Please be aware that the captioned matter was listed at Sr No. 6 before Hon’ble Justice Ahuja on Monday i.e. 22nd July 2026, when Counsel Mr. Dhruva Gandhi instructed by us appeared on your behalf.
When the matter was called out, we informed the Learned Judge that all office objections were complied with by us, save and except the Section 80 CPC compliance for which the registry had raised an objection. We canvassed before the Learned Judge the fact that such leave was inadvertently omitted by the erstwhile Advocates and that the suit at the relevant time of institution sought urgent interim reliefs. We also submitted that it was not for the Registry but for the Defendants to raise such an issue in pleadings and therefore requested that the said objection be waived and relied on law in support of such submission.
Counsel Mr. Kamdar appearing for Defendant No. 1 on other hand raised an issue of pecuniary jurisdiction owing to the fact that the suit was valued under Rs. 10 crores and therefore ought to be transferred to the City Civil Court. We requested the Learned Judge to grant us time to consider our position and comply with the said objection. The Learned Judge after hearing both sides was pleased to adjourn the matter by a period of 6 weeks to enable us to comply with objections.
We attach a copy of the order dated 22nd July for your information and records. The matter now stands adjourned to 10 August 2026.
We request a conference with yourselves and Counsel in order to ascertain our position and take necessary steps next week.
