CS Resignation- not filing DIR-12

Dear members,

Despite of vaiours reminders and serving of full notice period still Company not filing DIR-12 since last 2 months from resignation. Even a new CS was also appointed by the company but still didn't file DIR-12 of resignation.

I am not able to file as filing of DIR-12 is the company's responsibility and we don't have any option in DIR-11.

Please help me how I can remove my name from the company.

This is the Biggest Disadvantage for professionals (CS) in employment. 

We should Start Practice to file our Own DIR 12 for resignation Before the Last date of office.. Bcz This Pratice has been Start by many Corporates or unethical peoples

Now I would suggest you to generate the ISIN No on ICSI portel and Mention this point in it. If this is already Generated then Write mail to institute and MCA. 

Till that time try to Contact with the CS Who is there as on date and Ask her to file it. or inform this to the auditor or Statutory auditors of the company.  

 For Auditor there is form ADT 3 but for the CS who files it has no right to there Resignation form. 

This point has not been even reply by ICSI chapter when i have raised the query for the same

Raise it with CS President or Vice President or to your Regional Head.

Also, How DIR 12 for new CS is filed? MCA must have raised error.... can i know name of that Company ?

No they didn't file any DIR-12 neither for cessation nor for appointment. That's the problem.

In my opinion, you should write directly to MCA, ICSI, Auditors Stock Exchange (if listed) along with copy of all reminders and resignation letter.
