आपणास नम्र पणे आवाहन करण्यात येत्ये की ,
२१ जून १३ रोजी बोगस आदिवासी नेत्ये माजी आमदार अनंत तरे यांनी बोगस आदिवासी विरूधात जो महाराष्ट्र शासनाने GR काढला आहे तो त्वरित रद्द करावा असे शासनास निवेदन दिले आहे. सदर मागणी घटना बाह्य असून खर्या आदिवासी समाजावर अन्याय करणारी आहे. बोगस आदिवासी आमदार अनंत तरे यांनी या अगोदर सुद्धा महाराष्ट्रातील संपूर्ण कोळी समाजाल अनुसूचीत जमातीचा ( आदिवासी ) दर्जा मिळावा अशी मागणी केली आहे परंतु आता पर्यंत त्यांना अपयश आले आहे. युती शासनाचा काळात त्यांचा मागणीचा विचार करून त्यांची सत्ता असतान आमदार सुधीर जोशी यांचा नेतृत्वात कमिटी स्थापन करून बोगस आदिवासी आमदार अनंत तरे यांचा मागणीचा विचार करण्यात आला परंतु सुधीर जोशी कमिटीने सुद्धा अनंत तरे यांची मागणी फेटाळली होती.व सदर मागणी घटना बाह्य आहे असे म्हटले होते परंतु तरी सुद्धा बोगस आदिवासी आमदार अनंत तरे हि मागणी लावून धरतात व निवेदन देत असतात तरी खर्या आदिवासींनी एकत्र याव्ये व बोगस आदिवासी हटाव - आदिवासी बचाव अभियानास सहकार्य कराव्ये
बोगस आदिवासी हटाव -आदिवासी बचाव अभियाना अंतर्गत आपल्या कार्यालयात ,शासकीय नोकरीत ,शिक्षण संस्थ्येत, आदिवासीचा नावे बोगस दाखले घेवून नोकरी करणारे बोगस आदिवासीची माहिती त्वरित आम्हास कळवावी.बोगस आदिवासी विरूधात आम्ही फौजदारी गुन्हे दाखल करणार आहोत.
आदिवासी संघटना ,आदिवासी सामाजिक संस्था ,आदिवासी समाजसेवक , विचारवंत ,तरुण-तरुणी यांनी आपल्या नजीकचा शासकीय कार्यालयात ,महाविद्यलयात ,कॉलेज ,शासकीय- निमशासकीय ,बँक, सहकारी संस्था ,पोलीस स्टेशन ,ई. ठिकाणी माहिती कायद्या अंतर्गत शासकीय कर्मचारी जे आदिवासी आहेत त्यांची जात-पडताळणी झली कि नाही याची माहिती घ्यावी व जो आदिवासीचा नावे नोकरी करीत अस्येल त्याची पूर्ण माहिती त्याचे कार्यालय ,त्याच्ये मूळ गाव ,या बाबत माहिती आम्हास द्यावी अगर आपणास गोपनीय रित्या माहिती आम्हास पुरवायची अस्येल तर बोगस आदिवासी हटाव -आदिवासी बचाव कृती समिती सदस्ये व मार्गदर्शाक देविदास वाटाण मो.9226208073 ,अशोक बागुल अहमदनगर मो - 9922965028राम चौरे धुळे मो -9404502495, प्रभाकर फसाळे नाशिक मो - 9923867525 यांचाशी संपर्क साधावा

Dear Friends,
During the visit of Hon'ble Madhukarraoji Pichad Saheb, Minister of Tribal welfare Maharashtra State, at Gadchiroli on 1rst June 2013, some Social Issues were discussed. As per my knowledge since 1981, all our Political leaders, Social leaders, NGOs, Sansthans, Thinkers, Officers, Employees, Authors, Doctors, Engineers, are handling the issue of bogus Adibvasi/ false certificates, an...d reserved posts occupied by bogus Adivasi. This was only major issue before them. We spends our 33 years with full forces From hon'ble Baburaoji Madavi to Hon'ble Madhukaraoji Pichad Saheb, as emotionally and our existences matter. Even to day also we are arounding this issue only.
My friends, if we find out the reason of this issue, we will observe, that this issue created by virtue of areas restriction in constitution. The complementary of provision of constitution and political leaders have created this issues and want to gain politics. Our political leaders are knows about this issues but they unable to explore before their political parties forces.
We westde our 33 years without any conclusion and again we are westing our intellectuals on this issue. Again I would like to narrate here that our no any one function success without presence of our Political leaders or without their supports. But when we through our lights on Ambedkary movements, their intellectuals not calling their political leaders as like BAMSEF Organisation. RSS org. not calling their intellectual meetings. I feel our Adivasi intellectuals is only for struggles of bogus Adivasi, [exceptional some cases.]. by obeserving this issue, I feel that Adivasis intellectual are marketing by Political peoples and also Bogus Adivasi. I requested to youth, what is thruth and what is realities.

राजस्थान के भाजपा-कोन्ग्रेस के 60 विघायको(MLA)ने SC,ST, OBC का आरक्षण बंद (खतम करने के लिये) राष्ट्रपति को ग्यापन भेजी है,

१८ मे २०१३ चा जी आर१८ मे २०१३ चा कोणी काढला याविषयी सध्या महाराष्ट्रातील आदिवासींमध्ये चढाओढ लागली आहे. आमदार ,व मंत्र्याचे महान कार्य होय अशी मल्लीनाथी करण्यात ही मंडळी गुंतलेली आहे.खरे म्हणजे हाजी आर कोणाच्याही प्रयासाने निघो.तो प्रत्यक्षात उताराल पाहिजे.सामान्य प्रशासनाने काढलेल्या या जी आर ला बोगस आदिवासींनी आव्हान केले आहे. आता बघू कोर्ट काय निर्णय देते. परुंत माझा अनुभव व अंदाज हे सांगते. कोर्ट बोगस आदिवासींच्याच बाजूने निर्णय देणार आहे.म्हणू खऱ्या आदिवासींच परीक्षा आहे ती यानंतर. बोगस आदिवासींनी या जी आरला हाणून पडण्यासिठी एक कोटी रुपे जमा केले आहेत.त्यांनी सुप्रीम कोर्टात जाण्याची तयारी केली आहे. पुढील न्यायालीन लढाईसाठी आमची काय तयारी आहे ?

Rajendra Maraskolhe on 06/09/2013 matter was called on for hearing in the supreme court as govt of Mah has filed SLP in relation to 5530/2012 HC Nagpur bench verdict (Mehata /Haque JJ) Dt 10/07/2013. In this matter As per the judgement of milind (2000)and consequently kavita Solanki (2012) services on the basis of false caste certificate were protected by the High court. This particulate issue because of social consciousnesses challenged by State in the SC and today SC grants stay on those orders of service protection passed by HC.

Protection given upto 15.6 95 to SBC ( bogus adiwasi ) vide GR dated15.6.1995 is extended up to 28.11.2000 by linking with Protection given by GOI vide O .M .dated 10.8.2010 to halba koshti/koshti

The GOI through its Dept. of Personnel and Training vide OM dated 10.8.2010 have given protection to halba koshti/ koshti caste from Maharashtra who got appointment against vacancies reserved for the STs and who's appointment had become final on or before 28.11.2000 i.e the date on which the supreme court had decided the C.A .no 2694/88 in case of state of Maharashtra v/s Milind and others.
The effect of this judgement( in milind s case) has been considered by the supreme court in CA no 1547/2000 in case of Punjab National Bank v/s Vilas Govindrao Bokade.
Earlier, GOI vide o.m. dated 29.3.2007 has clarified that the relief accorded by the supreme court in milinds case is as a specific relief provided only to the candidates who were in whose case.
The Supreme court held that there is palpable wisdom in issuing OM dtd 20.8.2010, so for it relates to Halba Koshtis and Koshtis ouster,if their appointment had become final on or before 28.11.2000. Same analogy applies so far as GR dtd 15.6.1995 is concerned.
Further line of action is required by "आदिवासी बचाव कृति समिति /संघटना ,नाशिक / पुणे .

मिलिंद विरूद्ध महाराष्ट् राज्य या केसमध्ये सुप्रीम कोर्टाने दिलेला निर्णय घटनेच्या अनुच्छेद १४१ अंतर्गत प्रस्थापित केलेला न्यायिक कायदा आहे असा निर्णय अनेक केसमध्ये उच्च न्यायालयाने व सुप्रीम कोर्टाने , बोगस आदिवासी अर्थात विशेष मागास प्रवर्गास १५. ६ .९५ व ३०.६.२००४ च्या शासन निर्णयानुसार दिलेले संरक्षण कायम करताना दिला आहे.( *कोर्टाचे निर्णय पोस्ट केले होते)
तसेच सर्वोच्च न्यायालयाने अनेक केसमध्ये *हे संरक्षण नाकारले आहे
व मिलिंद कटववारे केसमधील निर्णय हा घोषीत कायदा म्हणता येणार
नाही असा निर्णय दिला आहे.
सुप्रीम कोर्टाच्या अवलोकनावरुन हे स्पस्ट झाले आहे की जातीचे प्रमाणपत्र खोट्या पद्धतिने(falsely) अर्थात जातीच्या नावात फेरबदल करुन मिलविले आहे हे जात पडतालणी समित्या सिद्ध करू शकल्या नाहीत. ते सिद्ध करण्याचे दायित्व आपल्या सर्वांचे आहे .जातीच्या नावात बदल किंवा नावाच्या पुढे किंवा मागे काना,मात्रा ,वेलांटी,उकार इ.चा वापर करून ST चे प्रमाणपत्र मिलविले असल्यास ;अनधिकृत व्यक्तिकडून नकली_ (forged )जातीचे प्रमाण मिलविले असल्यास ते falsely /fraudulently मिलविल्याचे सिद्ध करता येइल."जात चोर" हे आपले म्हणने सिद्ध करावे लागेल.
ज्या बोगस आदिवासीनी लबाडीने किंवा खोट्या पद्धतीने जात प्रमाणपत्र मिलविले आहे त्याना सरकारने सन २००१ च्या कायध्यात संरक्षण दिलेले नाही
सर्वोच्च न्यायालयाने आपल्या निर्णयामध्ये स्थापित केलेला कायदा /तत्व नंतरच्या निर्णयामध्ये बदल केल्याची उदाहरणे आहेत.मिलिंद कटवारे केसमधील न्यायिक कायदा बदलण्साठी सर्वोच न्यायालयात याचिका कोणत्या आधारावर दाखल करता येइल याचा विचार होणे आवश्यक आहे.

फिर भी जो अपने फर्जी जाती प्रमाण-पत्र की बात कही वो समझ गया हु और इस घिनोने काम की निंदा करता हु, क्या महाराष्ट्र सरकार को इस फर्जीवाड़े की जानकारी है ...
भाइयो ये सिर्फ महाराष्ट्र की बात नहीं हे म.प्र,छ.ग,झारखण्ड,गुजरात,राजस्थान और जहा भी आदिवासियों की ज्यादा बस्ती हे वहाँ की ये समस्या है ,इसका मेंन कारण हमारे जनप्रतिनिधियो की उदासीनता हे,जो समाज का प्रतिनिधि होने के बाद भी सरकार के तलवे चाटते हे , अब तो विरोध करना जरुरी हो गया हे,
आपको m.p की घटना बाताता हु m p एक पत्रकार जो कई साल से फर्जी जाती प्रमाण पत्र वालो के खिलाफ लडाई लड़ रहा था ,उस जुर्नलिस्ट को इतना परेशांन किया गया के उसे आत्महत्या करना पड़ी, उस पत्रकार ने मरने से पहले mp के पुलिस dgp और c.m को सारे सबूत सौप दिये थे लेकिन आज तक कुछ नहीं हो पाया !
ये तो एक घटना हे ऐसे कई उदहारण है,
आपको एक सच्चाई और बता दू ये जो m.p में फर्जी प्रमाण पत्र वाले और कोई नहीं I.A.S ,I.P.S और कई बड़े अधिकारी है जो आज भी अपने पद पर बने हुए है.....
