I am writing on behalf of 2 business owners in Maspeth.
Burke's Bar on Grand Avenue was in existence for 80 years, and when the building was sold to Asian landlords, they leased the premises to two Irish guys- Peter Maguire, from Woodside, and Paul Quinn, from Jackson Heights, both very well known and respected in the community.
Peter & Paul run a clean, neighborly bar, where the locals love to meet. Because of Corona Virus, they had to close on March 16th as all the other business of this nature were also ordered.
Peter & Paul made a deal with their landlady that they would pay 40% of the rent while they were closed. They don't have a kitchen, so cannot now fully open, so are OK with continuing this arrangement, however, their landlords are demanding full rent, and are engaging a Lawyer.
In your opinion, does Peter & Paul have any leg to stand on? Are there any options available to them, other than to walk away from a business they cannot support with full rent? It's a lovely bar, they spent a lot of money renovating it to look this way!!

Hi Martina,
They are currently serving what amounts to a snack, which passes the minimum requirements for the last few weeks, and they have a back which they renovated, but the law requires that they have a small number of patrons at any one time and it also requires 2 bartenders on duty. They could only have 8 to 10 more people outside in the front, so between the front & the back, they still wouldn't cover the rent, and all the other expenses,even if there was no rain.
It's very hard to do everything above board with all the restrictions. They have been trying to negotiate, and the first couple of months they paid the % as agreed, but the last 2 months the landlord absolutely wants the full rent.
I'm going to pass on the info from Selma and hopefully they will get some advice.
