On Monday morning you were informed by my driver that it is my car (he also apologised to you repeatedly). You were informed by Avinash of Amrapali that it is my car. You were informed by security that it is my car. You asked my driver to call the owner and I went down but you disappeared. There are messages on Whatsapp taking my name on Monday (I have copies of the same) which proves that you very well knew whose car it is. Everybody knew whose car it is. There are “n” number of witnesses to all of the above. So don’t make it appear that you did not know who was the owner of the car. In fact I believe that you did what you did only after coming to know that it is my car that too under other people’s influence.
You have no authority to detain or blockade anybody’s car. It’s a crime! Even when the police detains a car they need proper authorisations and they need to complete the necessary paperwork. The parking space is considered as Society’s common area but is allotted to you for parking as per Supreme Court’s order in this matter. You cannot claim ownership of that piece of land – that’s why you can’t fence it, you can’t put a door, you can’t get a electricity connection and blah blah. That’s why I wrote that you should check your legal position on this matter.
Regarding ownership proof – have I asked you to give me ownership proof of your flat, have I asked for you ID, have I asked for your parking allotment letter! You are forgetting that you are talking to a fellow resident and your behaviour towards him is totally unbecoming of your stature. I always thought you are a mature individual and this was least expected from you of all the people (maybe you were persuaded by others).
I have been very patient in this matter for 6 days because I did not want to create unnecessary hassles for you inspite of having very clear legal opinion. You are like my younger brother and I was waiting that better sense will prevail. I was forced to write the below email in view of the attached Notice put up by you. I was exasperated that you were making it appear that you did not know whose car it is.
Please remove your car any time to sort out this matter peacefully. My driver is waiting to take out my car. I am willing to close the matter without hard feelings unless forced to do otherwise.

If the car had sticker on it with your flat number then I'd have called you and told you about it. This is what neighbors do. But since there was no sticker, I didn't know whose it is and had to block it to avoid any security lapses. If MH 02 CV 4239 is your car then please give its ownership proof to either maintenance office or me so I can release it. I couldn't release car to a driver or anyone who isn't the car owner. Also please get sticker because it doesn't look nice & I feel cheated by builder for paying for 4 car parkings.
I'm at home and can unblock it anytime. If you still want to pursue legal option, then that's OK too.

I am writing this email to highlight the hooliganism and high-handedness of few individuals prevalent in our society. I request all to forward this email to as many residents as possible to root this behavioural pattern out immediately in the long term interest of our society. I apologise in advance for infringing on your time but the matter though personal today, is an indicator of things to come in the future, which may affect everyone.
This kind of attitude has been prevalent in our society for very long. People have got into fights with labourers, people have shouted at / abused security staff, people have misbehaved with a lady resident on the gate, people have barged into one senior citizen’s (who lives alone) residence at midnight in a group of 10 and started a fight and many more such instances. There have been bitter fallouts too of such actions but certain individuals just don’t seem to learn. The facts are as below -
I was out of station for 5 days last week and came back only on Sunday late night. When my driver came to park my car in my parking on Saturday (in my absence) he found that there was some other car parked in my parking. He was asked to park my car in any empty parking space in -3 basement in the meanwhile to avoid any inconvenience to any other resident. Erroneously and without my knowledge (as I was out of station) he parked the car in Mr X’s allotted parking (unlike some people I will continue to maintain my class and not use anybody’s name on a public forum). He then left the key with a fellow resident.
On Monday morning I received a call from the security to move my car and I was shocked to note that the same is parked in somebody else’s parking. I immediately asked my driver to move the car and park the same in my parking (if I had the key with me I would have done so myself). When my driver came to remove the car Mr X started threatening him with all kinds of physical harm and consequences. My driver apologised for his mistake repeatedly but to no avail. As soon as Mr X came to know that it is my car, he parked two of his other cars around this car and did not allow my driver to remove the car. Surprisingly till then the top priority for Mr X was to remove the car but now suddenly he did not want the car to be removed. He wanted to create conflict and gain mileage from this incident. By the way Mr X’s Scorpio was parked on the driveway (in an attempt to blockade my car) which is of course not wrong as per Mr X!
I am thoroughly surprised to see such behaviour from educated people in our society. Such high handedness and total disregard to basic norms of living in a society is shameful to say the least. In the past, many times people have parked their cars in my parking (including on this Saturday) but I have never forgotten my basic upbringing. I am sure it has happened to each one of us but never has the issue been escalated to such levels. The situation could have been handled with some class without getting into an ego hassle with a driver!
With the above background all are requested to refer to the attached message forwarded by Mr X. My driver has apologised to him repeatedly, Mr X has been in touch with the building management on this issue for the last week and Mr X is still guessing who is the owner! My driver and representatives have made multiple attempts to remove the car but Mr X is not allowing the same. How can then he claim that there is a property theft ? Whereas my car is my property which has been illegally blockaded by Mr X for a week as per his own admission and I have been patient till now.
Also, Mr X is requested to identify the 5-6 cars that belong to me without my knowledge. If he can’t then let him accept that he is spreading misinformation. Further what is the authority of Mr X that I should claim my car, whose keys are in my possession, from him ? In any case my Driver claimed it on Monday morning at 8.45 AM so why did Mr X threaten him and blockade the car for a week and now wants it to be claimed ?
For peaceful resolution of this matter, if better sense prevails, my driver will try to take out the car twice, once at 10 AM and then at 6 PM on 16/01 (Saturday) if there is no blockade. If he is unable to do so till 6 PM on 16/01 my legal representative will take all immediate necessary action to ensure that Mr X has to answer for the following civil and criminal violations, for which we have ample proofs, witnesses and Mr X’s own admission –
1. Threatening a Citizen of India (my Driver) with physical harm and use of abusive language.
2. Unlawfully detaining my moveable property against my wish.
3. Staking a claim on the common area of the society.
4. Maligning my name on a public forum for an act not committed by me.
5. Business and Opportunity losses incurred by me due to his above acts.
My driver has already, repeatedly apologised to Mr X for his mistake. What my Driver did was an error (not a crime under any law) for which he has already apologised but what Mr X is doing is deliberate and well thought out. I request Mr X to evaluate his legal position very carefully and remove the blockade as per above timelines. If the blockade is removed I will treat it as an apology and will close the matter without any hard feelings.
But the larger issue is that today such high handed behaviour is against me and I am being personally attacked, tomorrow it can be against any one of us. Such acts need to be condemned and all efforts need to be made to ensure that we live in a peaceful environment.

I totally agree that for our security we need to restrict / regulate entry of cars. However a system or law has to take care of all exceptions for proper acceptance and implementation without loop-holes. There are many issues involved with this. All these issues have been discussed in the past in General Body Meetings and with the builder. As a consequence of these discussions the parking stickers are not being strictly implemented. A suitable solution is being designed by the RWS and the same will be implemented after due authorisations shortly. Some examples are -
1. You have 1 parking space and 2 cars. You have paid for all the cars and the parking space and thus you have a right to park any of your cars in that single parking. It may be required in case the stickered car meeting with an accident or is gone for service and you need to use your second car. However you will be issued only 1 sticker. 2. There are residents who have personal security concerns and they do not want to publicise to the world their address on the windshields of their cars. What will be done in such case ? Do we want the security of our fellow resident to be compromised ? If their security is breached in our society will it not affect all of us ?
3. There are certain cars which have Infrared sensors on the windshields for various purposes and no stickers can be affixed on the windshield as it will interfere with the systems. What will be done in such cases ? Will we restrict out residents from progressing in life and buying such cars ?
4. Many fellow residents will be forced to buy parking space from the builder at their astronomical prices, if we implement the current stickers strictly. Do we really want to benefit the builder or we should look to benefit our fellow residents. We are trying to work out a parking space rental system with the builder so that the unsold parking spaces can be retained as an asset for the society rather than the builder.
5. How do we handle our visitors parking ? As per court orders all societies need to provide for some parking space for the visitors. Do we want visitors to our neighbours’ place, especially elderly visitors, to park their cars outside ? Do all of us don’t get embarrassed when we have to tell the respected visitors to our home to park their cars outside ?
Hence, we are all intelligent people and we need to use our intellect without jumping to knee-jerk reactions. We need to brain storm and address all issues. We need to formulate a system which can take care of all exceptions without compromising on the security of our families. To speed-up this process we need the involvement of many volunteers, like me, to support the efforts of the RWS which has already made such a huge positive impact. It is a fact that RWS is facing a lot of volunteer crunch and thus everyone is requested to come forward to support our common cause. Individual, unpleasant action against other fellow residents is definitely not the way to go as it will set a very hooliganistic precedent, as Ranjanda has pointed out. We need to be level-headed and classy in our interactions, both internal and external. At least in my experience, aggressive posturing and play-acting may look good and sound good to few people, but they seldom bring good results. I am sure all experienced residents of our society will agree with this mature approach.
Anyways for everyone’s information Ruchhir has finally believed me that the car belongs to me without ownership proof and has removed his blockade. As per my first email I am treating this as an apology and I hold no hard feelings against him. We will continue to be friends as we were before this unfortunate incident.

Your aim of finding the rightful owner of the car was accomplished on Monday morning at 8.45 AM when my Driver informed you or when Avinash informed you that I am the rightful owner. Everything done by you after that was totally unnecessary. I could also have parked 5 other cars around your cars and blockaded everything. I could have gone to the Police as per my lawyer’s advice. I could have towed away your cars or moved your cars physically (Nano can be lifted by 3 medium sized men). But I maintained my class and did not do any of this which I could have done very easily.
Thanks for enlightening all on your educational background, but did I ever question that you are well educated ? I just expect that education and upbringing should mellow people down so that they do not take law into their own hands and respect their fellow residents and human beings, even though they may be less educated. I just requested you to use your own vast intellect and understand that you illegally detained my property, maligned my name on public forums (I have proof of that) and caused a lot of inconvenience to not only me but all your fellow residents apart from threatening a uneducated Driver. In your arrogance if you don’t wish to apologise for all of this then it is entirely up to you. Pls note that your apology will not add to me in any way but will only help to maintain cordiality amongst everyone.
I will definitely fight for every resident who is facing such situations / behaviour from any fellow resident as I firmly believe that we all are equals and we all deserve mutual respect. It is my upbringing and in my first email I apologised to everyone for infringing on their time and I would like to apologise to every one once again for all this. But highlighting this issue was necessary for the future of our Eden Park family so that we respect each other from our hearts. Maybe I will fail with some people but I will keep trying.

Please refrain from providing legal threats as lawyers work for me too. Niceness should not be taken as weakness. If not more, than I'm at least equally educated than anyone around here. I'm from Columbia Business School, we take pride in Warren Buffet being our alumni and it tops all IIMs and ISBs in India. My wife is from Chicago Booth school of Business which is number one MBA in world and Raghu Ram Rajan taught her. I'm on board of several companies in advisor role and head mobility council of CompTIA in US. People here aren't less educated.

My wife is from Chicago Booth school of Business which is number one MBA in world and Raghu Ram Rajan taught her. I'm on board of several companies in advisor role and head mobility council of CompTIA in US. People here aren't less educated.
I personally never met any of them nor has any enemy or support. I simply observed the mail contents which was circulated in the group. If you carefully read the content of email, what message it gives you ?? The person is trying to give more importance to his Educational background and wealth, fame rather than talking to subject matter of wrong car parking. Has he pointed out any words of actual subject? It looks he is fighting personally with Sandeep.
“I'm at least equally educated than anyone around here.” What does it means ? we all are around here How can he quote this? Why he is pointing out, who is he, and what position he hold. Why he needs to tell all about his wife’s education, Columbia, warren buffet and so.. Whatever is he who cares.
Perhaps i am the silent member of group, doesn’t means i am not responsible of any unlawful activity and support the good cause for betterment of society. Dear Mr Sandeep,I would like suggest some solutions to your concerns or raise some concerns on the solutions you proposed for allowing non-stickered cars inside the society.
1. You have 1 parking space and 2 cars. You have paid for all the cars and the parking space and thus you have a right to park any of your cars in that single parking. It may be required in case the stickered car meeting with an accident or is gone for service and you need to use your second car. However you will be issued only 1 sticker. What will be done in such cases ?
>>Builders are smart enough not to provide you enough space to put more than one car in a slot and this is at least true for AEP. This can only be done by giving inconvenience to other residents by parking cars on driveway or in other slots.Also, how would deal with an issue of people rotating one sticker for parking multiple cars and park wherever they find space.
2. There are residents who have personal security concerns and they do not want to publicise to the world their address on the windshields of their cars. What will be done in such case ? Do we want the security of our fellow resident to be compromised ? If their security is breached in our society will it not affect all of us ?

There are still areas on both front and rear windshield that do not have these for anyone to paste radio controlled equipment used in toll recording systems in US/Europe. As we do not have these radio recording systems in India we can use these spaces to paste parking stickers. Also, I am really unsure of how a thin transparent sticker pasted from inside would impact this coating.
4. Many fellow residents will be forced to buy parking space from the builder at their astronomical prices, if we implement the current stickers strictly. Do we really want to benefit the builder or we should look to benefit our fellow residents. We are trying to work out a parking space rental system with the builder so that the unsold parking spaces can be retained as an asset for the society rather than the builder.

No one from this group (Including me) has raised educated or uneducated issue. You are the one who started conversation in this platform to show your education strength and elaborated your background, which has nothing to do with the subject matter. Your one paragraph mail contents looks you are underestimating other fellow members status in terms of education, employment, activity and so on. Everyone here would be more happy if you have written such mails or correspondence to Amarapali for forcing them to execute pending works in society rather than starting “Topics”uneducated issues.

You have raised some valid points but on some points it seems you have misunderstood my suggestions. For example in the first point I am not suggesting that we allow residents to park 2 cars in one parking slot, rather I am suggesting that Residents will park any one of their cars in the parking slot as per their own choice / convenience because it is their right. Our system should address this point. In the second point the people who have security threats also ensure that they can’t be followed home, so it is not so easy as you are envisaging. In the third point I would like to clarify that INFRARED is not a material but are rays which are thrown onto the windscreen from inside to keep a track on the driver’s visibility and weather conditions like rain etc so that Car’s systems can automatically switch on / off the necessary systems. Also these windscreens get heated up as and when required and the sticker will not stay on them for more than a day. So a sticker interferes with these systems and car manufacturers give specific instructions to not put any stickers.
Essentially if we have a system which covers the common concerns / problems of Residents then it will be totally wrong to assume that our fellow Residents will rotate the sticker and park multiple cars, as you seem to be fearing. I think all Residents are equally concerned about the Society’s issues and all Residents understand their responsibilities. We have to follow a democratic process for all our actions and the same can only bear fruit when there is a healthy debate on our various problems.
However, request the concerned at RWS to take note of Abhinay’s suggestion points, include these in the suggestion register and the same should be taken up during discussions on this subject. Also somebody from RWS should contact Abhinay to include him in the volunteer group and assign him some responsibilities so that his enthusiasm and talent can be beneficial for the society. We need more and more enthusiastic residents like Abhinay to come forward as there is a lot going on and we are very short on resources. The current Volunteer Group is heavily over stretched. Look forward to more Residents positively participating in our common struggles.
