i had a call with an investigator this week, the small claims
process takes some time, hopefully we can close all cases once the
Secretary of State gets involved, it may be we all need to contact them, i
will be back if that is the case. i have spent much time on this man, he is
finished, i will be back please be patient.

My family and I have invested over £200K into Lakeview and Gilbert Estate land banking scams. Now we are being chased by the courts for backdated maintenance fees for this land. The bailiffs just showed up and I was forced to pay the fees. I was totally unaware that there were any court order against me until I found out that they were sending all letters to my old address. I have filed a N244 form to have the original judgment set-aside. It appears he is desperate and filing small court claims against all his previous victims. When I went to his land sales seminar I noticed many of his victims are pensioners or of ethnic minority with a very limited understanding of English. It really pisses me off that he will use his knowledge of property laws to rip off the most vulnerable people in our society. I can imagine that alot of his victims will just pay the charges to save the hassle. It really bugs me that he is still making money from his scams even after it has been revealed. What bugs me more is he is using the courts to help him extort more money from his helpless victims. 

This guy needs to be put out of business ASAP. Let me know if I can help in any way.

I hope this guy gets what he deserves.

My parents have plots of land that are apparently being managed by Terracorp (uk) limited, directed by Baron Deschauer. My dad has now received letters from bailiffs due to him not paying his covenant charges. Is there anything my parents can do to fight this? They've been paying out not a small sum of money for a number of years now, for no benefit of which i can see. Any advice on how to fight this guy would be appreciated.

Are you parents still paying the covenant charge and being harassed by Terracorp/Baron Deschauer?

There is now an action group set up to fight the covenant charge and it has hired a contract law expert.  Barrister Helen Swaffiled of Contract Law Chambers has been engage and she will be representing the member of the group.  The name of the group is Land Banking Victims Association and you can contact them @ in...@landbankvictims.com or phone them on 0203 287 9270.  They will send you details on how to join the group.

Hundred have fallen victim to the land banking scam.  Individually, we cannot fight either Terracorp or its owners. We can only take him on as group.

I'm also in a situation where may parents bought 3 plots from Glenridge Estate (Bucks) Limited (now dissolved) a few years ago, they have paid the plots of in fall and are now paid the "Annual Covenant Charge" to Terracorp (UK) Limited which goes up by 10% each year and is also owned by Baron Alexander Deschauer. 

He has scammed my parents out of thousands of pounds, can someone please advise on this on going court case and how we can get involved?
