Please see the below email from Erica Thomas, Unit 7A. This is in regards to the burst pipe we had this winter in the wall. 

The total renovation cost for the unit was $19,954.17

State Farm is saying that they will not cover insulating the walls and redoing the framing that was missing in the walls. 

I am talking to their contractor to make sure we get the full picture as well as our insurance broker. The difference is $3529.38 that they are claiming is our responsibility. 

If it is determined that there was actually a construction defect and the framing/insulation was not there then I do not know if our insurance would even cover that. Additionally our deductible is $2500 so I do not believe that it would be worthwhile to file a claim even if we could as it could end up raising premiums on subsequent renewals.

 Please find a letter describing the issues uncovered by Greenisland and that State Farm Insurance claims according to our bylaws/purchasing agreement should have been covered by the master policy of the condominium. I have also included the final invoice from Greenisland and payment by State Farm.

Hi Cory,

Just out of curiosity, if it's something we (the building) pays for, shouldn't we have a say in who does the work and understand the costs prior to them being made? I'm not sure if there is a case for that? Or was this a matter of emergency for 7A making that point null?

At the end of the day, if the scope of work is something that the building should cover, then we may have no choice. Out of that cost, the $3,529.38 amount is all we would be responsible for?

Hi! Are we able to get a full breakdown of which pieces we might be responsible for? Also with cost per square foot, etc. to see if there's any room to negotiate.

Agreed on the need to do due diligence to see who is responsible for this work. Any update there? Would our lawyers be able to help parse it out?

I think it might be hard (and more expensive) to potentially bring in another company to do this part of the work, but definitely worth discussing.

I spoke to her project manager and I forwarded it to the building's attorney for more information. It is a unique situation because Green Island's estimate includes windows which the building is not responsible for and a lot of things state farm paid more for and something's they paid less for. State farm did cover some of the insulation but not all of it.  

The walls in the unit were plaster and not sheetrock when the building was built. The framing that was in the wall were ok for the plaster, but will not support putting up sheetrock in the unit. I will let you all know once I speak to Anthony cummings (the building's lawyer) and if I can get some more info from the contractor as well. 

Without speaking to the lawyer based on how I am looking at it, the total cost of Green Island's bill in $19,954.17 less the window cost of $1750.10 and less the payment she received from state farm (15,534.56 + $1000 deductible) would leave a total due of $1669.51 and if anything that may be what we could offer her. I believe if we are responsible for the framing and insulation, that is cheaper than we could get it by bringing in someone else. 

I will provide updates to you as we get them and let you know what our attorneys recommendations are.

If she's changing the type of wall - plaster to sheetrock, does that become her choice and then she is responsible for any additional work as a result of that? That seems different from "missing framing".

She didn't really have a choice because the walls were damaged and plaster is really not done anymore. I will certainly ask that question as well.
