C.P. Addition: Joan de Ufford (living 1330), wife of Richard de Weyland, Knt., and John de Bavent, Knt.

Complete Peerage 2 (1912): 426–427 (sub Burghersh) has a good account of Sir Bartholomew de Burghersh, K.G., 4th Lord Burghersh [died 1369]. Regarding his first marriage, the following information is provided:

"He married, 1stly, before 10 May 1335, Cicely, daughter and heiress of Richard of Weyland, of whose age proof was then made, having livery of her lands. She was living August 1354." END OF QUOTE.

In footnote a and b on page 427, the author provides the following documentation for the above statements: Calendar of Close Rolls, 1333-1337, p. 393, and Calendar of Papal Letters, vol. iii, pp. 528, 537.

This record reads as follows:

"1335. May 10. To John Moriz, escheator in Ireland. Order to cause Bartholomew son of Bartholomew de Burghersh and Cicely his wife, daughter and heir of Richard de Weyland, tenant in chief of the late king, to have full seisin of all the lands of which Richard was seised at his death in his demesne as of fee, because Cicely has proved her age before Robert de Holewell, escheator of cos. Norfolk, Suffolk, Cambridge, Huntingdon, Essex and Hertford, and the king has taken the fealty of Bartholomew for all the said lands." END OF QUOTE.

A related entry to the above papal indults can be found in Bliss, Calendar of Entries in the Papal Registers: Petitions 1 (1896): 261. This record was not cited by Complete Peerage. It reads as follows:

Date: 1354. 4 Non. Aug. [2 August 1354].
"Bartholomew de Borewasch the younger, baron. For license to have divine offices celebrated by their priests before him and his wife Cecilia. Granted. Villeneuve by Avignon, 4 Non. Aug. [2 August] ... That he and his wife may choose their confessors, who shall absolve them in all cases not reserved to the apostolic see. Granted. Dated as above. For faculty to his confessor to give him plenary remission at Easter. Granted at the hour of death. Dated as above." END OF QUOTE.

Thus we see that Sir Bartholomew de Burgersh married (1st) before 10 May 1335, Cecily de Weyland, daughter and heiress of Richard de Weyland, and that Cecily was still living 2 August 1354.

Reviewing the original Complete Peerage account, Cecily de Weyland is there stated to be the daughter of Richard de Weyland, but no mention is made of her mother. That Richard de Weyland was survived by a widow, Joan, is proven by Cal. of Patent Rolls, 1317-1321 (1903), which reads as follows:

Date: 7 March 1420. "Joan, late the wife of Richard de Weylaund, staying in England, has letters nominating Simon de Criketot her attorney in Ireland for two years." END OF QUOTE.

In 2008 John P. Ravilious posted conclusive evidence here on the newsgroup that Sir Richard de Weyland's wife was Joan de Ufford, daughter of Robert de Ufford, Knt., 1st Lord Ufford [died 1316], and sister of Robert de Ufford, K.G., 1st Earl of Suffolk [died 1369]. Recently I found conclusive evidence which indicates that Joan de Ufford, widow of Sir Richard de Weyland, married (2nd) John de Bavent, Knt. The evidence consists of two Common Pleas lawsuits, in which Joan, then wife of John de Bavent, sued for her dower rights in known Weyland family property.

l. In Trinity term 1330 John de Bavent and Joan his wife sued the Abbot of Saint Edmund’s, custodian of the lands and heir of Richard de Weyland, regarding a moeity of one messuage, lands, and rent in Onehouse, Finborough, and Blaxhall, Suffolk, and Denise widow of Roger de Colvill regarding one moiety of one messuage, lands, and rent and the advowson of the church of Little Welnetham, Suffolk, which they claimed as the dower of the said Joan. 2. In Michaelmas term 1330 John de Bavent and his wife, Joan, sued William Sturmy, custodian of the land and heir of Richard de Weyland, in the Court of Common Pleas regarding half of one messuage and land in Ash, Norfolk, which the said Joan claimed as her dower. Reference: Court of Common Pleas, CP40/283, image 372f (available at http://aalt.law.uh.edu/AALT2/E3/CP40no283/aCP40no283fronts/IMG_0372.htm).

Joan de Ufford and Sir John de Bavent were evidently married as early as Easter term 1327, which is proven by another Common Pleas lawsuit dated 1327 and 1328 which show John de Bavent was then lord of several Weyland family manors, doubtless in right of his wife's dower:

In 1327 and 1328 John de Bavent sued Robert le Palmere, of Kersey, Suffolk, and Thomas atte Watre in the Court of Common Pleas regarding a reasonable account of the time Robert was his bailiff in Onehouse, Suffolk and Thomas was his bailiff in Blaxhall, Wantisden, Middleton, Cockfield (in Witnesham), and Onehouse, Suffolk. In 1328 John de Bavent sued the same parties in the Court of Common Pleas regarding a reasonable account of the time the said Robert was his bailiff in Onehouse, Suffolk and the said Thomas was his receiver of money. Reference: Index of Placita de Banco 1327–1328 2 (PRO Lists and Indexes 32) (1910): 601.

In summary, we see that Joan de Ufford, sister of Robert de Ufford, K.G., 1st Earl of Suffolk, married (1st) Richard de Weyland, Knt. [died 1320], by which marriage she had one daughter, Cecily de Weyland, wife of Bartholomew de Burghersh, K.G., 4th Lord Burghersh. Joan married (2nd) before Easter term 1327 (date of lawsuit) John de Bavent, Knt. She was living as late as Michaelmas term 1330 (date of lawsuit). He was living in 1337.

RICHARD DE WEYLAND, Knt., of Blaxhall, Cockfield (in Witnesham), Le Fenhale (in Onehouse), Middleton, and Wantisden, Suffolk, son and heir, born about 1290 (aged 22 in 1312). He married JOAN DE UFFORD, daughter of Robert de Ufford, Knt., 1st Lord Ufford, by Cecily, daughter and co-heiress of Robert de Valoines, of Ixworth and Walsham, Suffolk. They had one daughter, Cecily (wife of Bartholomew de Burghersh, K.G., 4th Lord Burghersh). As “Sir Richard de Weyland,” he witnessed a charter of his mother-in-law, Cecily de Ufford, widow, in 10 Edward II [1316–17]. In 1317 he nominated Thomas de Westhale his attorney in Ireland for two years. In 1319 Robert de Saxmundeham, parson of the church of Blaxhall, Suffolk, complained that Richard de Weyland and others forcibly entered his dwelling place at Blaxhall, Suffolk, broke the doors of his house, and carried away his goods. SIR RICHARD DE WEYLAND died shortly before 7 March 1320, on which date the king ordered Edmund de Hakelut, escheator of Ireland, to take into the king’s hand the lands late of Richard de Weylaund, deceased, tenant in chief.. On the same date his widow, Joan, staying in England, had letters nominating Simon de Criketot her attorney in Ireland for two years. In 1320 Edmund de Bermingham, bachelor to the king, asked to be granted £20 worth of the lands of Richard de Weylonde in Ireland during the minority of the heir or to be granted a sum of money ... in consideration of his good service against the Scots and Irish. On 16 Nov. 1320 the king granted William de Wellesleye, king’s yeoman, £20 a year out of the extent of the lands and tenements of Richard de Weyland, tenant in chief, in the county of Waterford, by reason of the minority of the heir. In 1320 the Abbot of St. Edmund sued Cecily, widow of Robert de Ufford, in the Court of Common Pleas that she render to him custody of her grand-daughter, Cecily, daughter and heiress of Richard de Weyland. In 1327 and 1328 Cecily daughter of Richard de Weylaund sued Alexander de Saxmundham, parson of Chiselford, and Peter de Grimeston, chaplain, vouchees of Joan late the wife of Richard de Weylaund in the Court of Common Pleas regarding the manor of Blaxhall, Suffolk. His widow, Joan, married (2nd) before Easter term 1327 (date of lawsuit) JOHN DE BAVENT, Knt., in right of his wife, of Blaxhall, Cockfield (in Witnesham), Le Fenhale (in Onehouse), Middleton, and Wantisden, Suffolk. On 27 June 1330 he and Sir Robert de Ufford witnessed a grant made at Woodstock by Hugh de Turpyton, Knt., to Robert Cokerel, of Ireland. In Michaelmas term 1330 he and his wife, Joan, sued William Sturmy, custodian of the land and heir of Richard de Weyland, in the Court of Common Pleas regarding half of one messuage and land in Ash, Norfolk, which the said Joan claimed as her dower. In 1332 he and Robert de Ufford, Knt., served as mainpernors for Robert de Vere who had been detained in the Tower of London. He was granted protection in 1337, he then going with Robert de Ufford, Earl of Suffolk, beyond seas on the king’s service. At her death, Lady Joan de Weyland, “sister of the Earl of Suffolk,” was buried at Grey Friars in Dunwich Dunwich Priory, Suffolk.

This record is actually dated 7 March 1320, not 1420. Mea culpa.

In my previous two posts, I discussed the evidence regarding the parentage of Cecily de Weyland, 1st wife of Sir Bartholomew de Burghersh, K.G., 4th Lord Burghersh. I identified Cecily de Weyland as the daughter of Sir Richard de Weyland [died 1320], by his wife, Joan de Ufford, daughter of Robert de Ufford, Knt., 1st Lord Ufford. I noted that Cecily's mother, Joan de Ufford, married (2nd) Sir John de Bavent.

In my last post, I inadvertedly gave the wrong Common Pleas reference for the following lawsuit:

In 1328 John de Bavent sued the same parties in the Court of Common Pleas
regarding a reasonable account of the time the said Robert was his bailiff
in Onehouse, Suffolk and the said Thomas was his receiver of money.

The correct citation for this lawsuit is:

In my first post, I noted that the Abbot of St. Edmunds sued Cecily, widow of Robert de Ufford, in the Court of Common Pleas in 1320 that she render to him custody of her grand-daughter, Cecily, daughter and heiress of Richard de Weyland.

The reference for this lawsuit is:

Inasmuch as Cecily de Weyland was then still a minor, all four actions below regarding this suit were accordingly filed on her behalf by her guardian, Henry de Redenhale.
