Hello RWS

So far RWS isn't a registered body and it has no legal rights to check & monitor the financial transactions on behalf of residents. So please refrain from doing that and share the information you've openly to all residents. 

Please share, if you've, the latest sheet similar to attached that shows housekeeping approx ₹5L and DG maintenance approx ₹13K per month being charged in per sft rate.  This sheet isn't a propoganda. It was provided by builder and may be outdated. At least it was shared with all residents by Maitri Nyas. 

Please read attached builder buyer agreement and tell why RWS isn't pushing builder to finish basics and obtain completion certificate before asking for maintenance payment. 

Your short answer is that everything is OK and residents should decide to pay or not pay and you are making sure all payments are going in right direction.

Moving forward to responding valid questions and suggestions by fellow residents (ignoring common after-thoughts which will always prevail in large society), please allow us to put details one at a time -

1.      Name of Office Bearers – The current committee is an ad-hoc committee which was primarily elected to form the Society. Once the Society is registered this Committee will complete the membership formalities of all Owners and then resign paving the way for an election. It has been decided to not publicly disclose the names of these Committees Members on a notice board so that they do not have an unfair advantage in the elections. However, since so many residents are keen to know the names, we will be happy to submit details after discussions among present committee. In the meanwhile please treat RWS as a group of volunteers and all are free / welcome to join this group. There is a lot of work to be done!

2.      DG Charges – From the collection of Maintenance Charges of Rs 1.80 psft, not a single Rupee is going towards DG Maintenance. This information is totally misleading and our office bearers have checked the necessary calculations. Fixed Charges of Rs 70/KVA for meter is going towards the Grid Charges from the UPSEB (in fact it is less than the charges being levied by the Grid). We are taking up the levy of Fixed Charges of Rs 100/KVA for DG Backup with the builder as they have not provided any rationale for the same to us. In other Societies, this charge is as low as Rs 50/KVA. Once we get a revert from the builder on this, we will update all. We are hoping that the same may be reduced to Rs 50/KVA. The reduction, if any, will be adjusted in future bills.

3.      Maintenance Charges of Rs 1.80 psft – This is to reiterate once again that Maintenance charge is prerogative of Builder, not governed by RWS. The builder had taken a decision to levy Maintenance Charges from Dec’15. It is common knowledge that at the time of Registration, we need to obtain a NOC from the builder and the same is issued only after all dues are clear. So we have no option but to pay the Maintenance Charges although we were successful in reducing the rate to Rs 1.80 psft from Rs 2.25 psft originally agreed upon (most of us had issued undated cheques for this amount). Paying maintenance is not under control of any society or RWA/RWS while project will run under builder for next 3 years as per owner's agreement with builder as it is a matter between them. Although, we have pressurised the builder on all other pending points, once we start paying maintenance charges (which we have to pay in any case sooner or later) at least we have a right to demand various services. Competent RWS Volunteers are auditing every single Rupee collected and every single Rupee spent on this account on a weekly basis. At the cost of repetition, paying maintenance charges is your decision, not enforced by anyone other than builder.  However, be rest assured that RWS will keep a check that all the money paid is only contributing to the betterment of our lives at Eden Park and not getting diverted by the Builder.

4.      Housekeeping Charges – This information has no substantial evidence and please ignore such propaganda. We have competent volunteers looking into these matters. House-Keeping expenses are a part of Maintenance Expenses and we are tracking the daily attendance and the payments thereafter of all Maintenance and Security Staff. Please stop worrying on this front and avoid rumours.

5.      Information Sharing – RWS is putting up a weekly update. For any major policy discussions / decisions we hold a General Body Meeting. All residents must understand that we are in a state of negotiation with the builder and builder is privy to all notices that are put up by us. So we are constrained in our communications. This email ID is the authorised email ID of the RWS, however no individual can send emails from this ID unless it is vetted by the team. Thus residents are requested to not expect an immediate response to emails sent on this email ID. All are requested again to put their suggestions / opinions only on the Suggestion Register and by emails to this email ID. All must rest assured that competent volunteers are looking into and acting on your suggestions. We encourage more suggestions and guidance in order to accomplish matters based on priority.

6.      RWS formation viz a viz Maitri Nyas – Maitri Nyas as a platform was not able to unite all residents and the larger group was of the opinion that a society will be the best way forward, which was later vindicated by the opinion of an eminent lawyer who was invited to the Society to address a General Body Meeting and clarify. Please allow us to remind that formation of RWS was as a result and concurrence of aforesaid meeting with presence of most of eminent members. If you go through the updates, it is very clear that the attitude of the builder towards the RWS is progressive and many positive results have been achieved. First of them has been Security and House-keeping. Water Softening plant and Fire Safety Systems implementation have started. The subsequent RWS formation has following advantages apart from stronger representation to the builder -

a.      Unity - Builder knows that we are all united now

b.      Proper Legal Entity for the purpose - Legally strong and not vulnerable like a trust

c.      Fresh and some more mature Residents as part of Committee and Volunteer Group

d.      Society decision making is democratic while in Trust it may be autocratic

e.      Society collects contributions and thus members have rights whereas Trust collects donations which bears no rights

f.      Society can be converted to RWA but Trust can’t be converted

g.      Many more reasons…..

We hope that all queries have been answered. Some of the above queries have already been discussed umpteen number of times in the last 3-4 months and we hope that after today’s clarifications these are not raised again. We have to move forward instead of re-inventing the wheel.

I feel group putting so much efforts will definitely bring lot of positives to society, it might take sometime.

Hi

I am happy to receive an email from the proposed RWS office bearers. This facilitates cordial discussions and healthy debates. This email is a relief after the last email which was in a bad taste.

Just as an introduction, I moved into AEP in May 2015. I joined Maitri Nyas and when the discussion on forming a Society came up, I participated in all the meeting including discussion with the lawyer, and I also paid Rs 1000 for the membership of RWS.

Hence, I am part of the RWS, which is referred to in this email.

I as a member, am writing this email for seeking some clarifications.

1. Maintenance Charges

I have requested in the past, but since, Minutes of last General Body Meeting were not published, I am re-stating basis my memory:
- The decision to levy maintenance charges was supposed to be linked to some completion visibility. I also believe that we were going to get a view of the following:
    a. The number of security staff and maintenance staff per month
    b. At Rs 1.8 per sq ft per month, Amrapali was supposed to be not breaking even. And, we had discussed all the costs borne by Amrapali. I may be mistaken, but I thought DG maintenance was also included therein, as Rs 100 per KVA was never discussed. The view which was taken that it is good for Amrapali to bear around Rs 0.3 per sq ft of costs as that way they will have some need to drive completion and handover to RWA faster.

- The maintenance was supposed to be levied from January 2016 after having received the above information

Hence, seems like Amrapali has not been transparent with RWS and they levied the charges without taking RWS into confidence. On the other hand, in case the builder has shared details, request you to please also share with members. Or please let me know who I can meet to understand this in further detail.

On DG meter costs, I am aware that few societies levy some charges but then, they also provide some units free (so if the levy is Rs100 per KVA and say in my case I have a sanctioned load of 5KVA, for Rs 500, I will get 500/17 = 30 units free. By the way, I am surprised why they charge Rs 17 / unit for DG power, then?

2. Parking and entry of cars without stickers
In the last email, it was mentioned that RWS is looking at options to work out mechanism and discussing with builder. This was never on the agenda of any General Body Meeting and hence, it was never discussed before. Also, I as a member of RWS have not seen any proposal being circulated. May be my email was not updated in your database or maybe not the RWS but the office bearers are in discussions amongst themselves and with the builder. In any case, may I please request for the proposals / options be shared for comments as I am also a volunteer and well wisher of the society. It may be a good idea for this discussion to happen internally before discussing with the builder.

I am very concerned on security and entry of unidentified cars and visitor cars should be dealt with firmly. In case there are genuine concerns like those of personal security, which I am sure will be extremely few in nature, I am ok with them being granted a VIP / exception status so that atleast we can contain the lawlessness we have inside the society. In all my previous residences and jobs, cars without stickers were clearly kept outside the society and visitor parking was strictly outside the gate. I believe that even the Members of Parliament cannot go to the Parliament without stickers in their cars.

In my concern for security, recently I pulled up Maintenance Manager and showed few examples of lapses in security. He has promised that corrective actions will be taken in the next 8-10 days.


My older pending requests:
- May I please request for the Memorandum of Association of the proposed RWS to be please circulated. Even if the names of office bearers is withheld, I do not see a harm in the MoA / Rules of the RWS to be circulated
- Minutes of the last General Body Meeting be published. Some of the key points that I remember are:
    - The elections will be conducted within 1 month of registration
    - RWS to increase written communication with the builder so that we can strengthen the legal case, in case people decide that is the recourse to take. After all, the RWS was being formed as it had a stronger legal structure. Also, copies of these letters to be shared with other relevant offices within Noida, like the Noida Authority, District Fire Officer, District Magistrate etc.

Looking forward to making AEP a safe place to stay.

With so much of emails floating around and no concrete information in any of them on Project completion, NOC from NOIDA and registration of flats.
My updates to make more and more information available in the residents domain.

1.      Name of Office Bearers – 
Since RWS is adhoc not yet Registered everything is Face Value, not disclosing names and working in closed chambers to me seems to be the reason for questions being raised.

Adhoc RWS have no right to make any decisions, all decisions should only be taken upon majority residents consent and not by few individuals.

2.      DG Charges –

For residents information this worksheet was provided by Amrapali.
Either Amrapali is falsifying adhoc RWS now or there has to be research around these figures.

For residents reference attached is the screenshot of official communication received from Amrapali on this worksheet.

Is there now any such official communications from Amrapali to share with residents? We should have proper documentation and evidence to share with residents, just assuring does not really helps.

3.      Maintenance Charges of Rs 1.80 psft –
Maintenance can only be charged upon Completion of the Project, residents can read the builder Buyer Agreement Para 22 (a) for confirmation.

4.      Housekeeping Charges –

For residents information this worksheet was provided by Amrapali in October-2015 while they were planning to start maintenance. Above is the screenshot.
Either Amrapali is falsifying now or there has to be research around these figures.

We should have proper documentation and evidence to share with residents. Just saying everything is OK, even while we all know nothing has changed in society is not just helping.


5.      Information Sharing –
As per my information last General Body Meeting (GBM) of Adhoc RWS was held on 06-Dec-2015. 
Ever since then there were couple of weekly updates which came up on notice board, which said a monthly GBM would be held.
It is nearing close to 2 months, no such GBM held. Not sure if Amrapali is privy to this too.

6.      RWS formation viz a viz Maitri Nyas – 
AEP Maitri Nyas was able to unite 175 members on one platform, there were few who were left out who did not want to be part of it citing legalities around it.

It would be worth to pay attention to emails and concerns raised by residents on public platform, then requesting residents to suppress from doing so.
There are more residents against such actions then who support such actions.

Water Softening plant and Fire Safety Systems implementation have started.  -- 
Few of us spoke to Avinash 7 days back. There is no such progress. Or if residents are to believe there is progress on this front, please provide  firm dates on when this will complete.
One of the adhoc RWS weekly update 5 weeks back said Water Softening will complete in 2 days, it has been 35 days ever since then nothing happened.

a.      Unity - Builder knows that we are all united now -- 

Builder knows they have an Adhoc group which seems to be giving priority to their views than that of residents as evident from responses by residents on emails and from public residents domain.

b.      Proper Legal Entity for the purpose - Legally strong and not vulnerable like a trust -- 

It is still Adhoc RWS, or does adhoc body brings any legality. We have recently seen incidents and in past of folks issuing legal threats to residents. I am sure we did not want to achieve this sort of legality.

c.      Fresh and some more mature Residents as part of Committee and Volunteer Group -- 

It has now become a regular practice of underestimating people who have worked in past for betterment of society.
Taking their inputs along may help the society, instead of blaming their caliber and maturity levels.

d.      Society decision making is democratic while in Trust it may be autocratic -- 

Majority of Residents do not want to Pay Maintenance without registration or completion roadmap by builder. Unsure what makes us believe that by giving builder go ahead to start maintenance was a democratic decision of Adhoc RWS.

e.      Society collects contributions and thus members have rights whereas Trust collects donations which bears no rights

We should spend time and energy around following up with builder and Authorities to get NOC procured and get flats registration done. We have already spent our life time money earnings to buy a flat in AEP.
More mney Contributions should be things of future when corpus and all is needed, once RWA/AOA is formed.

f.      Society can be converted to RWA but Trust can’t be converted

Why is RWA/AOA not created at the first place. Why RWS? Why another intermediate platform? 

Questions will be raised again and again, unless information is provided to residents via weekly meetings.
It should be evident that with so many residents asking questions again and again over emails and on public platform it translates that there is no information available in residents domain.

Last not the least. Stop the blame game, we may lose friends than adding to the kitty.

Ruchhir has raised a very valid point which you should definitely answer for the benefit of other residents like me -

Why RWS isn't pushing builder to finish basics and obtain completion certificate before asking for maintenance payment? Is the RWS formed for the benefit of residents or for helping Builder collect the maintenance charges?

Also, As a resident I have few questions which I seek reply to -

1. The office bearers names are not disclosed, we don't know how many residents are there in RWS, how can RWS take unilateral decisions on important issues like Maintenance Payment, Parking, Security on behalf of majority of residents who are not RWS members.

2. It is been communicated that RWS was formed in so called "General Body Meeting" - How many residents/owners out of 300+ flats owners were present in that meeting, what was the quorum of the meeting, who decides the quorum. Please provide consensus of all to proceed  with meeting without enough representation.

3. I see that the communication on behalf of RWS is done from "resi...@amrapaliedenpark.com" . Since RWS is not a registered entity how has it purchased a domain and that too commercial (.com). Who has authorized RWS to purchase assets on behalf of AEP residents?

4. Mr. Ajay Kumar & Mr. Mohit Gupta themselves said that there would be part maintenance to the tune of Rs.1.00/Sq ft and it would be subject to Amrapali providing roadmap of completion of project. Why RWS agreed for Rs.1.80/Sq ft which is nearly 85 % of the total maintenance charge and that too without any commitment from builder on project completion?

5. Who are Competent RWS volunteers auditing the maintenance charges, are they qualified for doing books audit and accounting, are they CA's/Auditors in their past or present experience? We as residents have all the rights to know this as we are paying/would pay maintenance charges. 

6. What is the check and balance mechanism of RWS to ensure that the maintenance charges paid by residents don't get diverted by Builder?


Are we really so naive that we are asking for suggestions to deal with builder in 'Suggestion Register' in Maintenance Office which will have full visibility of builder/builder's staff.


A point wise revert in layman terms without getting into legalities and 'just personal assurances'  will be appreciated.

I just heard from Salim (D tower supervisor) that "IGL for D tower has been canceled for now as IGL can not lay the pipe alongside round pillar and wants separate brick lane to be done which will cost ₹ 1 lakh for builder to do, why will builder spend rs 1 lakh for IGL hence it is halted."

I don't know about Maitri Nyas and RWS, but as I said in earlier email, we've individually follow up to get things done.

Dear Owners

We can visit Amrapali HQ next week to address open issues in our own capacity (not RWS and not Maitri Nyas). 

Also  each of us individually can send signed letters to all authorities and address it to Mr Anil Sharma, via registered post, to build pressure on builder. Again in our own individual capacity. We can have a draft letter made so everyone can use it. 

If there is interest in doing above two items than we all can meet to move ahead on these. I'll reach out to my neighbours and acquaintances, you can do the same.

This letter will be CCed to NOIDA building department as well as to the DM ( who is the district administrator to safeguard public safety) so that they are in the loop and the builder can not take it lightly.He has to act on this.

The Forum for this action can be RWS or AEP which ever has more legal sanctity which I feel is RWS as per the legal opinion sought in one of the meetings when we heard the lawyer in detail.

Lets do this by 31st of the month so we can start moving in this direction

To kick start this process my request is that both RWS and AEP office bearers should establish contact immediately to start this draft process.

We would have to send such letters in individual capacity with majority of residents sending it. Maintenance is petty issue and we have bigger tasks at hand. 
1) NOC from NOIDA 
2) Registration of Flats 
3) Fire Safety Setup 
4) Water Softening Plant
5) Exhausts Provision in Basement

Moreover RWS is not a registered body and it has no legal sanctity at all, whatever the claims may be.
Maitri Nyas being a Registered body was cited to be legally vulnerable by few residents. If that is the case RWS is not any different, could be more though.

Lets now put all our energies in one direction to get our issue resolved with the builder. ( No point its maitri niwas or RWS  we all our together in this)

my suggestion is as follows

Lets list out all our issues which we want the builder to resolve within a time frame.

Both RWS and AEP can sit together to make this list .

After this is done all residents should sign on this letter and submit to the builder for resolution within a reasonable time frame. This letter will be CCed to NOIDA building department as well as to the DM ( who is the district administrator to safeguard public safety) so that they are in the loop and the builder can not take it lightly.He has to act on this.

The Forum for this action can be RWS or AEP which ever has more legal sanctity which I feel is RWS as per the legal opinion sought in one of the meetings when we heard the lawyer in detail.

Lets do this by 31st of the month so we can start moving in this direction

To kick start this process my request is that both RWS and AEP office bearers should establish contact immediately to start this draft process.

I agree these are the main issues of concern. We should put individual efforts to chase this with builder so that builder feel restlessness of residents and put something in action. Sending letters to builder is good idea, we should all gather in larger group and meet builder time to time.

Completely in agreement with you guys. It would be great if someone can share a common letter which can be signed and sent to Amrapali in individual capacity. In that case all our letters would highlight same/common issues.

Spot on.  Completely agree. I am sure most of the residents will be interested in doing so. It is time now to do this in our individual capacity.There are still many issues pending as pointed out and this can become a big campaign if other residents support.

I also agree with below action points and these points are the basic foundation for long term and need to be taken on priority.. Pl consider me available whenever we want to visit to builder either with RWS, Nyas or in individual capacity..

Also in the letters we are planning to send to builder we can mention some timeline that if we didn't get any proper timelines for its completion than residents will be doing Dharna in front of Amrapali corporate office..

I had perception of this when RWS stormed in and showed legal venerability to AEPMN, and today even RWS is also not very different. 
In my personal capacity I drafted letter and sent by speed post to Mr anil sharma Amrapali Head,
Noida Authority, DM Office, and fire department. 
And I highlighted these same points written here by other fellow residents. 
So I request you all to send these letters as I did, in your personal capacities. This will build pressure on builder and govt authority will also have idea about this societies's pathetic and unhealthy state. 
We can also connect to other members and send collectively.

I'm, as other residents, a little baffled and seek RWS to clarify this:

As per Societies act 1860:
The following societies may be registered under this Act:-

Charitable societies, the military orphan funds or societies established at the several presidencies of India, societies established for the promotion of science, literature, or the fine arts for instruction, the diffusion of useful knowledge, 1[the diffusion of political education], the foundation or maintenance of libraries or reading-rooms for general use among the members or open to the public or public museums and galleries of paintings and other works of art, collections of natural history, mechanical and philosophical inventions, instruments, or designs. 


Question:
While the name "Residential Welfare Society (RWS)" makes it sound like it is an RWA or Apartment Owner Association but it is not. Is this correct? Is RWS that is being made, a charitable society? Much like what Maitri Nyas was but instead of a trust, RWS is a more legal society and it is still not an RWA/AOA? Please help clarify. 

Above clarification will help residents in deciding.
