Licensing and Terms of Use

1. I understand from responses from TheViz that I may use the API for
commercial purposes including using it to allow customers to use it in
conjunction with other applications that I sell on a SaaS basis, but
under the license may I upcharge a subscribing customer for access to
the benefit of the API with their current application subscription?

2. Also, if I have SaaS customers that require me to use software
escrow, is there a way to put the API code into software escrow (i.e.
if I have contract requirement to put all libraries and code into
escrow)?

3. Also, what is a Service under the TOS? Is it only stuff provided
by Google?

4. The TOS alludes to a possible written agreement with Google to
extend the TOS beyond its current limitations. Is there a point of
contact to engage in those types of discussions?

I'm no lawyer, so take my interpretation with a huge grain of salt here, but I believe that the TOS allows you to charge for services that are supported by the API, but you cannot charge specifically for access to charts built on the API.  Also, the TOS strictly forbids downloading or otherwise obtaining the source code for the API, which would probably prevent you from putting the code in escrow.

In all likelihood, the generic license agreement does not meet your specific requirements, so you would have to have a special one drawn up (assuming Google is willing to do so).

As mentioned in our ToS, commercial usage is indeed permitted - but downloading the library is not.
Deepest apologies - but we do not currently have the bandwidth to negotiate modified versions of the ToS.
