MINUTES OF THE MEETING

In today's joint discussions the representatives of the management and the union were present as per the attached attendance sheet.

With reference of last minutes dated 14.03.2023 the IBA were advised to convey the outcome of meeting of sub-committee on medical insurance scheme, in this regard the IBA submitted the report dated 18.08.2023 in which the managing committee decided and signed agreement between United Forum of Bank Union and IBA on 19.07.2023. The same handed over the union/ association during the meeting. Further the IBA submitted an RFP on 24.07.2023 incorporating the agreed term as mentioned in the above said agreement and the process to select a bidder for arrangement of Medical Insurance Policies for serving employees and retirees was initiated. National Insurance Co. Ltd has emerged as the L1 bidder. The quotes submitted by NICL was thereafter approved in the Managing Committee of IBA and the same was communicated to banks vide letter dated 18.9.2023.

The representatives of union/ association suggested the certain views on less premium (copy of the same handed over to the Management during the meeting) for consideration and put the matter before managing committee while issuance of tender

The IBA submitted that the Hon'ble Court High Court of Delhi in the matter of Jugal Kishore Julka & ors Vs UOI (LPA No. 412/2023 & CM Nos 23237/2023......) vide order dated 24.8.2023 dismissed the appeal and stating that-

"The insurance companies are at liberty to set their premiums as well as the terms and conditions for each subsequent year in accordance with law. In addition, a retired employee being older in age than the serving employee would be at greater medical risk and, therefore, his premium has to be higher.

After prolonged discussion, the CLC(C) advised to IBA and DFS to take consideration on the grievance of retired employees and give reasonable opportunity to be heard. 

The representation and suggestion given by the union/ association for rationalization of the premium of the health insurance and other matter may also be considered positively while taking any decision in the benefits of retired employees. After due satisfaction of both the parties, the matter stands resolved and closed.

The matter can never be settled to the satisfaction of both parties and hence stands unresolved and pending only for any length of time.

1.  Retirees were demanding that Banks should devise a health Insurance scheme for all retirees free out of the staff welfare fund. No retiree has demanded IBA to form a scheme like this.
2. Who has given mandate to IBA to devise a medical scheme and recover 100% premium from retirees?
3. Medical insurance scheme is not a part of BPS but a social security scheme. First of all IBA has no authority to start this scheme and such a scheme should have been formulated with consulting retirees and not UFBU.
4. There was no application of mind by both IBA and UFBU while  forming this cheme. Both IBA and UFBU are well aware that while pensioners are receiving negligible pension due to non revision of pension and denying 100% DA etc, there are resigness and others who are not earning any income. Insurance co being a commercial organization is only concerned about its profit and may demand exhorbitant premium.
5. IBA and UFBU should have considered affordability of retirees while agreeing for such huge
    premium.
6. This scheme was uncalled for, not demanded by retirees and a unilateral decision by IBA and UFBU. Instead of asking Individual Bank managements to devise their own scheme for retirees out of staff welfare fund allocation this white elephant scheme was forced on retirees.

Let us celebrate the success of UFBR in solving medical insurance policy terms through this agreement with IBA .An excellent achievement by UFBR.
