It's true. Neither the Judiciary nor our leaders are interested in the fruitful culmination of the pending petitions. While the Association leaders will continue to enjoy the fruits till the case is pending in Courts, the Judge has no interest for he does not get anything whether he gives the judgement or keep it pending?

As per reports from various sources and outcome of BPS meetings status of our issues are as follows
1. Revision of EX Gratia
Sri Ripam Roy of  AIBOC in his latest speech confirmed that there is no provision for revision of Ex gratia in the recent BPS settlement. Review means extending existing Ex gratia on a yearly basis. However IBA has agreed to place the issue before the managing committee. . There is a possibility of negligible increase in Ex gratia from future date,
2. Merger of DA
Some years back IBA and UFBU were playing  actuaries appointment game. In one meeting UFBU used to ask IBA to appoint two actiaries and in mext ,meeting iBA used to ask UFBU to suggest names. No appointment of actuaries and no report is published. That game is repeated again.
UFBU demand merger of DA and IBA ask UFBU to prepare notes. In next meeting UFBU again raise issue without submitting notes and IBA again ask UFBU to submit notes.
3, UPDATION
When iBA is not ready to implement a merger of DA unless it is cost neutral, how will it agree for Updation.So Singla case has become an excuse for both iBA and ufbu to postpone discussions.
Few days back AIBPARC met IBA officials and discussed updation. At that time it was reported that the IBA had put a pre-condition that the case in SC should be withdrawn for further discussions. But AIBPARC was confident of victory in  SC, so it rejected the offer.
Now Since one year our case is not listed, Even when it is listed the case is not being  taken up for hearing. Every time our advocate has to request the court for early hearing as petitioners are senior citizens. Judge will agree and fix up a date. But again the same story,  not taken up for hearing.
Now AIBPARC also might have lost confidence about early hearing, it is demanding out of court settlement.

In case the case does not comes up for hearing before the summer break of Supreme Court ( which is most likely to be heard till then) , would it be advisable for our Solicitors to request the Hon'ble SC after summer break to assign a fixed date and time for final hearing by pleading old case and age of pleaders as was done in one of similar case in Delhi court where the date of 26.08.25 and time of 2.30pm has been ordered.

If very much sure of success/updation as per RBI formula in singlas case, why to negotiate?

Max another 12 months case will be decided.

We have opted for pension as per settlement Dt 1994.but banks say there is no updation clause in 1995 settlement. I do not know with whom the banks settled this settlement. Whether the banks  and UNIONS have got any powers to change pension regulation. This shows the banks are tampering the records with the help of unions. So if we want any immediate response there is no other way expect to file a criminal case against bank with police  showing both 1994 &1995 settlement requesting them to investigate the case. .

Advocate Mr.Sevaram has informed that this case will not be listed before Holidays. He is confident of the listing of the case after July 2025.
On the one side the case is not being listed and even listed not taken up for hearing. If the case is adjourned for months, will it be of any use for Pre 2002 pensioners?
On the other side IBA is adamant that unless the case is withdrawn they will not negotiate the updation issue,
UFBU is not taking any action to resolve the stalemate.
AIBPARC  whose affiliate is petitioner in Singhla case wants DFS to settle the issue out of court but is not ready to withdraw the case.
UFBU is not even taking up other issues like merger of DA and shifting of base year for DA/
But one thing is sure, Pre 2002 retirees will be positive till their last breath as only a few years left to reach god;s abode.

I think it is better to start dialogue with IBA and offer withdrawal of Mr.Singhla case on the condition that IBA  should offer some satisfactory updation settlement, for the following reasons/
1. Last hearing was held during March 2023 and since then the case has not been taken up for hearing. The case may conclude within one ,  two or five years.
2. The chances of success of the case is remote as earlier courts have rejected it.
3. IBA will implement benefits if any from prospective dates only. 100% DA case was fought for 12 years which made no impact on iBA and UFBU and finally implemented from future date.Lakhs spent on the case went into the drain.If
4. If today an agreement is reached and  even if we get an increase of 50% of what we may get through RBI formula. is great achievement. If delayed and an  agreement is reached after 5 years from prospective date, after losing the case we will lose 5 years arrears. If agreemnet is reached after 5 years, those who leave this abide during this period get nothing and those surbive will lose increased benefit 60 months
5. AIBRF, AIBPARC are flying high in the sky far from reality.
6. All stake holder retiree associations shed their ego and false prestige and unite and take a realistic assessment of the situation and start dialogue with IBA and achieve something.

It's a worthy suggestion from Mr Somasekara. Thank you for that.
Instead of waiting endlessly, the Retiree organizations should convince UFBU for setting up an immediate meeting with IBA to work out the best possible updation formula for the pensioners, besides other issues like DA merger at 8880 points. Once this is done in a manner that is beneficial to major segment of pensioners, particularly, the Pre 2002 pensioners, the parties to the MC Singla case can file a petion for closure of the case in the Supreme Court due to out of court settlement. The suggested process should not take 4 to 6 weeks time, and will ensure the pensioners in 70s and above get the benefits during their lifetime. As for the benefits, I subscribe to the view that a bird in hand is better than two in the bush.
As of now, we are not sure when our MC Singla case in SC shall be heard and a judgement given, that too in our favour or not and this is a prolonging uncertainty affecting the Senior pensioners.

One may remember,in 2015, there was an offer to negotiate 100%DA, if the court cases were withdrawn. But due to the adamant attitude of the petitioners the case continued to be dismissed by the court after few years, resulting in loss for the senior retirees. Same thing happens now. The unions do not learn from experience. The court case, if continues, does not guarantee a favourable decision. Wiser counsel should prevail and by withdrawing the case, the door for negotiation will open. And whatever we get will be advantageous as no more waiting will be there

But wo will advise the adamant and unwise petitioners.!

Rightly said sir,no other go,we have to start negotiation immediately.Alredy IBA told UFBU to withdraw the case.Hence as you said we must force the parties to withdraw the case,failing which no body will be available on know the fate of the case.please urge AIBRF AIBARC and other retirees organisations to take a wise decision in this regard

Wrong don't play with iba. We know pretty well that ibs will ditch pensioners. Better meet one lakh pensioners at supreme Court with a request for not postpone the case. Then the fools of supreme Court will come to know the serious ness. How  you are able to believe iba

IBA is a broker for banks. It acts according to the directions of bank. Only AIBEA is adamant because for VRS optees AIBEA has paid the amount from its pocket and AIBEA feels that the 2002 retirees had taken the PENSION benifits by way of  VRS settlement
So the unions are not interested and banks also joined their hands with UNIONS and playing with the lives of bank retirees.

Why blame IBA/DFS for all our ills when our own comrades are not espousing our cause.We quote several clauses in pension regulations for justifying updation and claim IBA is violating agreements and there exists a fit case for raising an industrial dispute with CLC.Who can raise an industrial dispute when parties to such settlements are observing silence.In these circumstances the prudent course appears to be what Somsekara has suggested
