Arrest-Poss of CDS, Paraphernalia, Syringe

On 10/8/17 at 4:42p.m., Newton Police responded to the area of the St. Joseph’s Cemetery for a report of a male and female who appeared to be unconscious. 


Upon arrival, the male and female in question were located and identified as Shereen McManus, age 27 and David Hearn Jr., age 32, both of Hopatcong.  In the immediate vicinity where the two were sleeping were numerous empty heroin bags and an uncapped hypodermic needle.

Both subjects were awakened by responding patrols and exhibited signs and symptoms of being under the influence of heroin.    McManus was found to be in in possession of numerous heroin bags with trace amounts of heroin, a hypodermic needle, a crack pipe and a tie-off that was around her arm.  Hearn was found in possession of 5 bags of heroin, numerous empty heroin bags and a hypodermic needle.  There were also numerous hypodermic needles on the cemetery grounds that were collected and disposed of by the officers.


Each were arrested and charged with the following offenses before being released on a summons.

N.J.S. 2C:35-10a(1) Possession of a Controlled Dangerous Substance (3RD  Degree)

N.J.S. 2C:36-2 Possession of Drug Paraphernalia   (Disorderly Persons)

N.J. 2C:36-6   Possession of Hypodermic Needle   (Disorderly Persons)

 

On 10/10/17 at 7:55p.m., Sgt. Michael Monaco was on duty when he observed McManus and Hearn to be present behind the mausoleum in the Newton Cemetery.  Subsequent investigation by Sgt. Monaco revealed that Hearn was in possession of a hypodermic syringe and 29 bags of heroin. 

 

As a result, Hearn was additionally charged with the following offenses and lodged in the Sussex County Jail in default of bail.  McManus was not charged in this latest incident.

N.J.S. 2C:36-6           Possession of a Hypodermic Needle  (Disorderly Persons)

 

Both individuals were provided information relating to the C.L.E.A.R. program.

Ptl. Jose Morales, Ptl. Russell Post, Sgt. Thomas Muller, Sgt. Michael Monaco, Ptl. Kenneth Teets and Ptl. Jared Zappa.
