pl  .confirm the account name to which common area prop tax is to be paid. 
pl. note as per the mail under reply as well as T5 seperate mails to followup  for clarity of prop. amount. we claim the non oc area tax is builder liability just as the disputed flats are Ln t liability and not to be part of common area  prop. tax.
in that case as the  half yearly prop. tax payment is due on 13 Aug. we shall be paying  by cheque favouring 
L nT  under protest and without prejuce .
 we have made it clear that T5 will pay nett of penalty paid in 2022 .
let it reflect as payable in line of all towers  and to be paid when all towers are made to pay.

This is in response to your  mail dted.       confirming that you are not in position to refund because you are in process of the recovering from other towers. However T5 has lost the interest on the penalty  for 3 yesrs as well as opportunity cost to utilise the funds for members welfare unlike other towers who have yet to make that payment.

Hello Jay,

I went into details of the annexure you have sent along with the excel working .

Request please clarify the following :

  1. according to what I can see and calculate , the property tax on ( other Ares and clubhouse ) that you have mentioned should be  Rs 2693110. I have only added the club house and amenities mentioned in the last 7 pages of the detailed listing of zones in the complex. Not clear how you have arrived at Rs 639447
  2. Accordingly the Property tax on Parking should be Rs 16130198.
  3. Strangely in all the areas mentioned in the Zone / subzone ( 1st column ) I do not see any entry/ description of  any zone under T3 footprint.  Thought that was unusual.


Request  pls clarify .

This does not impact the total figure but it does impact the breakup between parking areas and  Club amenities . This however further impacts allocation to members because the allocation rules for parking property tax  and amenities  property tax are different

We have information Interest & Penalty has been charged on our common area property bills by 2crs.

 

LTR has been managing the common area and on intimation from LTR we had been paying 50% of common area property tax. Amount to be paid was also informed to us by Jay Goyal. The interest and penalty charges on common area property is charged on the balance 50% unpaid.

 

This penalty on all 6 societies is not acceptable. It is important LTR looks into this issue and clears the interest and penalty charged to us.

 

Kindly treat this matter very urgent. And any interest or penalty if has to be paid on common area property tax has to be paid by LTR.

In the PT summary of your excel sheet the outstanding amount (50% share) pending to be paid by 6 towers is Rs. 2.99cr up to FY 25. The outstanding as per the property tax is Rs. 4.88crs.

I refer to your telecon with me on Friday, 7th November 2025.

You have confirmed that your internal audit process is complete and we can now audit your books of accounts. We would now like to appoint an Independent Auditor to conduct the External Audit of your books of accounts pertaining to Crescent Bay Common Areas. This is the precursor to the transition of the Common Areas to the CB Federation, which is in process. This audit will include books of accounts L&T Realty and Devshree Corporate Solutions. We would like to audit the Income & Expenditure, Assets & Liabilities, balance sheets, cash flow statements, bank records, financial statements, physical assets, vendor contracts etc. and will require access to the ledgers and supporting documents pertaining to the common areas of Crescent Bay Parel. It would be great if we have access to accounts from the time that the Common Areas are being managed by LTR. We request you to send us a formal go ahead on this audit, since we will have to detail out the scope to the Independent External Auditor we wish to appoint. Do let us know when we can start this audit too. Once we receive your written go ahead, we will indicate the name of the External Auditor.

On the pending work completion, you mentioned mid-January 2026 as the revised date of completion. Kindly update the end timelines against each pending job list and send us the revised schedule. We will be able to sign the Federation papers once the pending work is completed by LTR.

On the Federation name registration front, kindly send us the approval received from SRA Registrar so that we can hand over the details to our lawyer who is drafting the Federation Model Bye-laws.

We wish to bring to your notice some alarming developments related to the boundary demarcation of the Crescent Bay Complex at Parel. The Demarcation Map and the accompanying Notice from the District Collector/ District Magistrate’s Office related to the measurement of our sub-plot, was shared with us in January 2025.

 

As you are aware, we are in the final stretch of forming the Apex Federation at Crescent Bay Parel. As part of this process, the Members of the Interim Apex (Managing Committee representatives from each of the 6 tower societies) met yesterday and took an inspection round of the complex. We would like to bring to your notice some expedient steps that need to be taken to ensure that there is no encroachment of our mapped & demarcated sub-plot.

 

1)     We urge L&T Realty/ Omkar Developers to physically mark the boundaries of the Crescent Bay Complex at the earliest. This must be done jointly by your teams and the Surveyor we appoint. We can follow the demarcation map which exists for this purpose.

2)     We currently have heightened construction activity all around our complex. Behind Tower T-2 we understand that Shobha Developers is planning to start construction soon. Behind Towers T-3/ T-4, Kakade Developers has already started construction some time ago. And behind Towers T-5/ T-6, Sattva Developers started construction a few months ago.

3)     We are concerned that in the absence of a physical boundary wall of Crescent Bay, there is potential encroachment possible into the Crescent Bay subplot. All these developers have physically demarcated/ will demarcate their plots, while Crescent Bay still does not have the physical demarcation. It’s crucial to erect a wall/ fencing/ tin sheets all around the demarcated boundaries of Crescent Bay.

4)     We have a Tata Power Transformer, the Diesel Generator Sets and the Back Gate (Gate 4) from Tower T-4, which could be potentially damaged/ blocked due to this hectic construction activity. All these are situated at the rear side of Crescent Bay. Any damage to our property will have to be accounted for by L&T Realty/ Omkar Developers.

5)     The DP Road which is coming up behind Crescent Bay, should have proper pedestrian footpaths on both sides, must be levelled and the road width should be as per the mandated and approved plans of the SRA/ BMC.

6)     The Main DP Road in front of Crescent Bay should be handed over to the Crescent Bay Complex, so that we can continue to maintain and manage the same. If any official agreement needs to be entered into with BMC, kindly facilitate the same.

7)     The Gate 4 of Crescent Bay, which is earmarked at the rear on the map and provision has been made at the LG-4 Level of T-4 must be constructed and installed. It should lead directly onto the DP Road behind Crescent Bay.

 

Do let us know a date for the joint, physical demarcation of the Crescent Bay Parel Complex. We would also expect that the physical walls are constructed on all open sides of our complex. All this needs to be done within the next two weeks of receiving this letter. Failing which, the Interim Apex will be forced to unilaterally construct the physical boundary demarcation and charge the cost of doing the same to L&T Realty/ Omkar Developers. The legal onus of such a physical demarcation erected will then be on L&T Realty/ Omkar Developers.

 

We request a meeting this week at your Powai Office to discuss and close this matter with the greatest urgency. One Managing Committee Representative from each of the 6 Tower Societies will attend this meeting. We are concerned and alarmed at all the developments and it’s crucial to take preemptive action immediately.

We will not be able to wait beyond 30th November for your internal revert. We will get a quotation from a vendor for the construction of the boundary demarcation and send you the estimate for the advance payment. The boundary demarcation of the Crescent Bay Complex will also be done as per our understanding and knowledge, based on the map provided. We will not be liable for any disputes arising out of the same. In case L&T Realty does not pay the vendor the advance, we will deduct the cost from the monthly payments due to you.

We have minimal patience for the pace at which decisions are taken at your end and the amount of time it takes to eventually execute the work. We are at a very important phase of taking over the complete management of the Crescent Bay Complex. Your co-operation and urgency on pending matters is expected.

December is due date for balance 50% property tax. Apex needs to be clear with understanding on property tax billing. As per current understanding LTR has instructed to pay 50% of property tax of Common area billing.

We have information Interest & Penalty has been charged on our common area property bills by 2crs.

 

LTR has been managing the common area and on intimation from LTR we had been paying 50% of common area property tax. Amount to be paid was also informed to us by Jay Goyal. The interest and penalty charges on common area property is charged on the balance 50% unpaid.

 

This penalty on all 6 societies is not acceptable. It is important LTR looks into this issue and clears the interest and penalty charged to us.

 

Kindly treat this matter very urgent. And any interest or penalty if has to be paid on common area property tax has to be paid by LTR.

Please find attached the property tax invoices received from BMC for the CB common area for the financial year 2025–26.

We request you to kindly arrange to make the 100% payment to BMC before the due date to avoid any penalties as BMC has communicated that they are appealing for full (100%) payment of property tax from the year 2017 onwards.

For your convenience, we have also attached the overall property tax calculation from 2017 to 2026. As per the verbal information provided by the BMC Office, no penalty will be levied if at least 50% of the property tax from 2017 onward has been paid.

Kindly review the attached documents and initiate the necessary action at the earliest.

This is to inform you that the BMC representative has verbally communicated that, till date, BMC has not charged any interest if 50% of the overall property tax is paid. However, in the case of Crescent Bay, the 50% payment criterion is not applicable, and 100% of the property tax is required to be paid.

We are approaching BMC to provide supporting documents in this regard; however, due to their current engagement in election-related activities, they are unable to provide the relevant documentation currently.

As decided in the meeting of 19th December 2025, Mr. Prabhakar Awalegaonkar and I visited the BMC office on 22nd December 2025.

During the discussion with the Property Tax Inspector, Mr. Dive, in the presence of Mr. Prabhakar Awalegaonkar, it was informed that 100% of the property tax needs to be paid, as the 50% concession criteria is applicable only to buildings constructed prior to 2010. This criterion has been crossed, as clarified by Mr. Prabhakar Awalegaonkar.

However, Mr. Dive verbally communicated that, as of now, at least 50% of the property tax may be paid to avoid any penalty. Please note that in the event BMC imposes any penalty due to non-payment of 100% of the property tax, the same shall be the responsibility of the respective individual societies.

This is to inform you that the BMC representative has verbally communicated that, till date, BMC has not charged any interest if 50% of the overall property tax is paid. However, in the case of Crescent Bay, the 50% payment criterion is not applicable, and 100% of the property tax is required to be paid.

We are approaching BMC to provide supporting documents in this regard; however, due to their current engagement in election-related activities, they are unable to provide the relevant documentation currently.

All,

Spoke to Ketan today to reply to requirements in Financial Audit and to get an update on Structural Audit.

He said that on structural audit report provided by us, he is discussing the matter with Sachin Chug, their engg and the higher ups are looking into. He is awaiting the reply from the management.

In the meantime, he said he had emailed for Gate 2 structural audit method w.r.t. vibrations noticed at Gate 2. We are yet to confirm the same.

On Financial audit, he is asking us to provide the list of requirements so that he can follow up with Jay and Saish to arrange the same. I guess the email of Shraddha Naik, our auditor is not marked to LTR.

Post completion, surface finishing followed by curing/ponding will be carried out for a period of 10 days, i.e., until 12-05-2026.

SUB: POTENTIAL ENCROACHMENT OF DEMARCATED SUB-PLOT OF CRESCENT BAY COMPLEX, PAREL

 

We wish to bring to your notice some alarming developments related to the boundary demarcation of the Crescent Bay Complex at Parel. The Demarcation Map and the accompanying Notice from the District Collector/ District Magistrate’s Office related to the measurement of our sub-plot, was shared with us in January 2025.

 

As you are aware, we are in the final stretch of forming the Apex Federation at Crescent Bay Parel. As part of this process, the Members of the Interim Apex (Managing Committee representatives from each of the 6 tower societies) met yesterday and took an inspection round of the complex. We would like to bring to your notice some expedient steps that need to be taken to ensure that there is no encroachment of our mapped & demarcated sub-plot.

 

1)     We urge L&T Realty/ Omkar Developers to physically mark the boundaries of the Crescent Bay Complex at the earliest. This must be done jointly by your teams and the Surveyor we appoint. We can follow the demarcation map which exists for this purpose.

2)     We currently have heightened construction activity all around our complex. Behind Tower T-2 we understand that Shobha Developers is planning to start construction soon. Behind Towers T-3/ T-4, Kakade Developers has already started construction some time ago. And behind Towers T-5/ T-6, Sattva Developers started construction a few months ago.

3)     We are concerned that in the absence of a physical boundary wall of Crescent Bay, there is potential encroachment possible into the Crescent Bay subplot. All these developers have physically demarcated/ will demarcate their plots, while Crescent Bay still does not have the physical demarcation. It’s crucial to erect a wall/ fencing/ tin sheets all around the demarcated boundaries of Crescent Bay.

4)     We have a Tata Power Transformer, the Diesel Generator Sets and the Back Gate (Gate 4) from Tower T-4, which could be potentially damaged/ blocked due to this hectic construction activity. All these are situated at the rear side of Crescent Bay. Any damage to our property will have to be accounted for by L&T Realty/ Omkar Developers.

5)     The DP Road which is coming up behind Crescent Bay, should have proper pedestrian footpaths on both sides, must be levelled and the road width should be as per the mandated and approved plans of the SRA/ BMC.

6)     The Main DP Road in front of Crescent Bay should be handed over to the Crescent Bay Complex, so that we can continue to maintain and manage the same. If any official agreement needs to be entered into with BMC, kindly facilitate the same.

7)     The Gate 4 of Crescent Bay, which is earmarked at the rear on the map and provision has been made at the LG-4 Level of T-4 must be constructed and installed. It should lead directly onto the DP Road behind Crescent Bay.

 

Do let us know a date for the joint, physical demarcation of the Crescent Bay Parel Complex. We would also expect that the physical walls are constructed on all open sides of our complex. All this needs to be done within the next two weeks of receiving this letter. Failing which, the Interim Apex will be forced to unilaterally construct the physical boundary demarcation and charge the cost of doing the same to L&T Realty/ Omkar Developers. The legal onus of such a physical demarcation erected will then be on L&T Realty/ Omkar Developers.

 

We request a meeting this week at your Powai Office to discuss and close this matter with the greatest urgency. One Managing Committee Representative from each of the 6 Tower Societies will attend this meeting. We are concerned and alarmed at all the developments and it’s crucial to take preemptive action immediately.

We will get a quotation from a vendor for the construction of the boundary demarcation and send you the estimate for the advance payment. The boundary demarcation of the Crescent Bay Complex will also be done as per our understanding and knowledge, based on the map provided. We will not be liable for any disputes arising out of the same. In case L&T Realty does not pay the vendor the advance, we will deduct the cost from the monthly payments due to you.

 

We have minimal patience for the pace at which decisions are taken at your end and the amount of time it takes to eventually execute the work. We are at a very important phase of taking over the complete management of the Crescent Bay Complex. Your co-operation and urgency on pending matters is expected.

We wish to bring to your notice some alarming developments related to the boundary demarcation of the Crescent Bay Complex at Parel. The Demarcation Map and the accompanying Notice from the District Collector/ District Magistrate’s Office related to the measurement of our sub-plot, was shared with us in January 2025.

 

As you are aware, we are in the final stretch of forming the Apex Federation at Crescent Bay Parel. As part of this process, the Members of the Interim Apex (Managing Committee representatives from each of the 6 tower societies) met yesterday and took an inspection round of the complex. We would like to bring to your notice some expedient steps that need to be taken to ensure that there is no encroachment of our mapped & demarcated sub-plot.

 

1)     We urge L&T Realty/ Omkar Developers to physically mark the boundaries of the Crescent Bay Complex at the earliest. This must be done jointly by your teams and the Surveyor we appoint. We can follow the demarcation map which exists for this purpose.

2)     We currently have heightened construction activity all around our complex. Behind Tower T-2 we understand that Shobha Developers is planning to start construction soon. Behind Towers T-3/ T-4, Kakade Developers has already started construction some time ago. And behind Towers T-5/ T-6, Sattva Developers started construction a few months ago.

3)     We are concerned that in the absence of a physical boundary wall of Crescent Bay, there is potential encroachment possible into the Crescent Bay subplot. All these developers have physically demarcated/ will demarcate their plots, while Crescent Bay still does not have the physical demarcation. It’s crucial to erect a wall/ fencing/ tin sheets all around the demarcated boundaries of Crescent Bay.

4)     We have a Tata Power Transformer, the Diesel Generator Sets and the Back Gate (Gate 4) from Tower T-4, which could be potentially damaged/ blocked due to this hectic construction activity.
