The Independent Electoral Commission (INEC) says the Labour Party (LP) and Peter Obi, the presidential candidate, have refused to pay the N1.5 million demanded to access documents they are requesting.
Abubakar Mahmoud, counsel to INEC, spoke at the sitting of the presidential election petitions court on Wednesday.
Mahmoud was responding to claims by Levy Uzoukwu, counsel to the party and its candidate, that the commission has refused to release necessary documents requested by them to present as evidence in the suit challenging the outcome of the presidential election.

The Court of Appeal in Abuja on Friday adjourned indefinitely a suit seeking to stop Bola Tinubu from being sworn-in as president on 29 May.
It comes barely 10 days to the scheduled swearing-in, a strict constitutional event any court would have hardly altered its dates on speculative grounds.
Mr Tinubu of the All Progressives Congress (APC) won Nigeria’s 25 February presidential election, defeating former vice president Atiku Abubakar of the PDP and Labour Party’s Peter Obi.
But a former presidential candidate of the defunct Hope Democratic Party (HDP), Ambrose Owuru, who claimed he was deprived of his victory in the 2019 election, filed a suit that asked for a court order to stop Mr Tinubu’s inauguration.
He urged the court to order him to be sworn in as president instead of Mr Tinubu to compensate for the injustice of depriving him of his acclaimed victory in 2019.
Mr Owuru, a serial presidential candidate, did not contest the 2023 presidential election. His party has been deregistered by the Independent National Electoral Commission (INEC).
He lost at the Federal High Court, and then proceeded to appeal at the Court of Appeal.
After taking the arguments of lawyers to parties in the suit on Friday evening, a three-member panel of the Court of Appeal headed by Jamil Tukur, adjourned indefinitely to deliver judgement.
Mr Tukur said a date for verdict would be sent to parties in the suit.
At the resumed proceedings on Friday, neither Mr Buhari nor the Attorney-General was represented in court.
Despite being served with a hearing notice, Mr Buhari whose second term as president ends on 29 May, did not file any court papers.
But the electoral umpire’s lawyer, Hassan Halilu, urged the court to dismiss the suit for being frivolous.
Mr Owuru claims to be the adjourned “constitutional winner” of the 2019 presidential election.
Mr Halilu further informed the court that Mr Owuru’s case “is baseless and irritating.”
Mr Tinubu’s lawyer, Adelani Ajibade from the law firm of Chief Wole Olanipekun, SAN, argued that Mr Owuru’s suit “is strange and baseless”.
He said the plaintiff’s case is bereft of merit and should be dismissed.
The lawyer informed the court that Mr Owuru’s claim to have won the 2019 had been dismissed by a Supreme Court judgment which nullified his petition filed challenging Mr Buhari’s victory.
Mr Ajibade prayed for a dismissal of the case with N20 million cost to be imposed on Mr Owuru and in favour of the respondents.
The plaintiff urged the court to stop Mr Buhari, the AGF and INEC taking steps to facilitate Mr Tinubu’s swearing-in in 10 days’ time.
Mr Owuru argued that neither Mr Tinubu nor anyone else should succeed Mr Buhari, because he has yet to serve his statutory term of four years as Nigeria’s president.
MR Owuru accused the outgoing president of usurping his tenure since 2019.
He falsely claimed that the Supreme Court had not determined his petition against Mr Buhari’s victory in 2019.
“An order of prohibitory injunction compelling Buhari, AGF and INEC, their servants, agents … from any further undertaking or engaging in any act of usurpation of adjudged acquired Constitutional rights and mandate as winner of the 2019 presidential election,” court filings showed Mr Owuru urging the court.
In addition, he sought an order directing and placing on notice that any form of handover inauguration, organized and superintended by Mr Buhari on 29 May 2023 outside his “adjudged winner” of the 2019 presidential election.
Meanwhile, the appellate court evicted Mr Owuru from the inner bar – the front section of the court exclusively reserved for Senior Advocates of Nigeria (SANs).
Upon filing into the courtroom on Friday, the appellate court panel sighted Mr Owuru seated in the reserved seat.
Mr Tukur who led the panel asked Mr Owuru to vacate the seat, wondering when he was conferred the prestigious title of a SAN.
Attempts by Mr Owuru to sway the justices to allow him hold on to the seat was rebuffed.
Mr Owuru was called to the Nigerian Bar 40 years ago.
The lawyer, despite his scanty votes in the previous election, had challenged the outgoing President Buhari’s victory in the 2019 election. His case failed spectacularly as it was dismissed by the Presidential Election Petition Court.
Mr Owuru pursued the case further to the Supreme Court which also dismissed the suit as “a gross abuse of court processes.”

President Muhammadu Buhari Thursday in Seoul, South Korea, witnessed the signing of the Memorandum of Understanding between Nigerian National Petroleum Company (NNPC) Ltd. and Daewoo Group of South Korea for the rehabilitation of the Kaduna refinery.
According to a statement by the Special Adviser to the President on Media and Publicity, Femi Adesina, titled ‘Kaduna refinery rehabilitation gets boost as President Buhari witnesses signing of MoU between NNPC Ltd and Daewoo Group in Seoul’, Buhari thanked the government of South Korea, for its generosity in the rehabilitation of both Kaduna and Warri refineries.
He described the agreement as “very significant,” noting that “technology transfer is not easy.”
Speaking during his meeting with the Speaker of the National Assembly of the Republic of Korea, Kim Jin-Pyo, on the sidelines of the World Bio Summit 2022, he said he is particularly excited as the signing came on the heels of the ongoing rehabilitation at the Warri refinery by the same Daewoo Group which will at the first instance, deliver fuel production before the first half of 2023
At the signing, Buhari said: “Daewoo Group has massive investments in the automobile, maritime and other sectors of our economy.
“I am also aware that Daewoo is currently engaged in the execution of the NLNG train seven project and also constructing sea-going LPG vessels for NNPC and her partners.”
He said he looked “forward to the delivery of ongoing projects, especially at the Warri and Kaduna refineries, and the NLNG Train Seven,” stressing that “This no doubt will open many more windows of oppourtunities for Daewoo and other Korean companies in Nigeria.”
“I thank you for your faith in Nigeria,” Buhari told the Korean conglomerate at the end of the signing ceremony on the last day of his visit to the Asian country to attend the First World Bio Summit.

The United States President Joe Biden has announced a delegation that will attend the swearing-in of the former Lagos State Governor, Bola Tinubu as the 16th President of Nigeria at the Eagle Square, Abuja, on Monday.
The White House in a late Monday statement disclosed that the nine-member US delegation would be led by the Secretary of the US Department of Housing and Urban Development, Marcia Fudge.
The announcement came as the Federal Government tightened security across the Federal Capital Territory ahead of the inauguration ceremony.
Top security sources told our correspondents that security agencies had started raiding hideouts of criminals and thugs who could be used to foment trouble on the inauguration day.
Against the backdrop of protests by some Nigerians dissatisfied with the election victory of the former Lagos State governor, security agencies have deployed plainclothes and intelligence operatives to contain any outbreak of violence on the day of the inauguration.
With less than a week to D-Day, law enforcement agencies have been placed on red alert as they heightened security in preparation for the event which is expected to attract no fewer than 65 Heads of State, diplomats, other representatives of foreign governments and heads of international organizations and prominent Nigerians.
The PUNCH gathered on Tuesday that security agencies including the elite Presidential Guards Brigade, the police, Department of State Services operatives and men of the Nigerian Security and Civil Defence Corps had been given strict orders about their responsibilities in terms of general security, and protection of dignitaries.
It was gathered that more undercover and intelligence operatives had been dispatched to different parts of the city, including dark and vulnerable spots to ensure hitch-free activities.
A security source stated, ‘’We have been carrying out confidence-building and visibility patrols. By Friday, Eagle Square would be shut down. Because of the influx of people in Abuja, we have been combing and monitoring areas, including drinking joints and clubs.
Police ready
‘’We do 24-hour patrols now. We have more men in plain clothes on duty. The security agencies are also raiding black points and any suspects found there will be arrested and cautioned.”
A senior officer disclosed that the ongoing operation was an inter-agency security collaboration to ensure that the inauguration recorded no incident.
“We have been ordered to ensure that security around Abuja is tight. We would be doing this alongside other security agencies. Some of us have been stationed at key points of entry into the FCT.
‘’Others would be in charge of traffic control and ensure there is no movement of vehicles in the restricted areas. You would soon be seeing patrol vehicles more often now.’’
When contacted on the security preparation for the inauguration, the Force Public Relations Officer, CSP Olumuyiwa Adejobi, referred to a recent warning by the Inspector-General of Police, Usman Baba, against aggrieved political actors and other individuals attempting to scuttle the swearing-in ceremony.
The PUNCH reports that the IG gave the warning on May 15, during a press briefing at the Force Headquarters, Louis Edet House, Abuja.
The warning followed alleged utterances of some political actors and their alleged attempts at inciting the public to protest and cause national tension ahead of the May 29 inauguration ceremony.
The IG noted that adequate personnel and equipment had been deployed by the police for the activities leading to the ceremony, and also the D-Day.
US nine-member team
According to the White House statement, other members of the Presidential delegation include Chargé d’Affaires, U.S. Embassy, Abuja, Mr David Greene, United States Representative (D), California, Sydney Kamlager-Dove, Under-Secretary of Commerce for International Trade, U.S. Department of Commerce, Marisa Lago and General Commander of U.S. Africa Command, Michael E. Langley.
Also expected at the nation’s seventh transition are the Director of, U.S. Trade and Development Agency, Enoh Ebong, Assistant Secretary of State for the Bureau of African Affairs, U.S. Department of State, Mary Phee, Special Assistant to the President and Senior Director for African Affairs, National Security Council, Judd Devermont and the Assistant Administrator for the Bureau for Africa, U.S. Agency for International Development, Monde Muyangwa.
Besides the United States, representatives of the United Kingdom, the European Union and several countries were expected at the inauguration of the president-elect on May 29.
The Spokesperson for the British High Commission, Dean Hurlock, Tuesday hinted that the UK government would be represented at the event.
He, however, explained that the list of British delegation had not been released by London as of Tuesday.
The Press and Information Officer, EU Delegation in Nigeria, Mr Modestus Uwalaka, could not immediately confirm the identities of officials that would grace the ceremony when contacted on Tuesday.
But the Media Officer at the Embassy of Finland, Abuja, Ms Ima Edem confirmed to The PUNCH that the Deputy Head of Mission in Nigeria, Ms Johanna Antila, would represent the Finnish government at the inauguration ceremony.
The French Embassy spokesperson, Onyinye Madu, told our correspondent she had no information on the French delegation to the event.
The inauguration programmes will begin on Thursday with the investiture of Tinubu with the Grand Commander of the Order of the Federal Republic and the Vice President-elect, Kashim Shettima, as the Grand Commander of Order of the Niger.

Governor Charles Soludo of Anambra State has appealed to President Muhammadu Buhari to release Nnamdi Kanu, the leader of the outlawed Indigenous People of Biafra (IPOB), before exiting office on 29 May.
Mr Soludo made the appeal in a letter dated 20 April and addressed to the president which was obtained by PREMIUM TIMES on Thursday.
“In this circumstance, I am prepared to take him (Kanu) on bail. My government is prepared to provide him with alternative secured accommodation at Awka where he will have access to appropriate medical care, among others, and make him available when required,” he assured.
He said it was necessary for Mr Buhari to release the IPOB leader given that Nigeria has gone through a “very consequential election” and that part of the smart steps to be taken must include an agenda for national healing and addressing lingering insecurity, especially in the South-east.
Mr Soludo pointed out that the fight against insecurity in the region has not fared well because of lack of “wider constructive engagement/dialogue between the Federal government, South-east leaders and other critical stakeholders on a form of coordinated political solution.”
He said the release of Mr Kanu was not only a legal or compassionate thing to do, but also a patriotic act to advance the cause of security, peace and development of the South-east region.
“As you shepherd a transition process to handover to your successor, you might as well help to smoothen his easy take-off by resolving some of the lingering issues such as Mazi Kanu’s detention.
“I therefore respectfully call on you, as statesman, to discharge a historic show of mercy and release Nnamdi Kanu before you handover on the 29th May, 2023,” Mr Soludo said in the letter.
