Dear all,

 

In this email, I would like to draw your attention on:

I)      The possibility of coming up with a review mechanism in ACWC,

II)     The review ACWC TOR in 2015,

III)    The development of fundraising of ACWC.

 

 

I. ACWC Review Mechanism to the Implementation of the Declaration

 

As you know that ASEAN adopted the Declaration on the Elimination of Violence Against Women and Elimination of the Violence Against Children (DEVAWEVAC) in ASEAN in 2013.

 

The DEVAWEVAC stipulates that the ASEAN Members States, individually and/or collectively is committed to eliminate VAW and VAC in the region through eight measures. Please see the Measures in the end of this email, or open the attachment to get the full text of DEVAWEVAC.

 

The Declaration also provides an additional mandate for ACWC to:

a)    Promote the implementation of the Declaration, and

b)    Review its progress through appropriate instruments and actions, with the support of ASEAN Member States.

 

Declaration also requested the same to ASEAN related bodies (with emphasis on ACWC), as it says, “the relevant ASEAN bodies, in particular the ACWC, to promote the implementation of this Declaration and review its progress through appropriate instruments and actions with the support of ASEAN Member States

 

This end gives us the clue that the next step for ACWC is to develop AN ACWC’s REVIEW MECHANISM to the implementation of the Declaration, which may open up thousand possibilities to mend the gaps of the absence of protection function and mechanism of ACWC.

 

If we focus our efforts on this part, it may lead to the paths to make ACWC a stronger human rights mechanism that specializing on the promotion and protection of the rights of women and children in the region. This could be the opportunity for CSO to suggest or to provide inputs to ACWC on how the review mechanism can evolve.

 

Civil society can gather the information on the existing review mechanisms available in the other regional/global human rights mechanism and contextualize it into ASEAN. Analysis and recommendation in this matter would contribute to the building of knowledge on regional human rights mechanism for the rights of women and the rights of children.

 

The timing is also strategic (as explained below).

 

II. The Review of TOR in 2015 and drafting a new Work Plan (2016-2020)

 

The 9th Meeting of ACWC last year (2014), it started the discussion on, among others:

a)    The Review of ACWC’s Terms of Reference (TOR) – Please see TOR Article 10.5.

b)    Development of the new five-year work plan (2016-2020)

 

The review mechanism to the implementation of the Declaration should be included in the review TOR process and its amendment, as well as plan it well in the new five-year work plan (2016-2020).

 

Of course the two processes require assessment/evaluation in the implementation of the ACWC’s mandates and function in the last five years as well as the implementation of the ACWC’s work plan (2011-2015), which civil society can provide the assessment and present the result to ACWC.

 

Different with AICHR’s way of doing the review and amendment, based on the ACWC TOR Article 10.6, it is the ACWC the one to review its TOR after five years. The outcome of the review shall be submitted to the AMMSWD (Article 10.5, 10.6). Amendment, as stipulated in Article 10.2, should be submitted to the Chair of ACWC for consideration. ACWC shall submit the request for the approval to AMMSWD (Article 10.3).

 

 

III. Funding for ACWC’s operation

 

ACWC is now seeking the contribution from ASEAN Member States to share the responsibility to finance ACWC, especially on supporting secretarial assistance and staff at the national level. Not all AMS have responded yet.

Annex: Eight Measures of DEVAWEVAC:

 

1)    Strengthening and/or enacting or amending national legislations for the elimination of violence against women and violence against children, and to enhance the protection, services, rehabilitation, education and training, recovery and reintegration of victims/survivors;

 

2)    Integrating legislations, policies and measures to prevent and eliminate violence against women and violence against children and to protect and assist the victims/survivors in the national development plans and programs with time-bound targets, adequate resources, and gender responsive planning and budgeting;

 

3)    Strengthening a holistic, multi-disciplinary approach to promote the rights of women and children and adopt a gender responsive, child sensitive, and age-responsive approach to eliminate violence against women and violence against children in the region which includes effective laws, legislations, policies and other required measures;

 

4)  Strengthening the existing national mechanisms, with the assistance, where necessary, of the ACWC and other related stakeholders, in implementing, monitoring and reporting the implementation of the Concluding Observations and Recommendations of CEDAW, CRC and other Treaty Bodies as well as the accepted recommendations under the Universal Periodic Review Process of the United Nations Human Rights Council related to the elimination of all forms of violence against women and violence against children;

 

5)  Strengthening the capacity of law enforcement officers, policy makers, social workers, health personnel, and other stakeholders to develop, implement, monitor and evaluate gender responsive and child friendly legislations, policies and measures for women and children victims of violence;

 

6)  Encouraging research and data collection and analysis in confidential concerning all forms of violence against women and violence against children to support the formulation and effective implementation of laws, policies and programs to eliminate violence against women and violence against children for better protection of the victims/survivors in the region;

 

7)  Strengthening the provision of support social welfare services to women and children victims/survivors of violence and their families in ASEAN through the establishment of an ACWC network of social services to facilitate the promotion of good practices, sharing of information, exchange of experts, social workers and service providers, including NGOs;

 

8)  Strengthening partnerships with external parties at international, regional, national and local levels, including ASEAN Dialogue Partners, UN Agencies, civil society, community-based organizations, academia, philanthropists and private entities, in the work for the elimination of violence against women and violence against children in ASEAN and to mobilize resources to assist the victims/survivors.
