On 12/28/17 at 1:57p.m., Sgt. Michael Monaco observed a Ford Focus being operated by Ryan Devine, age 38, of Main Street, Newton being operated northbound on Water Street as he was utilizing his cell phone.
As a result, Devine was stopped on Water Street and Sgt. Monaco observed an empty bag of heroin within the interior of the vehicle. Subsequently, a K-9 was requested from the Sussex County Sheriff’s Department and Officer Justin McCann and his K-9 “Roxi” responded to the scene and a search revealed a full bag of heroin was found inside the vehicle.
Devine was arrested and charged with the following and released pending court.

N.J.S. 2C:36-2 Possession of Drug Paraphernalia (Disorderly Persons)
Devine was also charged with:
39:4-49.1 Drug Possession by Motor Vehicle Operator
39:4-97.3 Use of Wireless Telephone While Operating a Motor Vehicle.
