Dear  All

Can a  doctor  registered  in  one  state medical Council practice  in  another  state ? I  have  been  asked  this  question  frequently. Medicos Legal Action Group  had  challenged  the Section 13 A introduced by Punjab Medical Council Amendment Act 2010  which  had  mandated that  any  doctor  practicing within state of Punjab needs  to  be  registered  in  Punjab Medical Council. Our  contention  was  that  this  provision was  in  contravention  of  Section 27 of IMC  Act  which  stated  that  every  person  whose  name is  for the time being borne on the Indian Medical Register shall be entitled according to his qualifications to practice as a medical practitioner in any part of India. Also  anyone  registered  in  any  State Medical Council  was  automatically registered  in  Indian  Medical Register  which  meant  that  a  person  registered  in  one  state  medical council  could  practice  anywhere  in  the  country. The  issue  was  important  because  in  places  like  NCR Delhi, Chandigarh  and  border  areas  of  all  states  and  UTs  a  number  of  doctors  cross  state  boundaries  on  a  daily  basis  to  practice  their  profession.

MCI  was  made  a  respondent  and  the  reply  by  MCI  totally  undermined  our  stand  on  the  issue. The  reply  by  MCI  is  attached  and  it  upheld  the  right  of  a  State Medical Council  to  force  doctors  practicing  in  their  state  to register  with  the  State Medical Council.

It  is  also  amusing  to  note  that  many  states / UTs  still  do  not  have  a  state medical council.

Dear Dr. Nagpal,

1--Is this WP still pending? When is it likely to be decided?

2--I had filed a WP in Delhi HC on this issue and it was listed for arguments before a Division Bench headed by the CJ. Unfortunately, the petitioner (a doctor client of mine), under wrong guidance, withdrew the WP.

3--There are several instances of the MCI  taking unreasonable stand in the court. In another WP still pending in the Delhi HC, the doctor works in NOIDA, is registered with J&K SMC and the complaint against him, sent initially to MCI, was sent by MCI to UP SMC which  did not act and the MCI conducted the initial trial and suspended the doctor's registration for 6 months. This was in 2017. challenged the order of the MCI on several grounds.

True that anyone  registered  in  any  State Medical Council  was  automatically registered  in  Indian  Medical Register  which  meant  that  a  person  registered  in  one  state  medical council  could  practice  anywhere  in  the  country.

IMA Gurgaon has filed a WP in PAH high court against HMC as they have started renewal every 5 years without any provisions in Act. The insistence of state council to register in practicing state is also unconstitutional. It means you can practice only in one state. While as per law any qualified medical person can practice anywhere in India.

A great efffort by IMA Gurugram team. It is wise step in the right direction. Majority of consultants are working both in Gurugaon and Delhi. It is a issue bothering many of them. 
It is a common understanding and very true as well that once you are registered in state medical council or register you need not apply for MCI at Delhi. You automatically are enrolled in central medical register. This dichotomy was created by PCPNDT Act which made it compulsory to get registered in state medical council as for as Haryana is concerned. Being a bonafide member of any state medical register and then interalia automatically a member of central medical register one must be at liberty to practice simultaneously in all states of the union of India.
