CIC gives illegal order which helped the DDA.

Information Commissioner at CIC gives an illegal order and a free hand to Public Authorities to reject any RTI application.

 

Dear All,

In a recent CIC order dated 07.07.2014, not only the Information Commissioner at CIC has redrafted illegally the meaning of the “information covered in Sub-section 2(f) of RTI Act”, through his biased & illegal dismissal order by dismissing my Complaint case, he has saved his friend Mr. S.N.Gupta (the Appellate Authority at DDA) and his subordinate PIO/ APIOs at DDA from the provisions of RTI Act of severely punishing them on account of delay in providing the initial RTI reply from PIO through which only the part information was provided and making a excessively delayed First Appeal order (after 200 days of making the First Appeal to him) through which he (Appellate Authority) illegally claimed that “the inspection of files/ record” has already been facilitated to the RTI applicant.

 

Shri S.N.Gupta, at present Commissioner (incharge) – cum – Secretary at DDA was Director (RL) – DDA & Appellate Authority (who made the illegal appeal order after 200 days) and was at Ministry of Urban Development before coming to DDA. Mr. M.A.Khan Yusufi, the Information Commissioner, has also served as Jt. Secretary & Legal Advisor at Ministry of Urban Development.

 

In his decision dated 07.07.2014, the Information Commissioner at CIC challengeably states that“(Commission) feels that all issues (of RTI application) dehors Section 2(f) of RTI Act” and term that information (unexempted & very general nature) required by me (RTI applicant) from an unexempted authority i.e. DDA – New Delhi does not come under the preview of RTI Act.

 

According to the Oxford Dictionaries, meaning of ‘Dehors’ (a French word) is; “Other than, not including, or outside the scope of”
