Interesting ruling. The TPS law says that decidin;'g who gets status is to be decided by DHS without judicial review. However, there are procedures that are supposed to be followed. But not in Trump World. Here, the head of DHS gets to decide without consultation. That was K. Noem, who ended TPS for Haitians and Syrians on her own. Obviously at the direction of Trump. So the whole process falls to 1/2 people.
This is bad for many reasons. The most obvious is what is happening now. One admin grants TPS to group(s) of people; the next admin ends it. So now TPS is in jeopardy for a about 300K Haitians and a few K Syrians. But also another 1.3 million others are up in the air with their status.
The law needs to be redone so that TPS doesn't become a political football that allows people into the US only to be booted some time later.
And when Noem declared Haiti/Syria "safe" for people to return, US citizens were warned that both countries were to dangerous to travel to. So there's that.
And the whole process shouldn't be in the hands of a single person. It wasn't, until the 6 SCOTI said it could be. I wonder how they'll rule when a Democrat chooses differently.
