On 6/24/18 at approximately 12:00p.m., Newton police responded to a Main Street boarding house in an attempt to locate and arrest a resident on an active warrant out of the Sussex County Sheriff’s Department.

 

Upon arrival, patrols were able to locate the subject identified as Daniel Devine, age 34, within the structure and he was taken into custody on the outstanding warrant.  While arresting Devine, officers also observed (5) suspected bags of heroin on a nearby nightstand that Daniel Devine claimed ownership of.


Subsequently, (4) bags of suspected heroin and a small plastic bag with suspected marijuana was also found on a couch within the apartment and Ryan Devine, age 39, (Daniel’s older brother) admitted that those items belonged to him.

As a result, the two Main Street residents were charged with the following offenses:

Daniel Devine

N.J.S. 2C:35-10a(1)  Possession of Controlled Dangerous Substance  (3rd Degree)

 

Ryan Devine

N.J.S. 2C:35-10a(1)   Possession of a Controlled Dangerous Substance  (3rd Degree)

N.J.S. 2C:35-10a(4)   Possession of Marijuana (Less than 50 grams)       (Disorderly Persons)


Both brothers were lodged in the Sussex County Jail.  Case pending court.
