La Residention builders are asking buyers to sign a consent form. Issue is being discussed by members of Buyer Association.
BUYER WILL LOOSE HIS RIGHTS:
1. After providing consent that consent will also be given/consider for extension of date of completion and buyers may not be able to claim any delay panelty.
2. If project goes to RERA under section 8 than RERA will be responsible for getting the construction completed. Builder will be free from all his liabilities. Registry will not be completed as funds will not be available to pay dues of GNIDA. GNIDA will not issue OC/CC until dues are not paid.
3. Builder need consent from buyers to extend date of completion as per RERA rules.
4. There is no clarity what will be terms and conditions if buyers provide consent to builder.
5. There is no clarity how builder will arrange funds and how they will pay land dues which are app Rs. 206 crores as on 31.03.2022.
6. According to builder 98 crores (dues from buyers) + 167 crores (due to CR) will be recovered and construction cost will be 217 crores. How builder will repay all his dues to various agencies and GNIDA from balance 48 crores (167+98)- 217= 48 crores balance to pay all dues including land dues to GNIDA.
In nutshell, LA residentia is playing mind game by obtaining NOC from buyers, but he should first give undertaking that he will pay full interest from the date from which the flats were supposed to be handed .over to the byers as per initial agreement. Why he has stopped the construction for.last many years and could not hand over the flats as per agreement.Even he.had accepted before SC of India that.he will.complete the projects by so and so.dates. We should not accept this proposal from him.
Why he has tried to built 38 towers, he should have raised only few towers as and when.the money being received from the buyers. It was complete manipulation.from his part and today.he is making lame excuses by giving this kind of justification ,which is.not acceptable. FIRST ,all Directors should be sent to.jail. THERE is a high handedness in this project. LET the SC take decision in this case.
All.directors and their family should be harmed.directly or indirectly for their fraud and ultimately this will.happen in time to.come.becouse they have mischived all middle class byers for their hard earnings
