Dear Sir,

Vide ref Id No. 60186 dated 18/8/2014 I filed an RTI Application online seeking some important information from records of CIC.

It was a surprise for many the Transparency Body which decides on appeals and complaints of RTI Act 2005 matters denied the information and even not responded after  60 days.

On record the appellant filed over 300 RTI Application in the larger public cause and due to corrupt practices in CIC for the last 3 years no Appeal and Complaint filed with CIC due to its failure to have any confidence on citizen. The integrity of both CIC Members and Staff at low due to facts sought in the RTI and now the denial cemented it further.

Instant appeal here by filed u/s 19 (1) of RTIA 2005 against the CPIO and PIO of CIC for breach of RTIA 2005.
Appeal here by request the FAA to conduct the hearing as per Section 19(1) and direct the CPIO and PIOs to provide information sought para by para.
Appeal here by request the FAA to order enquiry for the reason for delay and denial of information sought. The matter be recorded in the personal files and ACR of the respective CPIO and PIOs for delinquency and not comply with directions and against the issued orders as duties assigned.
Appeal here by request FAA to ensure and direct the CPIO and PIOs to put all the relevant information in the public domain of the CIC website and on notice board, including this RTI Application.

Along with this appeal, I here by file the complaint u/s 18 of RTIA 2005 against the CIC CPIO and PIO for Denial of RTIA 2005 Application and Delay with clear intention. Therefore appeal to CIC to register a complaint u/s 18 of RTIA 2005 and proceed the enquiry as mandated. In case the CIC Members as addressed above have any reservation on the complaint, they may please intimate the appellant on the matter within 7 days receipt of this email.

Lets walk the talk, ensure transparency and zero tolerance to corruption in CIC(with denial this establishes).

An RTI with CIC after I stopped over 3 years not filed single appeal/complaints with CIC due to its favouritms and biasness towards PA
 
 
  1. Please provide the web link to access the Annual Assets Reports submitted by CIC Members and especially all category off Staff.
  2. Please provide if any member or staff exempted from submitting Annual assets Report, if so names and reason recorded for the exemption
  3. Please provide if any member or staff defaulted  submitting Annual assets Report
  4. Please provide the name of CVO at CIC
  5. Please provide list of Vigilance enquiries and complaint received by CIC against its staff.
  6. Please provide the method and mechanism exist in the CIC to check misuse of authority by staffs and CIC Members either Cash, Kind or Material benefit from Public Authority.
  7. It was noted that there are numerous procedures established such as the link below by CIC for Appellant to submit the Complaints u/s 18 and Appeal u/s 19(2) with CIC, while NO such procedure found for CPIO,APIO,SPIO and FAA. (http://cic.gov.in/Checklist-ac.pdf)
  8. Please provide reason recorded for giving exemption and favour to FAA, CPIO, APIO, SPIO and harassing the innocent citizen appellants by CIC staffs rejecting the appeals and complaints.
  9. Please provide the list of Appeal and Complaints rejected by CIC staff without hearing or opportunity to appellant.
  10. Please provide under which section the appeal and complaints are rejected by staff, if so provide the clause and section under RTIA 2005 and power delegated staff by CIC.
  11. As per records since inception year wise and CIC Member wise list of Appeal filed u/s 19(2) qualified for penalty for Rs. 25000 u/s 20 of RTIA 2005.
  12. As per records since inception year wise and CIC Member wise list of Appeal filed u/s 19(2) qualified for penality for Rs. 25000 u/s 20 of RTIA 2005, where in CIC have not imposed and done favor to Public Authority and caused Revenue Loss.
  13. As per records since inception year wise and CIC Member wise total revenue loss to exchequer.
  14. Have CIC prepared annual report for No of Appeal u/s 19(2) and 19(3) filed by appellant and demanded penalty u/s 20 and qualified on records/evidence submitted for the same. If so please provide the copies through cic website.
  15. Have CIC prepared annual report for No of complaints  filed by appellant and demanded penalty u/s 20 and qualified on records/evidence submitted for the same. If so please provide the copies through cic website.
  16. Have CVC,ACB, CBI, ED or any other agencies investigated whether the CIC members have made material or other benefit for not imposing the Amount Rs. 25000 where in clearly on record of appeal and complaint of Appellants found violation of RTIA 2005.
  17. As per website of CIC While referring through CIC decision it was also found that in cases where Appellant not present personally the cases where written argument submitted were not considered. Please provide section under which RTIA 2005 made it mandatory for appellant to present during the hearing.
