First check article of association of the company, does it contain any provision related to this.

if the director has resigned then you can appoint him again - in agm as as director if in bm then additional director

but if the director has not been regularized and re appointed as director in the ensuing agm then file a form under sec 167 first as if additional director is not regularzed in the ensuing agm his chair automatically gets vacated as per sec 167
