Dear All Members,

Please go through the contents of the attached letter addressed to the Chief Secretary, Government of Karnataka.
All the contents of the letter will be background paper on PIL points, subject to the decision of the group of Actiivists/Donors who will meet shortly to discuss the Action Plan on PIL. Final decision on the matters to be included in PIL will be taken after discussing with the Advocate to be decided in the meeting of Actiists/donors.

I will inform the activists/donors on venue details today or tomorrow after discussing with the person who has agreed to share space for the meeting. Meeting will positively take place on Sunday at 3.30 pm. I request the activists to study on pre-requirements on PIL and cares too be taken while filing PIL..

Though I have difference of opinion on certain issues with Mr. Shankar and FPCE, I will invite him for the meeting of activists, as I am fully aware of his efforts on RERA enactment and enforcement in Karnataka and in the country. Though I am not in FPCA, I am in contact with Mr. Shankar regularly. Our aim is implemention of RERA in true letter and spirit.

I shall also invite Mr. Kalgi who is the President of BCAOWA, newly formed for fighting the sufferings of apartment purchasers at ground levels. Members from BAF and FAAB will also be called to the meeting.

I will inform  details in my next email.by talking to activists and donors.

It is time for all homebuyers (Apartment/plots/layouts) (in pipeline and new) and existing owners to extend monitory help for fighting home-buyers issues/sufferings/problems of decades through  PIL..

Dear Sir

Please add one point about appointment of RERA officers
1. Should have unblemished track record through out the service.
2.No conflict of interest, like the officers should not be connected/related/partnered with any builders.
3. Should be well read in law/technology and interested to read further
4.Should be service minded. Have a temperament to listen to the people instead of throwing the weight around.

Sir,
What you have suggested is good idea but it can not tot be taken in PIL. Your suggestions are good for bringing amendments to the provisions of RERA Act. Members of RERA are selected by the Commitee headed by the Chief Justice of Karnataka as per section 22 of the Act. The members are governed by certain conditions mentioned in Section 23, 24, 25, 26 and 27. Most of the points referred by you are covered in the above sections but they are not specifically explained in the act as these are subjective matters.
PIL is for proper implementing of the existing provisions of the act and not for amendment of the act.
Hope, you agree with what I have mentioned here.
