Court of Appeal orders retrial of Aregbesola's petition Ahmed Bankole, Ibadan Oyo
The Court of Appeal sitting in Ibadan on Monday ordered the Osun Elections Petition Tribunal to retry the petition of Action Congress's (AC) governorship candidate in the April 2007 gubernatorial election, Mr. Rauf Aregbesola.
Aregbesola had gone to the appellate court to challenge the July 15, 2008 verdict of the tribunal, which upheld Gov. Olagunsoye Oyinlola's victory.
In its judgment, a panel of the Court of Appeal, headed by Justice Victor Omage, said the petitioner was denied the use of vital documents to establish his case.
The documents, according to the appellate court, are Forms EC8A, EC8B, EC8C, EC8D and EC8E.
``On no account should a party be refused his documents to assist him establish his case.
``Election petition must be handled with care. The tribunal was wrong not to have admitted the forms", Omage said.
In the more than one-hour judgment, Omage said that when an appeal satisfied its purpose, it should not be struck out.
``I consider issue three (the non-admission of the forms) in the appellant's amended brief of arguments and interlocutory, as crucial to his case", Omage said.
Omage, who led four other judges, said that the rejection of the security reports at the tribunal was wrong.
Reacting to the judgment, Oyinlola's lead counsel, Mr Yusuf Ali (SAN), said the judgment was fine.
``We are starting all over. That is the beauty of it; there is opportunity for all the parties to ventilate whatever they think is/are their grievances.
"On our part, it is a welcome development. It is like there is no victor, no vanquished. We don't see it as a defeat. For us, we see it as victory, victory for democracy and victory for rule of law", he said.
In his reaction, Aregbesola's lawyer, Mr Charles Edosonwan (SAN), said the verdict was a message for future tribunals that at all times they must conduct themselves ``with substantial justice in mind".
He said the Osun tribunal based its judgment on technicalities rather than "substantial justice".
