Dear Sriramamurthy,

Since the issue of extending 100% DR neutralisation to pre Nov 2002 pensioners is resolved through negotiations between IBA-UFBU the possibility of granting arrears from 2005 may not happen.

If UFBU-IBA recommend to DFS, for arrears w.e.f date of Minutes or so possibility is there.Let us atleast hope for that.

Unless it has came through any court verdict the chance of getting arrears, is remote. Fact is, that  we have legally lost in the above case.

It may not be wise to ask for arrears as there is no locus standi, after the case having been dismissed by the courts.

What we got is by the benevolence of the finance ministry and had they decided against it,  we would not have got it, as no one can force them.

We have to thank the Finance Minister for her positive attitude and also the UFBU for pursuing the demand. Earlier FMs were dead against any benefit for retirees,.leave alone 100%DA.

Who cares for the court verdict? I along with many others in UCO Bank have not received commutation arrears despite the Supreme Court verdict.

Pre 2002 retirees must be happy to have received 100 % DA with prospective effect because the said demand was rejected by the apex cour.

I feel that pension updation must have been given which would have covered 100% DA also when implemented

INstead of satisfied with what they have now got asking for arrears is not in good taste because lot of other retirees are left out without any updation in their pension and also they donot know whether the same will be demanded by UFBU in near future

It may please be noted that pre2002 have now been granted only that which the other retirees have been getting since Feb2005/date of retirement. 

While asking for arrears is not unreasonable, that demand will never be entertained for the sheer quantum of monies involved.

Chv will be very happy to hear that lot of our colleagues have departed in penury without seeing any 100% neutralization in their lifetime.  Chv should try to live as a pensioner pre 2002 with no savings except pension and will know the pain, agony, and humiliation.  Some of our pensioners say that we should be happy with whatever we get.  Let those people keep such comments to themselves and not to preach their ideology to the whole group.  This google group is not for them.   We too have worked and when our PM Modiji declared one rank one pension to defence personnel, we welcomed it.  Why some of our own people oppose updation.  Perhaps they are chamchas.

The issue of having date of retirement as cutoff date for extending benefit like improvement in DA formula has not attained finality in the Supreme court yet.  (In our case the Honourable Supreme Court ruled that cutoff date is permitted in such cases.) Please go through the enclosed order of the Court. Once this case is decided by the Hon'ble Three Judge Bench, upholding the earlier decisions that improvement in an existing benefit should be extended to all without any cutoff date, we can file a Writ Petition in any of the High Courts seeking a direction to the Banks to pay arrears. 

Another avenue available is raising an Industrial Dispute by applying for reference of the dispute to a Tribunal. This can be done only by Unions /Associations representing the Workmen. 

We Bankers Association represents Workmen also and they have raised Industrial Disputes earlier. Sometimes Back I have sent a request to them in this regard. Though they acknowledged my request. no further information has come from them.

Sir, This is your opinion. Kindly keep close to your chest.  Do not try to force on this group which is meant to serve common good to helpless.  Perhaps, you have got  good source other than pension.  The same type of theory was given when some people were getting their choice of place etc., while less fortunate were working in remote places where no scope for children education unless they house their family in some other place which is really hard in real terms.    In your view, the people in the age group should always  live in a humble condition.    

Some notable retirees union have fought in supreme court to get second commutation to their members and arrears with  interest more than the bank interest rate.  If you have got time and resources,  kindly find out yourself.
