3. The Company may at its own option repair reinstate or replace the vehicle or part thereof and/or its accessories or may pay in cash the amount of the loss or damage and the liability of the Company shall not exceed:
(a) for total loss / constructive total loss of the vehicle - the Insured's Declared Value (IDV) of the vehicle (including accessories thereon) as specified in the Schedule less the value of the wreck.
(b) for partial losses, i.e. losses other than Total Loss/Constructive Total Loss of the vehicle - actual and reasonable costs of repair and/or replacement of parts lost/damaged subject to depreciation as per limits specified.
4. The insured shall take all reasonable steps to safeguard the vehicle from loss or damage and to maintain it in efficient condition (- Insured took reasonable care by retrieving the vehicle whenever possible say after 6 - 7 day & delivered to the workshop for working) sand the Company shall have at all times free and full access to examine the vehicle or any part thereof or any driver or employee of the insured. In the event of any accident or breakdown, the vehicle shall not be left unattended without proper precautions being taken to prevent further damage or loss and if the vehicle be driven before the necessary repairs are effected any extension of the damage or any further damage to the vehicle shall be entirely at the insured's own risk - (- No scene of aggravation at insured's end, muddy acidic water kept it's action ON till it was opened, drained, surfaces cleaned & protective layers applied by than the surface finish was already damaged).
Dear sir,Aggravation of loss in this case would be very difficult to prove. Because, the loss has occurred due to flood and inundation. Insured or the driver is no way involved in aggravating the loss in this particular case.There could be many practical aspects as to why the vehicle was placed at the workshop late and late in undertaking the repairing the vehicle.As surveyors, our approach and opinions should be rationale and the innocent insured should not be penalized for no fault of him or her. In the midst of above, revision in motor tariff has been sidelined and kept in abeyance from our attention. We have the moral responsibility of giving our views as intermediaries in the industry as well as general policy holders.
To achieve the objective we a few Surveyors from Tamil Nadu and Kerala are meeting today at Coimbatore to discuss and consolidate the opinions and suggestions towards the exposure draft released by IRDAI in regard to the Revision in Motor Tariff.
