Navigating the CERT-In directives for business operations

On 28th April 2022 the Indian Computer Emergency Response Team (CERT-In) issued new directives relating to information security practices, procedure, prevention, response and reporting of cyber incidents for “the safe & trusted internet”. These were not preceded by public consultations. 

The directives cover aspects related to the timeframe for reporting cyber security incidents; maintenance of user identification data; transaction information for crypto exchanges and wallets; maintenance of customer details by data centers, cloud services, and VPN providers; and maintenance of logs in the Indian jurisdiction. 

Rootconf and Privacy mode are co-organizing a panel discussion with FOSS United Foundation to discuss the impact of the CERT-In directives on business operations. Panelists Srinivas Kodali (Independent Researcher), Prateek Waghre (Policy Director, Internet Freedom Foundation), and Richa Mukherjee (Director of Public Policy and Corporate Affairs, PayU) will be in conversation with M. Sonali (Associate, 9.9 Insights). The discussion will enable the audience to gain a better understanding of data governance, operational practices, and policy engagement.

Did the announcements of the directives state that consultations were held before the directives were introduced? 

Lack of communication snowballs into lack of transparency. Open consultative processes help to mitigate impact.

Dear Zainab,

I have posted on mygov.in and I got many likes. I am 'Discoverer Level 1' there, I started as 'Enthusiast Level 1' and then worked all the way to 'Enthusiast Level 4'. I have also worked with a Govt center on cyber security and given all my work as 'help to Nation'. I had also written to Pegasus Committee of Supreme Court and the professor then sent it to Hon Lordship and entire commitee. Govt has asked me to maintain confidentiality on technical matters.

Throught my view has been 'India should have complete control over this' and 'Law should be handle any situation'. For any phone tapping, data tapping proper Govt laws and procedure has to be there. Earlier our Country did not have full knoweldge of this tech so we relied on foreigners. But I contributed to the effort to make it in our Nation only.

Hello Manish,

Was it public knowledge that individuals and organizations can comment on CERT-In directives before they were made public? Or were you aware because you are an insider?

The FAQs have been published after the Directives have been issued. Isn't this chaotic?

I am Indian National and I have made sacrificies. Now we have 'Whole of Nation' 'Whole of Govt' approach. Govt listened to me many times, even if I am just pvt citizen. I am not Govt official. Anyone who wants to voice can write to Govt or hold public events like you are holding. No one asked me to do this service, I felt from heart. My family suffered but I still did

If you have genueine points you create signature campaign, do public events, do research and make contribution. I am sure Govt will listen

On specific CERT directives, I saw in news directive was made. Then I went to mygov.in and then Linkedin. Then there was news the Govt may revise directive, but I am very happy yesterday's news directives are same.

I started Govt work on May 17th 2021 and I wrote to Pegasus Committee 2 months back
