Dear Fellow Residents,
At the outset, we would like to apologise for the long email. However, it was absolutely necessary in view of the deliberate attempt by few disruptive individuals to create misinformation and confusion among the fellow residents with an intention to take undue advantage of the confusion. Couple of residents who were blowing the trumpet of Maitri Nyas started advocating individual action against the builder and now they are seeking support for RWA formation. Their plan of action has changed 3 times in 3 days!
We are surprised to note that these individuals are now advocating the formation of a RWA. We have been advocating this for more than one year and these same individuals have been opposing it tooth and nail and even posting whatsapp messages to fellow resident for boycotting General body meetings which were called to discuss the formations of RWA/RWS. This has resulted in a delay of one year for all of us. It further surprises us that these few individuals are not even aware that RWA or Apartment Owner’s Association can’t be formed without the completion certificate from the authority. Relevant extract of the applicable act is attached – pls refer last line in point no 2. This has been discussed in all public forums and also clarified by the lawyer in General Body Meeting (we wish these individuals had found time to attend these meetings). So all Residents, including these individuals, who support formation of a RWA are basically supporting the on-going actions of RWS. We hope that the above clarifies everything to everybody. Residents are requested to not get misled by false propaganda spread by these few individuals with vested interests.
These individuals are finally asking relevant questions about which organisation is the best way forward for us. But they are asking these questions one year too late! We have been asking these questions for more than a year and once we achieved unity, we have found answers to all these questions. We have brain-stormed, taken legal opinion on the way forward, taken a united decision and are proceeding in the right direction step-wise accordingly. The steps are as follows –
1. Formation of RWS with Bye Laws as per Apartment Owner’s Association
2. Push builder for completion of the Project which will facilitate builder to get Completion certificate from Noida authorities.
3. Builder obtains Completion Certificate.
4. RWS is converted to RWA / Apartment Owner’s Association – All RWAs / AOAs are Societies and are registered with the same Registrar in Meerut
We were informed by Amrapali Management that around 4-5 residents of Eden Park visited Amrapali office on Sunday (24/01/16). They were informed by Amrapali Staff that all necessary updates have already been provided to RWS Office Bearers on Saturday (23/01/16) and they were advised to communicate with RWS in future.
Now it seems that these individuals cannot digest the fact that they are not able to claim credit for so many positive developments in Amrapali Eden Park. For them the work progress is not important but who is doing it is more important! Thus they invited Mr Mohit Gupta (Director – Marketing) of Amrapali to AEP on 27th Jan, but he had an emergency and he couldn’t make it. Apparently he is again expected to come today. The point to note here is that Mr Mohit Gupta was responsible for selling this project and he has done an excellent job of it. Although he is not directly responsible for the completion of this project he feels morally responsible and thus is obliged to interact with these individuals who were his customers. In any organisation each vertical is headed by different individuals and these individuals take responsibility of completing activities in their vertical. Such involvement of Mr Mohit Gupta will not bear any fruit as he in any case will refer the matter to the concerned vertical head who is already coordinating with the RWS. It will only waste his and everybody else’s precious time.
But to maintain the pretences of unity amongst AEP owners in the eyes of the builder, we are not opposing this invitation. However we are reasonably sure that Mr Mohit Gupta will not trespass into his colleague’s responsibility area and he may not come. Even if he comes, he will provide the following updates, which have been achieved by the efforts of the RWS within 3-4 weeks and are already available to all residents –
1. Electricity Bill payments have been streamlined.
2. Security has been restored from 2 to 20 guards.
3. Gun Man has been posted.
4. House-keeping staff has been increased from 2 to 8 and will soon be increased to 10.
5. DG Fixed Charges were reduced from Rs 100/KVA to Rs 50/KVA.
6. Water Softening Plant is under commissioning and is expected to go online within a few days.
7. Fire Safety Equipments have been received on Site. Installations will begin soon.
8. PNG Connection work which was stuck up for so long after partial installation, has restarted both in C and D Tower. There are some technical issues in one wing each of both C and D Tower and competent RWS members are coordinating the resolution both at IGL and Amrapali end.
9. Registration of our flats has been promised within this financial year by the builder. Amrapali along with various builders have negotiated a global settlement with NOIDA authority and this proposal is now under final approvals.
There is a positive movement from the builder on all pending points and regular updates are also being provided by the RWS. RWS is tracking all these points on daily basis from all angles. However, miracles can’t be expected and it will take time to achieve everything that we want.
Hence all residents are requested to be patient and not get confused by the false propaganda of certain individuals. We are proceeding in a totally legal, democratic and transparent manner under single umbrella. Any action which is not synergistic with the common interests of all residents and which highlights divisions to the builder, might negatively impact the positive, united process which has been created by RWS with a great deal of effort. If this positive movement gets affected negatively by the un-warranted actions of these few individuals, they will be wholly and solely held responsible for all the consequences thereafter.
