Dear Merlin Lotus flat-owners,

As you may have seen through email communications, we had a couple of meetings on the agenda of registered association formation in the past months. One flat-owner per apartment unit / door number will become the member of this association once formed and registered.

We needed 10 members to form the Governing and Executive bodies of the association, but since we did not receive any further nomination, we are proposing the following 8 members, who agreed to be part of these 2 bodies, as per minimum requirement advised by our legal counsel.

Governing body:
1. Mr. Sujit Ghose (1/1B) - President
2. Mr. Masud Ahamed (2/4B) - Secretary 
3. Mr. Baidhik Maity (2/2A) - Treasurer

Executive body:
4. Dr. Dibyadip Mukherjee (1/4B)
5. Mr. Deepanjan Banerjee (2/3B)
6. Mr. Nibir Mandal (1/2C)
7. Ms. Nandini Jana (2/4C)
8. Mrs. Shibani Mukherjee (1/4C)

Please advise if you have any objection to the proposed selection above. If no objections are received by 30-Nov, we will treat that as deemed acceptance and start the proceedings of association registration.

Fully agree with the steps taken.

However, from my own experience with the formation of the Association in 2017, as a founder President, and the reading of the WB Apartment Ownership Act 1972 and the Byelaws, following is to be observed:

1. A Board of Managers (Governing Body)  has to be constituted with 1/3 rd strength of the Association members. As there are 24 apartments, the Board will have 8 members. 

However in case where a member has more than one flat/apartment, he will have only one membership/vote. 

In that case the strength of the Board / GB can be less than 8: say 6.

2. The Members of the Board / GB are to be elected by the General Body in a Special meeting called for the purpose.

3. The elected Board / GB then elects the Office Bearers/ Executive Committee: essentially President, Secretary, Treasurer. You can also form a couple of sub committees, though not essential, for Housekeeping etc.

3. The Board has to ideally meet once a month. The Executive Committee any time. 

4. AGM or a Special General Meeting can be called with 2 weeks notice.

At the AGM, the audited accounts are to be presented for approval.

The AGM or the SGM can take a call on maintenance rates, special projects, Corpus etc.

5. A Rules of Residence can be drawn up, with rules and passed at the AGM/SGM. This can form part of the Byelaws.

Dear all,

Some of our proposed Governing body members had concerns with respect to their availability as signatories given their respective career and personal commitments. We had a further discussion with our legal counsel in this regard and came to understand that Governing body and Executive body members need not be mutually exclusive. 

We have thus adjusted our proposed structure accordingly as listed below.

Governing body:
1. Mr. Sujit Ghose (1/1B) - President
2. Dr. Dibyadip Mukherjee (1/4B) - Vice President 
3. Mr. Masud Ahamed (2/4B) - Secretary 
4. Mr. Baidhik Maity (2/2A) - Treasurer
5. Mr. Deepanjan Banerjee (2/3B) - Joint-Treasurer

Executive body:
 - All 5 members from Governing body, plus 
6. Mr. Nibir Mandal (1/2C)
7. Ms. Nandini Jana (2/4C)
8. Mrs. Shibani Mukherjee (1/4C)

Please advise if you have any objection to the abovementioned structure latest by 15-Dec-2024 EOD. We will provide the final structure to our legal counsel for further proceedings accordingly thereafter.

Since we have not received any objection from any of the Merlin Lotus Flat-owners to the proposal included in the email below till 15-Dec-2024 or even after that till date, we are treating this as your acceptance to the proposed Governing and Executive body structure, role-holder and member list.

Please be advised that effective 16-Dec-2024, these are the role-holders of the working committee.

Dear Flat-owners,

Requesting all of you to kindly provide the following documents pertaining to you as the flat-owner, as well as your co-owner(s), if any, against each apartment unit with immediate effect. 

1. Pan Card (photocopy/soft copy)
2. Aadhaar Card (photocopy/soft copy) 
3. Two (2) copies of passport size photographs
4. Registered Sale Deed  (photocopy/soft copy)
5. Mutation certificate (photocopy/soft copy), if available
6. Electricity bill of the flat in question (photocopy/soft copy)
7. Signed and filled up version of the attached Authorization form (take a print and fill up, sign and share in person or send the scanned copy via email)

For resident flat-owners as well for flat-owners residing within Kolkata, we will collect all the above documents between 1st and 2nd Feb.
For flat-owners residing outside, we request you to either email the soft copies of the aforementioned documents or courier the hard (photo) copies of the documents latest by 2nd Feb.

Dear All Flat owners,

A gentle reminder and a clarification.

As we all know that there were attempts of forming association earlier, couple of years back, when we collected those documents and submitted to previous lawyers office and are not available with us.

Henceforth kindly resubmit all the aforementioned documents alongwith sale deeds to the earliest possible and help proceeding with the association formation. Do let us know for challenges faced if any while sharing those documents.
