OT James IV Descents for Alice Constable-Maxwell (1850-1941)

Alice Clare Constable-Maxwell was born 17 December 1850 at Grove Lodge, Richmond, Yorkshire, the youngest of nine children. Her father died two months after her birth, and her mother died four months later, so Alice had no living memories of her parents. She was the second and final of her parents' eight full-grown children (the eldest son died age ten) to marry, on 4 February 1875 at Kensington, London, Philip John Canning Howard of Corby Castle (1853-1934). Alice's daughter Ursula Howard, born four years later in 1879, was the sole grandchild of Alice's parents. Alice outlived all her siblings, and for 34 years was the sole surviving one. She died at Corby Castle on 22 May 1941, age 90.

Alice was the daughter of Peter Constable-Maxwell of Grove Lodge, born 7 February 1807 at Everingham Park, Yorkshire, died 27 February 1851 at Grove Lodge. He married 25 September 1834 at St Michael & All Angels Church, Brimington, Derbyshire, Helena Mary Bowdon, born 1813 at Southgate House, Clown, Derbyshire, and died 16 June 1851 at Grove Lodge.

Alice's paternal line was the Northumberland gentry family Haggerston of Haggerston Castle. In 1746 her great-grandfather William Haggerston legally changed his surname to Constable on inheriting Everingham Park and other estates of the Constable family. Alice's grandfather Marmaduke William Constable added Maxwell to the surname when he succeeded his mother as representative of the Scottish lordship of Herries of Terregles, and that title was eventually bestowed on his eldest son, Alice's uncle. The family also became the senior representatives of the Yorkshire gentry family Middleton of Stockeld Hall, and the Scottish peerage family Stewart of Traquair.

The most recent monarch in Alice's ancestry is James IV of Scotland. She has six lines of descent, through two of his bastard daughters, laid out below, with links to the most recent individuals in Leo's database for each.

As I am sure you are aware, Alice Clare Constable-Maxwell and her husband Philip John Canning Howard, J.P., of Corby Castle, Cumberland share a descent from Sir Henry Howard, K.G. 3rd Earl of Surrey (the poet) and thus are 5th cousins 1 time removed (via their descent from Sir Francis Howard, of Corby Castle, Cumberland and Mary Widdrington). They have another descent from him making them 8th cousins 1 time removed (via Sir Henry Howard, K.G., 3rd Earl of Surrey and Lady Frances de Vere).

I am sure they may well share kinship via other lines too.

Their daughter Ursula Mary Howard's husband Sir Henry Joseph Lawson, 3rd Bt. of Brough Hall, York, Yorkshire, also has a descent from Sir Henry Howard, K.G., 3rd Earl of Surrey and they share kinship via Sir Peter Middelton, of Stockeld, Yorkshire and Mary Ingleby and thus their closest kinship is 7th cousins 1 time removed. They share kinship via the Earl of Surrey via at least two other lines.

Again, they may well share further kinship through other lines.

I do have a question though. Are the Middeltons of Stockeld, Yorkshire known by the Middelton or the Middleton spelling or indeed both and if the latter, when did the Middleton spelling taking prevalence?

The Parish Registers for St John the Baptist Church, Beckford have not been published, and apparently aren't available online. Hopefully they contain the burial entries for Edmund and his wife. The parentage of Lucy Bailey is unknown, though presumably she was from Tewkesbury. Edmund's younger brother Henry Wakeman of London married a Frances Bailey/Bayley from Norwich. Possibly Lucy was related to her.

I presume you meant Hon. Dorothy Tracy rather than Hon. Mary Tracy as per generation NN14 and several sources that list her thus?

This Edmund Bracy or Bracey should not be confused with Edmund Bracey, junior, yeoman, of Beoley, Worcestershire, son of the above (and this brother of Mary) who was born 5 April 1709 and died 28 July 1783.

Whether these Braceys are related to Bressey/Brassey/Bracy of Maulden, Bedfordshire listed in Douglas Richardson's Magna Carta Ancestry, 2nd Edition, I am unsure.

Thank you for catching this. I had thought that the first name of the daughter of the 2nd Viscount Tracy who married William Higford was 'Dorothy', as that is the first name given to her in many sources. Shortly before I made the post to SocGenMed, I found the will of Dorothy, Viscountess Tracy thru the PCC database on Ancestry.com. She very specifically names her daughter, wife of William Higford, as 'Mary', not 'Dorothy'. I changed my database, and changed her first name to 'Mary' in Line EE in my post, but forgot to change her first name to 'Mary' in Line NN. Apologies for the confusion.

You are exactly right. It was 'Edmund', not 'William', Bracey who was the yeoman in Beoley, Worcestershire who died in 1750 and was the father of Mary Bracey Wakeman. It's 'Edmund' in my database. I've no idea where I got 'William' from.

Not a problem at all. I've been watching your recent Edward III posts with interest and have been entering the data into my own database and when possible have tried to fact check or spot errors. It is interesting that in the majority of sources I have seen that her name is listed as Dorothy Tracy. I wonder where the original error was made? Is there not a burial record for her in 1685 that supports her name being Mary rather than Dorothy? Did the 2nd Viscount Tracy leave a Will naming his issue and/or in-laws?

I like to double check. Although the Will of Dorothy is likely more accurate as a primary source.

The only sources I could find re. Bracey of Beoley was related to the Sheldon family and their lease of land in Beoley but I am unsure whether there's any familial relationship between the families.

There are two Edmund Brassey/Bressey/Bracy in the family listed in Richardson's work but it may just be a case of the name being the same without any familial relationship.

It seems to go back at least to 1847, and the Wakeman pedigree in the edition of Burke's Landed Gentry for that year:

What's more curious is that her first name is 'Dorothy' rather than 'Mary' in a detailed account of the Tracy family in 1888:

But the American author Mrs. Matilda O. Abbey was likely relying on Burke's, and not examining original records like wills.

The Find A Grave Index has Dorothy, Viscountess Tracy dying at Eastnor Castle, Castleditch, Herefordshire, and buried at St Andrew Church, Toddington, Gloucestershire:

William Higford hadn't yet inherited Dixton House in 1685, so I'm not sure where they were residing when his wife Mary Tracy died. We know Mary proved her mother's will in the Prerogative Court of Canterbury on 3 October 1685: "Honourabili Mariae Higford Uxori Willimi Higford Esq., filiae", and was her mother's executor. But Mary must've died soon afterwards, as administration of her mother's estate was granted to her husband William Higford on 30 December 1685 because his wife Mary had died. If, as seems likely, Mary and William Higford were living with her mother the Viscountess Tracy at the time at Eastnor Castle, then Mary may also have been buried at Toddington, like her mother. But I haven't checked if the Toddington Parish Registers have been published, or are online.

I would think so. I haven't looked at the Tracy article in Complete Peerage, but if the 2nd Viscount did leave a will, CP is likely to mention it.

Dorothy Tracy's will was summarized in the 1922 edition of Miscellanea Genealogica et Heraldica. Unfortunately I can only see it Snippet View thru Google Books, but hopefully others can see it full view:

Yes, Edmund Bracey was granted a lease of lands in Beoley by the Sheldons in 1708:

It's an interesting idea that it might have been due to kinship with the Sheldons. But since Bracey's son and namesake Edmund Bracey, junior (1710-1783), was a Jesuit priest, the Sheldons could just as readily have supported the Braceys as tenants because they were Catholic:

Many thanks for the link, Jan. Unfortunately I get the message "This item is not available online (Limited - search only) due to copyright restrictions" for that book from here in Vancouver.

Luckily though, it turns out there is a word-for-word full transcription of the will of Dorothy, Viscountess Tracy on pp. 62-64 of '8 Papers Relating to Claims to the Viscountcy of Tracy of Rathcoole' (1841):

On the IGI I found this christening (https://familysearch.org/ark:/61903/1:1:JMQ1-K2B) for a John Higforde to a William Higforde and Mary which fits date-wise to be a son of William Higford, of Dixton House, Alderton, Gloucester and Hon. Mary Tracy and thus a full-brother of Frances Higford who married Henry Wakeman, of Ashton Underhill.

Excellent find, Brad. That proves without doubt that she was Mary Tracy and not Dorothy (she mentions Mary by name more than once and it's clear she is wife of William Higford). William Higford and Mary Tracy appear to have had at least three children therefore, viz. Dorothy, Frances and John Higford (chr. 27 November 1681). Although the Will of Dorothy, Viscountess Rathcoole does not mention her granddaughter Frances Higford. Presumably John Higford died young. I have not been able to locate a burial date for him although there is a burial of a John Higford on 31 Oct 1722 in Saxlingham-Nethergate, Norfolk that might be him (but it maybe a different John Higford).
