The NSW government has a special land tax on foreigners owning real estate in that state

A recent surprise was that a couple, one of whom was a permanent resident, was classified as a foreigner and taxed accordingly. They had not rented out their home here but were overseas for longer than 200 days within one year.

The fact that the other was a citizen did not exempt them.

Morning,  
I am in SA on 410 visa  (Retirement visa with 1 house )which means always a visitor & I am now classed a overseas investor & have to prove every year live in own home for  more than 6 mths & when I bought it had to paid over $6000.00 for a years permission to move & then they stung me with extra 7% stamp duty on top of normal stamp duty.. Been here 25 years & helping the economy  spending money . I can't believe that they treat us this way when we came to live with our kids. Also when we applied sfter 10 yrs you got a pension  then they changed the rules before 10 yrs was completed No pension No permanent residency,No help. And now classed as foreign investers. Plus tne fact that UK freezer my pension. Not that I would want to go back for afull pension.

Why not apply for citizenship, that would stop it dead I think.

I don’t think applying for citizenship will help much.  If you are on a retirement visa, or as we are in Queensland, on an aged parent visa you will wait at least 10 years to get citizenship.  At that point you have to have a medical.  Probably you are over 70 by that time and probably have a long term condition that could bar your application.  All that time you are still an overseas investor and you still don’t get citizenship.

It all depends on the jurisdiction and how its land tax legislation defines “overseas investor”. The point being made in the example below is that NSW defines even citizens who are residing overseas for 200 days in a tax year as such. With no “compassionate” relief (even for Covid).
Check the applicable regulations before acting, is not a bad idea. Then adjust you behavior accordingly.
Citizenship can be helpful. They can’t throw you out (bar extreme grounds). And you should become entitled to the rights of anyone else (bearing in mind all claimants gave to jump through some residency and working life residency hoops to get the age pension as I have outlined before.)

I am not even  permanent  so can't  apply for citenship
