Arrest -Distribution of CDS, Conspiracy to Distribute CDS, Aiding a Person to Sell CDS

On 5/16/18 at approximately 8:30p.m. Daniel Devine, age 34, and his older brother, Ryan Devine, age 39, both of Main Street, Newton, were arrested after a cooperative investigation by the Sussex County Gangs Guns and Narcotics Task Force and the Newton Police Department.  During the course of the investigation, it was revealed that the Devine brothers had distributed heroin within the Town of Newton.

 

At the time of their arrest, the two were found to be in possession of 150 bags of heroin and 2 syringes.  As a result, Daniel Devine was charged with the following:

N.J.S. 2C:35-7.1A Distribution within 500 feet of a Public Place (2^nd Degree)

N.J.S. 2C:35-5B(3) Distribution of a Controlled Dangerous Substance (Heroin) (3^rd Degree) (2 Counts)

 

Ryan Devine was charged with the following offenses:

N.J.S. 2C:5-2 Conspiracy to Distribute a Controlled Dangerous Substance (3^rd Degree)

N.J.S. 2C:5-2 Conspiracy to Distribute a Controlled Dangerous Substance within 500 feet of a Public Place (2^nd Degree)

N.J.S. 2C:2-6 Aiding A Person to Sell A Controlled Dangerous Substance (3^rd Degree)

 

Both brothers were lodged in the Sussex County Jail.  Case pending court.
