Is there any particular requirement for the owner has to stay in his house to get it converted to freehold. Is it mandatory?

I hope it is not mandatory. Free hold helps mainly for resale purposes and are exempted from paying Ground Rent of the flat.

Yes, it is not mandatory, but DDA officials ask for telephone bill, bank account in owner's name at that address apart from voter I'd card and aadhar card.

No no. There is no such requirement. In my society more than 30 flats got converted to freehold which r on rent for 5 yrs plus.. Owners didn't stayed in the dlat for one day !!!

U r right Rama ji, these were earlier requirements, i m informing about these days demand of officials. In my society too many flats hv been converted them while on rent.

All other documents generated on living only

Step by Step Guide Book for Conversion of Land from Lease hold to Freehold

Step-I A brochure along with Application Form regarding conversion scheme can be obtained from the Sale Counter of DDA at Vikas Sadan, 'D' Block INA, New Delhi-110023. It is also available in designated branches of Banks.

Step-II Fill the application form for conversion and attach following documents :-

  • UNDERTAKING regarding payments/ dues/ mis-use duly attested by Notary Public/First Class Magistrate.
  • AFFIDAVIT regarding physical possession/ground rent duly attested by Notary Public/ First Class Magistrate.
  • INDEMNITY BOND regarding convenants with the lessor duly attested by Notary Public/First Class Magistrate.
  • Copy of Power of Attorney alongwith Sale Agreement (where application is made by the attorney) duly attested by Notary Public/ Gazetted Officer.
  • Copy of Completion Certificate/ "D Form" (in respect of all plots & flats allotted by Co-op.Gr.Housing Societies) duly attested by Notary/Gazetted Officer.
  • Proof of Physical possession of the persons in whose names conversion is sought viz. House Tax Receipt/Ration Card / Passport/ Driving Licence/ Identity Card etc. duly attested by Notary Public / Gazetted Officer.
  • Four Attested Passport Size photograph and four attested specimen signatures in whose favour the conversion is sought duly attested by Notary/ Gazetted Officer. {If the applicant is allottee/lessee/sub-lessee, then his/her photograph & in case of applicant being an attorney, photographs of person(s) named in column 3 of the application form are required to be submitted}.
  • Copy of Lease Deed/Sub-lease deed/Conveyance Deed/demand letter duly attested by Notary/Gazetted Officer.
  • Copy of No Objection Certificate (NOC) from the Mortgagee(s) duly attested by Notary/Gazetted Officer.
  • UNDERTAKING regarding payment of difference, if any, in conversion charges(duly attested by Notary/First Class Magistrate.

These formats are available in the brochure. A copy of the acknowledgement report must be retained by the applicant, which details all the documents submitted alongwith the application.

Step-III Submit the duly completed application form alongwith conversion charges and other dues at any of the designated branches of Canara Bank, Corpn. Bank, Bank of Baroda and Central Bank of India.

Step-IV On receipt of application in the concerned Land/Housing Branch the case is referred to Accounts Branch for verification of payments & issue of N.O.C. In case there are any outstanding dues or non- verifiable payments, intimation is sent to the applicant alongwith deficiency noticed, if any. This deficiency generally relates to :

  • any payments due,
  • any document missing/not submitted.

Step-V DDA has prescribed a time limit of 90 days to issue Conveyance Deed. In case no response is received from DDA, contact Dy.Dir./Director/ Commissioner of Housing/Land Branch.

Step-VI After the conversion is allowed by the competent Authority the concerned branch will send Conveyance Deed (CD) papers to the applicant for stamping from the collector of Stamps, Govt. of Delhi. A counter of the Collector of Stamps has been opened at 'D' Block, Vikas Sadan, New Delhi for the convenience of the public. Submit an application to Collector of Stamps Office affixing Court Fee Stamp of Rs.1.25 paise along with following documents :-

  • Four copies of CD Papers duly filled,
  • Copy of demand letter and Lease Deed,
  • Copy of Sale agreement & GPA{in case of purchaser},
  • Four copies of Treasury challans,
  • Receipt of payment of Rs.5/- on account of file charges to be deposited at the counter of Collector of Stamps.

Step-VII On receipt of application for stamping, the Collector of Stamps will issue a slip indicating the date on which the challans indicating the amount to be paid will be issued. {Presently the time prescribed for intimating stamping amount is 5 days.}. The challans are required to be collected from the Counter of the Collector of stamps.

Step-VIII On the due date, obtain challans (4 copies) from the counter of Collector of Stamps, GNCTD and deposit the amount in Treasury i.e. State Bank of India,Vikas Sadan, INA.

Step - IX After the challan/amount is deposited in the Treasury, they will return one copy of challan to the applicant. Get the challan photocopied and submit the 4th copy of challan(in original) alongwith photocopy at the counter of the Collector of Stamps. The Collector of Stamps office will return the photocopy of challan indicating the date on which CD Papers duly stamped will be provided to the applicant. {Presently the time prescribed for issue of stamped CD papers is 15 days.}

Step -X Collect stamped CD Papers (Three copies) from the counter of Collector of Stamps located at 'D' Block, Vikas Sadan, INA, New Delhi.

Step -XI Submit Stamped CD Papers (Three copies) to Housing/Land Branch at Reception counter of DDA in Vikas Sadan for execution of CD Papers requesting for date of execution.

Step -XII DDA will intimate the date on which the execution of CD papers will be done.

Step -XIII On due date contact the Lease Administrative Officer (LAO), DDA along with 2 witnesses and proof of identity of witnesses and self. Also bring four passport size photographs, copy of original Lease Deed (if executed)and possession certificate.

Step - XIV After execution of the lease, LAO will hand over two copies of CD Papers to the applicant for getting the same registered in the office of Sub Registrar, GNCTD. The applicant can get the CD papers registered either at office of Sub- Registrar, GNCTD located at Vikas Sadan, INA or in the Sub-Registrar office in whose jurisdiction the property falls.

Step -XV The Sub- Registrar office will return one copy of Registered CD to the applicant on the due date indicated on the receipt. {Presently the time of 30 days is prescribed}.

Step - XVI On the due date obtain Registered CD from the office of Registrar and forward photocopy of the registered CD to DDA for record

Not necessary. I have helped in doing freehold to two of my members. They were not staying there. But the DDA, as usual to the highness of stupidity, asked proof of stay like government telephone connection, ration card (?), electricity bill in the person's name (?) ... but I then gave a letter saying I am the Secretary of Abhiyan CGHS Ltd etc. One can make it...

Yes that's correct, it is not mandatory to stay in CGHS flat to convert it into freehold. But DDA always ask at least one additional document (other than share certificate, possession certificate) to prove that one has possession of same flat. The easiest way is to update bank account address (this can be done based on share certificate & possession certificate) and same can be presented to DDA.

If there is Tatkal Passport & tickets
Why can't DDA also  start Tatkal sewa?
As to free hold there are agents charge huge amounts those who want without hassling  n hurrry

It's much easy these days am told to get CD!

The online system also exists, try that

Technically correct

In sale deed it is clear possession handed over to buyer.

But DDA will question Seller was having possession?
As buyer has paid so much amount without possession?

Requirement of physical possession of flat is Electricity Bill issued by B S E S, PNG gas bill in the name of owner of the flat, voter I Card and if you have another address on voter I card then papers to the title deed of that addess

I think we are getting confused with the original query of Sudha. If I understand, Sudha want to know "'whether it is mandatory for the member to stay / hold possession of the allotted flat while applying for freehold conversion??. The answer to this question should be : It is legally permissible and allowed for a member who got a flat allotted to keep it vacant or put it on rent. the question of SALE DEED don't arise till such time the flat is FREEHOLD (till such time, it is on a PERPECTUAL LEASE wherein DDA will remain LESSOR, society/ members are LESSEE. A person with leasehold rights cannot SELL his flat (hence the question of SALE DEED don't arise here.

Why DDA is asking for such documents are "in pure terms" FISHING. If the person provide any document, DDA will further ask the person to provide ownership of the address mentioned there to see whether such person fradulently obtained allotment... There is an internal guideline note in DDA for this purpose. Electicity Bill, PNG connection, voter id card, aadhar card are all provided based on society's allotment letter ( the proof of possession is LETTER OF ALLOTMENT). .

Dear, you are wrong. Proof of physical possession is Electricity Bill issued by B.S.E.S. or P.N.G. Bill. in addition Possession cum Allotment letter issued by Society. Now if one has another address on Voter I Card/Adhar Card/Driving licence which is an address proof and identity proof D.D.A is asking for papers to the Title of Property for that address, in order to satisfy that property does not belongs to the person in whose name the flat is reason being no one can own two properties in Delhi provided the area of another property is more than 66.66sq. Meter. This is established law in delhi
