Hello All.

I hope everyone is well and having a stress-free 2023. (We can dream, can’t we?)

Has anyone worked with Daniel’s Law?

I’ve been asked to perform site-wide searches on name and address of “covered persons”  and then redact the names and addresses.

All the posted minutes include the names and addresses of people who spoke in the public portion of the meetings.

If a person spoke as a resident, not in an official capacity, and it is part of the official minutes, should the information be removed with [redacted] or overlay with a black highlight to show the text was redacted?

There are also names and address published of objectors to Land Use applications.

Hi Jean-

Just curious, is this something new? I thought Daniel’s Law was more specific to judges, etc. Not your everyday resident. I could be wrong. I do know it’s a hot topic right now.

Hi Christina.

I think the township administrator is concerned about residents’ names and addresses being published who may be police officers, etc. in another town, not the resident’s town. (Not a “regular" resident.) I would think that if that person wants to be on the Daniel’s Law list then it is up to the person to notify the municipality in which he/she resides. 

Yes, it is a hot topic and there seems to be little guidance for the municipalities.

Hi,

You should check with your municipal clerk who should be fully aware of all the recent updates to the law. They have expanded the list recently and I would expect it to keep growing due to the recent shootings of council members. It's going to be tough with all the docs that live on our websites but your clerk should be registered as the main redactor for the municipality and can help guide you.

Only “covered” individuals can apply to have their information redacted which is submitted through the state for approval through the above portal.

Each town would need to select official redactor(s) who also need to register with the state and they are provided the contact information for only those covered individuals who have registered and will subsequently require redaction.

 

Best to consult with your municipal counsel.
