Nowhere in Rule 50 or 51 of DSEAR 1973 is the requirement of a Building completion certificate/Occupancy Certificate/Building Fitness Certificate issued by the local Competent Authority (D.D.A) mentioned. So, it is crystal clear that it is mandatory to have a Building completion certificate/Occupancy Certificate/Building Fitness Certificate issued by the local Competent Authority which is D.D.A for PROVISIONAL RECOGNITION of a private school.We firmly believe there is deep routed corruption which exposed in recent survey by CMS that Education Department involved and CM asked for detailed study. This school was given approval whether after considering of either CASH or KIND by concerned. Therefore it is important an impartial enquiry and most importantly the safety and security of the children.

Reference regarding grant of provisional recognition to Presidium School, Sector-22, Dwarka without a completion certificate from DDA, it is submitted that while recommending the grant of provisional recognition of Presidium School , in the checklist, the fact that the School has appended a structural stability certificate from Mittal Associates was clearly stated. It is pertinent to mention here that there are some schools who have submitted structural stability certificate from private approved architects and have been granted provisional recognition by the competent authority. As & when building completion certificate issued by DDA (Competent authority) is obtained by the school only then their files are submitted for permanent recognition. Based on this information a provisional recognition upto 31.03.2016 (by which date the school is required to produce BCC by Competent Authority) has been granted by ACT-I branch (HQ) with the approval of Worthy Directorate of Education.

First of all there has to be Transparency in Department which is not there.

The case of regarding Presidium School(Lala Sher Singh Memorial Jeevan VIgyan Trust Society) , Sec-22, Dwarka, New Delhi-77 clear evidence of gross CORRUPTION in Education Deparment and bucking under the MAFIA kind of schools made the BUSINESS module in Education.
The department earlier claimed the School had Completion Certificate.
The evidence from DDA vide 01686 confirmed that DDA have not yet issued Completion Certificate. The Education department issued Provision recognition based on letter from DDA to DUAC. Later on the department tried to clarify that it was based on DDA letter. Now the same Education department state school never had CC but had Structural Safety by some Architect. The authenticity of the Architect is also doubted as no such Registration no found. The certificate is issued to Presidium School but the building and land is belong to Lala Sher Singh.
The Education Act of Delhi 1973 mandated the Building Completion, Occupancy and Fitness certificate for Recognition. This is evidently proves that one after other the Education department tried to mislead and cover up lies and falsehood.
We had recently also noticed another fraud where in Sector 22 Presidium school claim it got award from British Council. On checking the fact we found that it was Presidium School in Sector 16 & Ashok Vihar got some recognition. Which we are pretty sure the British Council will review.
Education department and Delhi Govt will be responsible for any loss and damage to innocent little children, parents and poor staff.
We demand proper vigilance enquiry into the entire matter.
Meanwhile the Education department must issue show cause notice to management of Lala Sher Singh Society.

It is now further expose the process of RECOGNISING a School is based on FICTIONS and UNCOMPLETED or IMAGINATORY documents there by compromising the Students and the future of our Education. I am pretty sure this requires department full review and extensive enquiry.
- The Department vide reply 31/8/2015 still NOT replied on how did School was allowed to function from 2013 to 2014 without Recognition and Completion Certificate.
- The Department now claims that " Presidium School was granted Provisional Recognition vide letter no. F.DE.15964)/ Act-I/ 2014/ 27599-27609 dated 02/ 12/ 2014 by ADE (Act-I)"
- In previous replies Department NEVER ever mentioned that it was PROVISIONAL RECOGNITION.
- How come department issue PROVISIONAL RECOGNITION. Is that in the in the DSEAR 1973 and any further amendments?
- How Come the certificate issued in the Name of PRESIDIUM when the Land, Building and all records read as "Lala Sher Singh Memorial Jeevan VIgyan Trust Society"

- The above is clearly one could make out a Letter from DDA to DUAC for SEEKING Approval and Not a Completion Certificate. Please note completion certificate is issued in APPENDIX-H, FORM-1 by Vice Chairman of DDA. The Department knowing fully the fact accepted a mere letter from DDA to DUAC as CC. The CC is issued to Institution that applied i.e Lala Sher Singh Memorial Jeevan VIgyan Trust Society after DUAC Approval by DDA VC. They mark copy copy to CFO, CE-DDA-Dwk. Please read the Building BYE-LAW 1983 for clarity and details. (A copy of the format for Form 1 and Appendix H enclosed).
- Please note and read para 6.7.3 of Building Bye Law 1983 "In case where the building scheme requires the clearance of Delhi Urban Arts Com-mission, then the Authority shall issue the building permit only after getting the clearance from the Delhi Urban Arts Commission."
- The Completion Certificate may have not even issued after DUAC approval as the other clearance such as LABOUR CESS, Extension of Time, Penalty, Compounding Charges, FIRE NOC, LIFT Certificate, Exterior Certificate, Height Clearance from AAI, Plumbing Certificate, Land Tax/Property Tax from SDMC, Work Contract Tax etc. May be even the application rejected. Have Education department verified all this?
- The School informing the VC DDDA vide Appendix F (SEEKING PERMISSION to Occupy) dated 15/04/2013 as you very well understand Prior to Appendix H.
I would therefore appeal/plea once again:
- Initiate departmental enquiry into Lapse, Delinquency, Dereliction of responsibilities by Department of Education staffs in allowing Presidium School to Function from 2012 to 2014 without Recognition and Completion Certficate (School itself admit build completed only on 15/04/2013).
- Initiate departmental enquiry into Negligence on the part of Department to issue Provisional Recognition based on Letter from DDA to DUAC which is NOT Appendix H (Completion Certificate).
- Initiate Legal and other applicable action against the e Lala Sher Singh Memorial Jeevan VIgyan Trust Society for MISLEADING the Department with documents such as Appendix F and Letter to DUAC as Completion Certificate and running school without Recognition and Completion certificate compromising the safety and security of innocent childrens.
- The Department also may call independent Audit of Presidium or Mother s Pride or Lala Sher Singh Memorial Jeevan VIgyan Trust Society or Florence Nightingale Education Society.
- Annual Report under Rule 180 of DSEAR 1973 be published in public domain u/s 4 of RTIA 2005.
- Confidential enquiry into the Salary disbursement of Teachers, Assitance and all other staffs working in the above mentioned schools/Educ Society/ Trust especially checking the factual information from Staff who left whether the compliance of 10(1) DSEAR 1973 and paid only through cheques and bank transfers including contractual staffs.
- Lapse, Delinquency, Dereliction of responsibilities by Department of Education staffs in allowing Presidium School to Function from 2012 to 2014 without Recognition and Completion Certificate (School itself admit build completed only on 15/04/2013).

Numerous Emails and Bakcground DATA in VOLUMNOUS attached.
First of all the so called enquiry was EYE WASH and at the end it found the enquiry was on something else and not on the complaint and not on the LEAD and Evidence provided and what has already confirmed by RTI by Education Department.
Ofcourse the enquiry also brought out GLARING TRUTH there was NO BUILDING COMPLETION CERTIFICATE but only a letter from DDA to DUAC which is NOT A COMPLETION CERTIFICATE KNOWN TO ALL. Still Education Department went ahead and given RECOGNITION while the SCHOOL WAS FUNCTIONAL from 2012 as evidently provided and reported by WHISTLEBLOWER Citizen.
Now go into some background and details as below
School got land from DDA vide F.19(30)/98/IL/838 dated 31/3/2000. Application for Completion of the building Certificate dated 12/4/2013. The DDA has written to DUAC only on 19/9/2014. So when did school got CC ? One side Department claims School got Completion Certificate. While the Principle of the School state that "DDA has written for approval of completion certificate to the Secretary, Delhi Urban Art Commission vide letter No. F.13(154) /04/BLDG/68 dated 19/9/2014"
So question remains when did DUAC Approved the Executed Building Plan ?
As per our information the DUAC approved it only on 29/10/2014?
After DUAC approves the Building plan then only DDA Building Department issues Completion Certificates. So did Presidium School mislead the Education department or fully knowing the Building approval norms the Education Department Staff approved the Recognition simply based on the letter to DUAC from DDA ?
If that be the fact, how did Department of Education issued recognition vide Letter No. F.DE/15(64)ACT-1/2004/27599-27609 dated 2/12/2014.
This confirms that school defaulted in construction as per allotment of Land policy of DDA within 10 years.
The school Principle made an allegation against the citizen who alerted the Department and sought details, RTI and enquiry simply based on the TRUE FACTS where in proved beyond doubt that School was running without approvals. If the complaint have any VESTED interest as alleged by the Princple of Presidium let it be investigated by CBI , CVC or any agency or Court monitored. If the compliant was bundles of Lies, based on Fabricated and concocted incidents. What stop the Presidium to file a case against such fabrication and propaganda?

Why do a citizen in neighour hood disturb the peace and tranquillity of the school as alleged by the principle. Infact, if any day a visit with Camera recorder one could see the school principle and the school is disturbing the Residence of the Dwarka by Parking illeagally on the main 30 meter road. There were instance when Fire Tenders and other emergency vehicle movements were slow down by this illegal parking. The DTC buses at time decline to come on this road due to this illegal parking. In addition the senior citizens of the area were complaining about the foot path encroached by the School Princple and School and made the citizen to use the road instead of footpath endangering their life and causing even personal injury. Also take note of records from DDA the school have done illegal entries and slope by vandalising public property of the DDA and DDA had demolished some part which again restored by the School Principle and School. It is also on record residents made complaint to then MCD/SDMC at the time of construction of the school pouring the waste water to sector 22 parks with human waste disposal and easing out facility not provided during that period. On smelling the motives of the School Principle and School management DDA immediately covered the vacant land from further encroachment. The huge NEON Board with PRESIDUM written on its prima facie any child will tell that against the MCD norms for Boards and Display of Names as well as certain that without approval of FIRE or other agencies concerned. All these are just few points establishes with sufficient RECORDs and FACTS that the School management and Principle is not with clean hand or background. The School claims that the person associate are GOOD REPUTE. Is this what the reputation of Presidum Management ?
If these kind of background people are going to educate our Future Children and Next Generation then its for the Govt of NCT Delhi to take firm decision in this matter and investigate all the schools with Presidum/Mothers Pride name running across Delhi.
All angles including whther they have Basement and currently what it is being used. How the name of the EWS students name appears actually present in school or only on Register, check the CCTV footage matching students or now. How the staffs are paid and any Labour or other violation such as EPF, ESI, Labour Cess(Especially for the building), Extension of Time (EoT to DDA fully paid or not) Service Tax, Income Tax, Property Tax. After getting approval of the building the amount of alternation done with or without approval. Have the FAR area compromised against actual FAR. Have all penalty, compounding charges duly paid or not. Have the FIRE NoC compromised or not. Have the proper play area provided. Have the public land encroached or not. There are many angles in which investigation required.
We will be also filing various RTI and finding our own sources about other Branches of these School to find out the Motive and nature of their Commercial Running Schools like these.
Now coming to Education Department the complaint was very CRISP and CLEAR about the operation of the school from 2012 without Completion Certificate. While the investigation terms of reference not known to us and reason best known it was not shared. From reading from the letter of Principel of the Presidum school they have previously also replied to Department of Education. Why the same not shared must be answered by Department.
As per Diary No. 574 dated 21/1/2013 is on record of the Department confirms in addition to RTI ID No. 7607 and Appeal filed thereon.
Nowhere in the letter from School denied that School was running from 2012 to 2014 without approval.
Coming to enquiry report consisting of just 7 LINES and 1 Paragrpah :
We have not surprised the manner in this enquiry was conducted. How an enquiry without any terms of Reference. How an enquiry ordered over PHONE ? The report state simply about the enquiry of Mothers Pride School interacting with Students checking furniture, bus, visual articles.. One failed to understand what was the instruction of DDE or Education Officer ?What was the complaint about. The school run as Mothers Pride instead of Presidum ? From this one is firm believe this is motivated and conspired to mislead the matter. As the prime complaint was the Presidum School was run without approval of Building or even recognition from Department of Education from 2012. The Departments own RTI reply admitted the same. Now more and more evidence emerging with all furtile efforts by Department Corrupt officers. I am saying this because the Minister only stated in few days back in the news that our society is build by very bad corrupt Department especially referring to education and had ordered few enquiries.
Why did't the Department of Education not provided information sought under RTIA 2005 ?
Why did't the Department not conducted the hearing as per RTIA 2005 19(1) for the appeal?
Prima facie it is evident from all misleading and repeated denial one after another by Department of Education that there is alleged GROSS NEXUS and CORRUPTION. Which is so far not investigated.
Therefore to ensure a scoetiy and future generation developed for our great nation we need to impart education based on MORAL Values and not from SOUL Selling people. The education that our forefathers and even our latest all admired great APJ Abdul Kalam Saab wanted the education.
The people made education as source of WEALTH. This is could be easilty verifiable if a proper order of enquiry by ED, IT, Economic Intellegence, CBI, CVC and other agencies in such matters.
We therefore demand proper investigation both against the department lapses and the school management.
