At the outset, let me have the  pleasure to introduce myself as Devulapalli Srinivasa Murti running 77 years of age, a retired senior manager from the erstwhile Syndicate Bank, now merged in Canara Bank.  I retired from the service on 28 04 2001 under "SVRS" SCHEME-2000" OFFERED BY THE GOVERNMENT.


PREAMBLE:

It has been the established practice to revise pension to the retired employees periodically along with salary revisions for the working employees from time to time, to commensurate the mounting inflation , is an universal phenomena.

However, we the bank retirees have been deprived of this basic requirement for over three decades ever since the introduction of pension scheme in the banking industry way back in 1993.

During this interregnum period of more than three decades, the salaries of the bank workers  have been revised EIGHT TIMES and whereas, our pension basic has remained STATIC WITHOUT UPWARD REVISION  even till date against the mounting inflation. i furnish the important CALENDAR OF EVENTS  in brief:

PENSION UPDATION CLAUSE(Ex:2)


"2. FORMULA FOR UPDATING PENSION SHOULD BE ON THE LINES OF THE SAME GIVEN IN THE RESERVE BANK PENSION SCHEME. ANY CHANGE THEREIN SHOULD BE INTRODUCED ONLY AFTER MUTUAL AGREEMENT.   💢💢UNQUOTE💢💢
 
Accordingly an AMENDMENT was also carried out to the Pension Regulation 35(1) where the earlier RESTRICTIVE  CLAUSE WAS REMOVED BY MANDATING PENSION UPDATION  APPLICABLE TO ALL PENSIONERS UNIFORMLY.

In its Legal Circular dated 30.09.2019 appended herein,  the Indian Banks’ Association has defined the scope of their relationship with member banks.  By its own admission and proclamation, its capacity to represent member banks is limited to the matters specified in the said Circular.

 A CASE STUDY ON DIVERSION / EMBEZZLEMENT OF BANK EMPLOYEES PENSION CORPUS  -  FUNDS DIVERTED TO PRIVATE INVESTMENTS -  URGENT NEED FOR AN AUDIT BY "CAG" - THE ONLY CONSTITUTIONAL AUTHORITY - 

AREAS OF
MISAPPROPRIATION:

- By not remitting the management's  contribution towards the pension corpus promptly as envisaged in the regulations.
- Loss of interest for the belated period is not compensated.
- Misappropriation of the Corpus Funds to cover up the Banks' losses (Window dressing Ex: PNB ₹5260 Crores)
- By Diverting the Pension Corpus funds to Private investments  (Ex:OBC ₹200 Crores)
 
IN FACT, THE ABOVE  ACT OF THE CEO OF ORIENTAL BANK OF COMMERCE  IS  PROHIBITED IN TERMS OF THE TRUST DEED  EXECUTED BY THE BANK MANAGEMENTS  AS MANDATED UNDER THE INCOME TAX ACT  AT THE TIME OF INTRODUCTION OF PENSION SCHEME INASMUCH AS  PENSION CORPUS MUST BE INVESTED IN THE APPROVED GOVERNMENT SECURITIES ONLY .  WHEREAS THE SAID BATTERY COMPANY WENT INTO  LIQUIDATION AND CONSEQUENTLY, THE PENSION CORPUS  LOST THE ENTIRE INVESTMENT OF  ₹200 Crores

THUS, BY DIVERTING ₹200 Crores  FROM PENSION CORPUS TO A BATTERY COMPANY, THE  CMD OF ORIENTAL BANK OF COMMERCE INDULGED IN CRIMINAL BREACH OF TRUST FOR EMBEZZLEMENT OF FUNDS - A COGNIZABLE  CRIMINAL OFFENCE PUNISHABLE UNDER  IPC.      

SUPPOSING THE SAME WERE TO BE INDULGED BY ANY ERRING EMPLOYEE,  HE / SHE WOULD HAVE BEEN SUMMARILY  DISMISSED FROM THE SERVICE BESIDES CRIMINALLY PROSECUTING HIM / HER UNDER IPC EVEN FOR A PALTRY AMOUNT OF INVOLVEMENT FOR THAT MATTER WHEREAS  THE CEO OF OBC LET GO "SCOT FREE" GLARINGLY

whatever it is. 
1. First of all D.S Murthy is not a party in the  Singhla case. 
2. So he has no locus standi to interfere in the case. 
3. A case should be argued in court hall during the hearing date and not through email or letters. 
4. He can join as pleader in the case and argue the case.
5. Supreme court has provided guidelines /procedure for requesting early hearing of the cases for lawyers representing petitioners.
6. No outside party can make such requests.
So in all these points D S Murthy is completely wrong.
7.Such requests are made in PIL cases.
8. Pension/retiral benefits cases are not considered as PILs.
However  D S Murthy can submit general representation to Registrar of SC to expedite the cases of senior citizens.
9. First of all representation of D S Murthy is illegal and further addressing such letters to PM and FM is ridiculous. D S Murthy should note that neither FM nor PM can direct SC to expedite the case.

Yes, there should be improvement/revision/updation whatever the name one can call,  bank pensioners need more monthly pension to meet the increase in living expenses substantially.  The Medical Insurance Premium/expenses have also gone up in recent years and becoming unaffordable. 

 

CJI, FM and PM are given feedback by respective departments in the matter by experts in the field.  We should be honest and base our requests only on facts.  There is no need to quote / misrepresent information which are not correct/truth and helpful to us.

 

We got 100% DA, improvement in family pension and one option for res ignees without quoting Regulations (wrongly), without any court order, without proving any misappropriation, etc.

 

A honest and sincere request – will yield better results than placing our genuine requests on incorrect/misinformation/allegations which may harm us more.

 

There should be a rationale in whatever we are doing and there should be facts and facts alone.

1.     Is it right to write to CJI ?  There is a prescribed procedure for requesting hearing of the case at the earliest in SC.  The same has to be followed by the petitioners.  Outsiders have no locusstandi in these issues.

Please find attached letter dtd 18/07/2024 written by SC asking not to write to CJI as the same will not be looked into.

             

2.     All the documents are mentioned in email of Sri. D S Murthy have already filed in the   

              Singlas Case by petitioners.  No new findings/grounds are mentioned.

 

3.     Regarding embezzlement, there is no documentary evidence is produced by Sri D S Murthy and refers to a legal notice – which has no value.  Whenever we allege anything, there should proof, supporting documents to establish the allegation.

Please find attached the details (alleged misappropriation) – wherein all the issues are clarified by FM and also by PNB.

4.     Coming to Regulation 35(1), please read the clause again, please inform which part of the above regulation is not implemented by the Bank.  The same has been dealt by Karnataka High Court in clear terms by Single Judge and also by Divisional Bench.

5. Further , vide 2005 letter DFS has clarified the Govt stand regarding updation in response to Retiree association representation.  This was subsequent to amendment of 2003.  This have been referred in Singlas case at Chandigargh High court also.

 

The fellow pensioners are to be informed of the facts and truth only.  That will make the pensioners to understand the situation and will be ready to accept the outcome.  There is no meaning in creating hype and misinformation campaign – which does’t do any good to anyone.

Leaders/assumed warriors need honesty/sincerity in placing/pleading the demands with appropriate authorities and not gimmicks.

Mr D S Murthy, is very senior pensioner and celebrating silver jubilee of pension this year. 
This is any an attempt to clarify/draw attention to the various issues raised in Mr. D S Murthys email :

Yes, there should be improvement/revision/updation whatever the name one can call,  bank pensioners need more monthly pension to meet the increase in living expenses substantially.  The Medical Insurance Premium/expenses have also gone up in recent years and becoming unaffordable. 

 

CJI, FM and PM are given feedback by respective departments in the matter by experts in the field.  We should be honest and base our requests only on facts.  There is no need to quote / misrepresent information which are not correct/truth and helpful to us.

 

We got 100% DA, improvement in family pension and one option for res ignees without quoting Regulations (wrongly), without any court order, without proving any misappropriation, etc.

 

A honest and sincere request – will yield better results than placing our genuine requests on incorrect/misinformation/allegations which may harm us more.

In same manner Sri D.S . Murthy has enlightened the plight of Bank retirees and pensioners in his unique style.
A Little bit of broad veiw and friendly approach is necessary to accommodate the efforts made by individuals to achieve justice to retirees and pensioners.
It is well known fact that all the retirees associations have totally failed to impress the UFBU to successfully achieve pension updation,why anyone should discourage individuals who are beating arround the bush.

Listing of updation cases is beyond the control of pensioners. The wise step is convincing IBA to start discussion on Updation pending court verdict or withdrawing cases on the condition that IBA come out with an updation scheme.  AIBOA has filed a case in Bonbay High court which is adjourned to Sep 2025. SBI pensioners group case in Delhi High court is pending as Bank has not filed its reply. There is uncertainty in Singhla case listing. While IBA is claiming  sub judice because of pending Singhla case, AIBOA instead of convincing IBA to start discussion, pending court verdicts, has filed one more case. Is there any deal?
No union is taking up the merger of DA.  Both IBA representing banks and UFBU are well aware that pensioners  have no other alternatives  but to approach courts which takes 10-15 years to mpass verdict.
They cannot even get information through RTI.
DFS will never pass unilateral orders. Only IBA has to recommend for updation.
Under these circumstances !st phase action, 2nd phase actions, Dharnas are totally irrelevant for pre 2002 pensioners who are aged.
Instead of these gimmicks, all unions AIBRF,AIBPARC, BMS and Mr. Prasad's Union should unite and take issue with UFBU directly.
