problem with scaledSize Icon using IE8 and version 3.7

The scaledSize function for icons seems not to work in the new API version 3.7 together with InternetExplorer8.

The original beachflag-icon is 20px width and 32px high. In my example I reduced the iconsize with the size and scaledSize parameters to 10px,16px.
It works with Firefox, Chrome, IE9, but not with IE8 which is worlwide still the most used browser.
And it worked with IE8 in the former API version 3.6 as you can test in my second example (same map with version 3.6) here: http://www.ralf-wessels.de/test/apiv3/marker_infowindow_v3_6.html

Is this a known bug? Am I doing something wrong?  Is there a solution for this problem?
