NOC for Registered Office - INC32

In a company formation case, registered office premise (a flat) is owned by the husband of the proposed Director. The agreement for purchase of the flat was entered into about 6 months ago. The electricity bill of the registered office was in the name of the developer, while the cooperative housing society maintenance bill (monthly) for flat in name of the husband of the proposed Director.

We submitted NOC of the husband along with clarification on the mismatch between in the the name mentioned on electricity bill and  maintenance bill  and a copy of electricity bill and housing society maintenance bill for Dec 2019.

CRC has sent it for resubmission with comment - NOC should be given and signed by the owner of registered office premises i.e. by person whose name is mentioned in utility bill.

In such scenario, would submission of select pages from the registered agreement for purchase of the flat along with clarification be sufficient proof of registered office. Please advise.

Along with sale agreement also submit the copy of the latest utility bill as that's mandatory for proof of registered office. Secondly in the NOC, you should get the signature from the person whose name is mentioned in the utility bill & most importantly, both the names & address should match with each other.

The sale agreement mentions the Director's husband as purchaser. The electricity bill is in the name of the Developer / Builder as purchaser not yet got the electricity meter transferred to his name. 

We submitted copy of the Housing Society monthly maintenance bill which is in name of  the Director's husband as an additional document for utility bill, but it was not considered by CRC.

Hence seeking views of members who may have faced similar queries / resubmission from CRC.

If society bill is not considered as utility bill, then you have to prepare the NOC as stated in electric bill. Sale agreement is just a supporting document. The main documents attached are electric (utility) bill & NOC from owner. So you need to go by that only.
