Query related to filing of registration of Charge form (CHG-1)

Hello All,

I have a query and would require your input.

Company A has taken loan from SBI and given Company B's Land as mortgage. 

Company A has filed the charge form in which the option saying "does the property given on morgagte is owned by Company A" - it selected No and mentioned Company B's name & CIN & PAN. 

Thereafter form CHG-1 was filed and In the master data of Company A, the details of charge is showing along with the name of Company B under "Asset holder name" however, no charge is visible in company B's Master data.

Do company B need to file the form, CHG-1?

No, Company B is the Asset holder , providing collateral.

Why will a guarantor hold the charge in its name? The charge is always created on the loan seeker, entity not the guarantor. B shall only named as a guarantor in the documents.

Please go through Sec. 186 again

as per me, COmpany B also needs to file as they stand as guarantor for .loan taken by COmpany A and fall under second category of loan/ advances/ guarantee

Yes Ma'am, Company B has been addressed as Guarantor in all the loan documents. 

I already dropped an Email to SBI stating that we do not need to file the form for the guarantor, however they are insisting on filing as they have an internal circular passed to do the same.
