Ref to our RTI Application disposed ref No. MORTH/R/2013/60772
The reply found that a Single person request that too a former IAS officer Mr. Pradeep Singh that too for his PERSONAL Vehicle  the Number Format designated through CMV were amended by MoRTH staff without the amendment of CMV.
The info sought under which Provision amended the numbering and its information were denied by MoRTH.
This was done in-spite there was objection from NIC and the software as well as problem for Law enforcement agencies. The unique style for the entire country is compromised on the request of a single individual and INSULT TO PARLIAMENT and other authority who debated and finalized the CMV
The notes also clearly mentioned the OBJECTION and reason for not agreeing to this ILLEGAL AMENDMENT.
We here by brought to New Govt through this Appeal the IMPROPER Method to change the numbering of vehicle in the country by a few Officers, which is totally illegal.
As it is learned there were clear order from Courts on HSRP where the MoRTH not brought this to the court notice intentionally.

We would like to whether the Jt. Secretary of MoRTH have the power to amend the CMV Act and change the Vehicle Registration based on identification of state with new system to AMEND and SCRAP for influential people. 
 
This policy is issued without AMENDING the original CMV Act provision.
 
We therefore demand immediate response from MoRTH.

It take AGE's to get an Act or Rule amended in larger Public Interest.
Take latest example of Central Motor Vehicle Act 2007 passed by Cabinet on 1st March 2012.
 
While for Influential people in the MoRTH administration WITHOUT amendment issue orders at own will and descretion the Rules and Act in favour of few individuals or so called class.
 
This is classic example after long debate and policy. The Govt of India asked all state to adhere uniform Number Plates with State Code in code which easly could locate by RTO http://en.wikipedia.org/wiki/List_of_RTO_districts_in_India with STATE CODES.
 
Since every TOM, DICK and HARRY in our country want to SHOW OFF and pretend he/she is VVIP of this Country, the number plates wanted to decorated in that way so do there is high demand. Yes if wise people at MoRTH and Transport Departments of various States Govt this would have really REVENUE Model as just like Chandigarh did it earn over 10 Lac per ONE Number Plate of VVIP.
 
Now it HARD to beleive that MoRTH officials and Local Transport Officials and Politician are not benefitting from this VIP Number Allotments!!!
 
This so called allottment of OLD Numbers under RETENTION a SIMPLE Letter which have NO POLICY or AMENDMENT to RULE or NOTIFICATION and SECRETLY served to State Transport authorities. Who further keep it in their domain. The said letter RT/11036/21/2009/-MVL dated 9th Feb 2010 is against the Basic Rules of CMV Act and set pratice. This also cuase confusion for public and even law enforcement agencies to trace such numbers.
 
We there for reques the MoRTH to withdraw this immediately.

Ref: DL-x-F series started issue from 24/7/2003.

        DL-x-F Series falls under FANCY and Not VIP (except 1-100 & 786).

        VIP/Fancy numbers freeze on 6/8/2007

        by Govt of NCT Delhi Cabinet Decision No. 1252.

        Freezing Removed 20/3/2008

     

Please provide following information under Right to information Act 2005.

 

                                

  1. Ref to attached File Noting of Transport Department :

 

a)     Under which provision or clause of CMV  & DMV given permission to Delhi Transport Minister to amend the Numbering as stipulated in Section 41 (6) of CMV Act  and allot DL-x-F serious.

b)     Have the Transport Minister violated the CMV Act or DMV Act or Rules by starting a new serious against set protocol & rule.

c)     Have the Policy for pricing VIP/Fancy Number put up to cabinet on 24/12/2007 ever been resubmitted ? If not please provide reason for not taking up with Cabinet for the REVNUE Model as stipulated in File Noting on Page No.7 N.

d)     The draft Policy is evident in the absence of Policy Delhi Govt is causing Revenue LOSS to exchequer. The delay of non policy is on part of which department and name of the staffs involved.

e)     As per records shows Ref No. PA/JC(OPS)2004/TPT/8354-58 dated 26/7/2004 which reiterated in File Noing Page No. 4(N)(Ref NO. 56) listed as VIP Numbers.

1.      Have department issued the above ref listed numbers to any one in normal course other than dignitaries listed as 18.

 

 

  1. Please provide list of amendment made on VAAHAN Software by Delhi Transport Department to change the Number Sequence and Code Sequence for type. This info should include name of the officer asked for amendment and reason for amendment under CMV and DMV Act/Rules.
  2. As per para No 22 & File Noting  on No. 7 N ( Page 53) by Shri. A K Srivastava Asst Director (Ops) is EVIDENT of REVNEU Model for VIP Numbering and proposed Rule 34 A to DMV Rule 1993. As per record this amend rule is this is  for Revenue collection on VIP/Fancy Numbering which are on high premium and high demand ?  
  3. As per record Have Hon. Supreme court officially made any request to withdraw the Cabinet Decision  to freeze or Allot VIP Numbers without a Policy?
  4. As per file Noting No. 14-N(Page 46) stated the CM approved vide minutes of 15/1/2008 the 6 category of people for Special Registration SUBJECT TO CABINET  DECISION.

a)     Please provide the date on which Cabinet approved the Special Registration to various category of people.

b)     If No Cabinet Approval, how the numbers are allotted and under which power delegated and whom the Cabinet Power is delegated.

c)     Does Principle Secretary to CM, Transport Minister or Chief Minister have the power to over rule the decision of Cabinet Decision? If so please provide relevant rule/section

d)     Please provide reason for LG Official Vehicle in the category as LG Vehicle actually don’t display any Number Plate and as protocol it shows only National Emblem.

e)     Have Govt of NCT Delhi received any request from CAG to include the official vehicle of CAG into Special Number/VIP/Fancy Numbers ? If so please provide copies of the requests. If no request received please provide reason for inculcation and on whose direction.

f)       Have Delhi Transport considered surrendering VIP/Fancy Number allotted to 17 category people once they sold the vehicle to third party to arrest misuse if any one got a VIP/Fancy Number under above category and then sell the car immediately or later stage.

g)     Under what Provision the PRIVATE VEHICLES of Senior Officials of Govt of NCT Delhi (IAS & JAG) qualify as DIGINITARIES. On whose direction this group was included.

h)     In case a citizen want to challenge the inclusion of non official vehicles suchas above Govt Officials and MLA/MP;s personal vehicle, whom to approach. Is there an appeal authority or citizen have to approach the court ? Does this qualify under current Lokayukta or any other authority.

i)        When a Supreme Court Judge is not eligible for VIP/Fancy Number registration for their PERSONAL Vehicles. Under what provision the Govt of NCT Delhi Employees/MLA/MP's allowed Special Registration Number of Private Vehicles.

7.   Retention Registration Mark of OLD Moto Vehicles on New Vehicles  

a.      Have the Dept of Transport disclosed through website policy on above Retention of Old Vehicle No on New Vehicles ?

b.      If not please provide reason for withholding the information from public domain.  

c.      Have all the procedures and rules for the above is informed through advertisement and public notice ?

d.      Please provide the method and procedure of Delhi Transport Department to verify the old vehicle is scrapped. Have the video/photographs and visit/Certification by Govt staff is ensured?

e.      How many vehicles were issued such Old no retention to new vehicles issued by Delhi Transport Department till date.

f.        Please provide complete list through website and copy by email.

g.      Have the Traffic and other law enforcement agencies were informed of the new vehicles issued old vehicles?
