On 9/7/17 at 5:09p.m., Sgt. Michael. Monaco stopped a 2004 Chrysler Pacifica on Trinity Street for having a loud muffler. A theft investigation had previously been initiated in regards to a stolen purse from a Halsted Street residence containing an undetermined amount of cash and personal effects in which the rear seat passenger, John Nystrand, age 36, of Halsted Street was a suspect. When he was asked to exit from the vehicle an empty bag of heroin was found at his feet. Nystrand admitted to possessing same and was taken into custody. A search of his person also revealed a hypodermic needle. Nystrand was arrested and charged with the following offenses:
N.J.S. 2C:36-6 Possession of a Hypodermic Syringe (Disorderly Persons)
N.J.S. 2C:35-10a(1) Possession of Drug Paraphernalia (Disorderly Persons)
Subsequent investigation, revealed that the driver, Daniel Biermann, age 29, of Spring Street, Newton had a suspended driver’s license. Biermann consented to a search of the vehicle and the search revealed a fabric bag that contained several hypodermic needles, numerous empty bags and 3 full bags containing heroin. Biermann admitted to ownership of the items and was also taken into custody. As a result, he was charged with the following offenses:
N.J.S. 2C:35-10a(1) Possession of a Controlled Dangerous Substance (3rd Degree)
N.J.S. 2C:36-6a Possession of Hypodermic Syringe (Disorderly Persons)
N.J.S. 2C:36-2 Possession of Drug Paraphernalia (empty bags) (Disorderly Persons)
39:3-40 Operating a MV while his Driver’s license was suspended.
39:4-49.1 Possession of CDS in a Motor Vehicle
39:3-70 Loud Muffler
Both subjects were processed and released after being charged on complaint summonses. Matter is pending a 9/27/17 appearance in Superior Court.
