Pension to Resignees

I have moved applications under RTI Act to the following banks to know how 20 years is prescribed as eligibility for resignees to join the pension scheme.

Bank of Baroda

Bank of India

Bank of Maharashtra

Canara Bank

Indian Bank

Punjab National Bank

Union Bank of India

UCo Bank

Indian Bank has declined to provide the information. Some banks have informed that they do not have any documents for the same. Some other banks have provided irrelevant information.

My Second appeals under RTI are pending for a long time. My letter to DFS has also not yielded any positive results.

It seems that the UFBU is not interested in resolving the issue.

I feel that the minimum service eligibility should be only 10 years as per Regulation. The Joint Note or Bipartite Settlement has not stipulated 20 years as eligibility. The MOF clearance has not made any such stipulation. The Regulation is silent on Resignees. Applying qualifying service meant for other categories to Resignees will be a false interpretation. There are decided cases that whenever there is doubt with regard to the applicability, favourable decision to employees should only be taken into account. 

When there is no response from the management or the Unions, only option left will be through judiciary.

I attach gist of different communications I had on the subject with all these banks.

If anyone is interested I can provide copies of the entire set of documents for pursuing the case legally.

Dear Shri. Kalyanasundaram ji,

You have stated "The Regulation is silent on Resignees". In my view, this may be because, the framers (IBA, UFBU and GOI)thought that Voluntary Retirement is itself nothing but resignation under a special scheme titled  "Voluntary Retirement Scheme".

Perhaps, it is due to this same reason, they now say that eligibility under the present scheme is also 20 years.

However, if the Courts agree with the contention that 10 years' service is enough to become eligible for Pension
in terms of Pension Regulations 1995, it will be a boon for the Resignees.

Resigness who are affected should immediately take legal action. Do not wait for UFBU to take up the issue.  They have already signed the agreement accepting terms and conditions. By the time they take up the issue cause will be time barred. Their age-old trick is just to drag the issue by giving assurances that they will take up the issue and if frustrated retirees take legal action then they cry sub judice.

I am also in a similar situation and have qualifying service of 17 years and 11 months. Bank of India acknowledges that I have 18 and half year but still NOT eligible as I don't have 20 years completed services as Unilaterly stipulated by IBA and Banks denying Pension Benefits to resignees within 10 to 20 years of service and decisions made against the directives of Government which has no mention of stipulation of 20 years.Finance Ministry must clarify on this to the banks so that no eligible employee who resigned is denied of legitimate pension option and  benefit.

Dear Mr.Kalyanasundaram,
Congratulations for your efforts to get the bank resignees to get their rightful dues of pension.
I observe from the list of banks, the name of State Bank of india. SBI also denied me pension  for me, though I put in 18years 3 months 3days confirmed service and resigned from the bank in 1986. All my appeals for pension denied on the pretext that pension is not applicable for resignees  intre-alis implying the requisite period of 20 years not completed.

Discrimination between resignees and retirees is discriminatory and created by the bank authorities for denying pensions . You are right many organisations including  that of central Government provide for pension or proportionate pension for even resignees after putting in 10 years service.  

Denying a citizen for voluntarily opting out of service is his/her fundamental right. The moot point is the requisite period  which should be reasonable and equitable. This is decided by Government
institutions providing for pension/proportionate pension for 10 years.It is only the  Managements of PSU banks including SBI who have been arbitrarily fixing the 20 years period which is arbitrary
All the PSU banks including SBI are owned / controlled by Government of India and what is good and applicable to employees of GOI are equally good and applicable to PSU Banks/SBI.

Further, I am of the opinion that the S.C judgement of Honourable Justice Misra In 2015 in the case of SBI Vs its VRS Employees, of eligibility for full VRS for 15 years service is also a pointer that 
fixing 20 years is arbitrary and draconian.It can be perused for full clarity .

I am now 82 years old, and sharing my concerns for all my fellow sufferers and deeply grateful to Mr.Kalyanasundaram ,Mr.Pathak and others for their sincere efforts. If there can be any other platform where we can bring our concerns it is worth looking at. Welcome to sharing our concerns and take collective efforts.

Dear Mr. Kalayanasundaram,
The name of SBI is not in the list of the Banks you mentioned. I  wish to point out that, instead, I erroneously stated the name of SBI.is in the list.SBI is also one of the Banks stipulating 20 years service for entitlement of Pension and also denying pension for Resignees .

I wish to clarify the same.

Iam Vijay singh pension optee sincy1994 resignees having 32yrs of service,from sbbj bank.bank refused to pay pension .In any bank industry , is any body pension optee resignees banker who's receiving pension ?.
