CIC ORDERS TO PUBLISH AGREEMENT WITH THE PRIVATE DENTAL COMPANY.

The appellant sought information regarding action taken on a complaint filed by him against Dental Life, Zakir Hussain Marg, New Delhi along with replies received by CGHS, if any, details of other complaints received against the same clinic and a certified copy of agreement/MOU with M/S Forsan Healthcare Pvt. Ltd. for dental treatment of beneficiaries.  Relevant facts emerging during hearing: 

Both the parties are present. The appellant filed an RTI application dt. 22.10.2013 seeking the above information. The PIO provided a point-wise reply. The FAA did not dispose of the appeal. 

The appellant stated that he is satisfied with information on all points except Point (f), i.e. the agreement/MOU with M/S Forsan Healthcare Pvt. Ltd. for dental treatment of beneficiaries, which he has not received till date. The respondent stated that the same was under submission to Higher Authority at the time of filing of RTI application but as of now the same is before

the Vigilance Dept. for enquiry. On query by the Commission as to why the same cannot be provided even if it is with the Vigilance Dept., the respondent failed to give a proper answer.

Decision: 

After hearing both the parties and on perusal of record, the Commission directs the CPIO to provide information on Point (f) of the RTI application to the appellant, within two weeks from date of receipt of this order, under intimation of the Commission. 

Further, the Commission directs Additional Director, CGHS(HQ) to make the

agreement/MOU with M/S Forsan Healthcare Pvt. Ltd. for dental treatment of beneficiaries, available u/s 19(8)(a)(iii) of the Act.

The appeal is disposed of accordingly.
